The Daily Mirror reported on some of the latest evidence to emerge in Mark's case on 14 May 2020, following an investigation by their journalists, who carefully examined freshly obtained documentation from HMRC and other sources. The version that appeared in the newspaper was headlined 'Evidence of my dad's secret life will prove I did not kill him' while their online piece opened with 'Public Schoolboy who murdered dad says 'secret life' evidence proves innocence':

After 10 years of wrongful imprisonment, we seem to finally be turning a corner. We are appealing to the public for any new information about Sami's death or his past.

How exactly can any of this offer evidence of Mark's innocence?

We know that Samuel Alexander (Sami Fahmi El-Kalyoubil) used many different names after moving to the UK from Egypt, foreign nationals often take British names. He might have been a live wire at one time but at the time of his murder he was being looked after by home helps and was in poor health.

In my opinion, the existing evidence in this case does point to Mark Alexander having carried out the murder, most probably in a moment of rage after years of being controlled and manipulated by his father.

The method of his burial is indicative of someone having filled in the grave on a number of occasions. No stranger is ever going to put them-self in such a situation.  The story about the underpinning of the garage wall is a load of codswallop too, it just isn't plausible.

So there are quite a few strands to this. In summary, the new evidence demonstrates:

1) That Mark grew up in an environment of extreme privacy in which he was conditioned into maintaining total secrecy for his father and covering his tracks.

2) That Samuel was in the habit of cutting off contact with people, avoiding detection, and evading calls and letters when it suited him. Samuel could be expected to go away for periods of time without telling anyone where he was going.

3) That other possible motives existed for Samuel's murder

4) That alternative suspects exist (and that the jury should have been made aware of this)

The first two points undermine some of the key arguments made at trial that Samuel's disappearance in September 2009 was 'out of character', or that Mark's perceived failure to 'raise the alarm' was motivated by a desire to conceal his death. Instead, we see how Mark's reluctance to involve authorities, or divulge information to third parties like the neighbours, was reasonable in the circumstances. It would have been the last thing Samuel would have wanted Mark to do. With this new context in place, Mark's behaviour has an innocent explanation.

This was the core thrust of the circumstantial evidence used by the prosecution to argue that Samuel died in September. If this is undermined, then their estimate as to his date of death is unreliable. Remember that all the forensic evidence supports Samuel being alive in October, it was only their use of the circumstantial evidence that brought that forward.

More generally, the basic idea that the jury should have all available information in front of them is really important if they are to reach an informed decision. They didn't know about Samuel's secret life, or evasiveness; and they weren't told about alternatives motives and suspects. From their perspective, Mark was the only person in the world who would have any reason to do this, and Samuel's apparent change of behaviour only pointed to his death. They believed this because information was withheld from them. That isn't just problematic, it is unjust.

To give you a sense of our current understanding of Samuel's life, this is a breakdown of some of the things we have found so far:

I wouldn't overstate this, the Judge himself recognised that Samuel had made a reasonable recovery by 2009, and their is some doubt as to the nature of the work that these employees were actually being paid to do.

The method of his burial is indicative of someone having filled in the grave on a number of occasions. No stranger is ever going to put them-self in such a situation.

This is actually a really important observation. The idea that Mark was responsible would have required him to excavate the site in a stop-start fashion over the course of 2 months, between 5 September and 31 October, returning to the crime scene on multiple occasions. This would have been an extraordinarily risky and reckless thing to do. He would have had to avoid being caught on each visit, clean himself up before each return to London, presumably exhausted for the evening ahead, all while running the risk of the body being discovered. The jury never considered the plausibility of such a scenario, and it is markedly inconsistent with the evidence given by Forensic Archaeologist Dr Stephen Litherland on behalf of the Crown, that "the grave was probably not open for a long time before the first layer of [mortar] was poured as there was little evidence of weathering of the sides of the grave or of any wind blow detritus (such as leaves) in its base".

All of this makes the point that this could not have been the act of a single person, let alone an inexperienced one like Mark.

For goodness sake give the man a chance to prove his innocence.  Another case has just been referred to the Court of Appeal.  Gary Walker was refused twice by the CCRC  and issued a judicial review of their decision.  They had to backtrack and look again at the new evidence.  You don’t know all the information in Mark’s case so stop judging. It has no effect on your life.

”THE parents of a pregnant mum-of-three who was beaten to death by her policeman lover have spoken for the first time of their devastating loss.

John and Margaret Bailey are demanding a full inquiry into how Gary Walker got a job as a PC with Avon and Somerset Constabulary before he killed their daughter Audra Bancroft, 36.

The cop had previously been sacked by Staffordshire Police following a violent brawl outside a Derby nightclub - but references to his new force were not properly checked.

Evil Walker, 40, was jailed for life at Stafford Crown Court last week after a court heard how he fatally strangled and punched Audra at the home they shared in Branston, Staffordshire.

She was pregnant with their child but was planning an abortion.

Last night her parents, also from Branston, called for an inquiry into how Walker managed to get another police job.

Mr Bailey, 60, said: 'If Avon and Somerset had done their job properly and found out that Walker was a liar, he could have been jailed andAudra would be alive today.

'He had such a hold over her. She was a strong character but he completely manipulated and cut her off from her family who loved her.

'He was a man in uniform and she trusted him. If you can't trust a policeman then who are you supposed to trust?'

Walker, who must serve 13 years before being considered for parole, killed Audra last December.

A pathologist's report found 26 areas of bruising on her body, a fractured nose and brain damage.

The pair were seen rowing outside their house the night Audra died after she had visited the home of her childhood sweetheart and ex-husband, Andrew Bancroft, and their three children, aged 12, 10 and eight.

The pair had divorced after she began a relationship with Walker, after they met in a pub.

Mr Bailey, a software engineer, said: 'She was elated when she first met Walker and thought he was absolutely wonderful. He was a man in uniform and she was bowled over.

'They weren't together for long before he was dismissed from Staffordshire Police after being involved in a brawl at a nightclub in Derby while he was off-duty.

'He then got a job as a security guard in London and told Audra he was earning pounds 5,000 a week as a bodyguard to oil sheikhs.

'We were a bit suspicious about this but Audraseemed to be happy with him. 'As she was a grown woman with three children of her own, we didn't like to interfere.

'Margaret then heard that Walker had beaten upa previous girlfriend, who was also a police officer, who he been living with and planned to marry.

'Her father, who was a senior police officer, had to take a restraining order out against him to stop him harming her any further. 'We became very worried but she seemed happy. We feared that if we told her about his past it might turn her against us.

'The last time Margaret sawAudrawason Father's Day last year. She came to our house with her arm in a sling. She had a broken wrist and a black eye. Walker said she had slipped in a pub.

'She hadgonefromweighing12stone to eight stone but still seemed jolly enough.

'Then, in August I received three alarming text messages from her while I was working in Chester.

'The first read: 'Dad help me please'. The next was 'I'm so sorry, please please help me'. A third one was similar.

We told her whatwehad heard about Walker and she challenged him about it when he returned home. She then rang us again and said that he had left her.

'I went round to see her and we spent three hours talking. She told me she was pregnant and that she planned to have an abortion.

'We offered to buy her a house where she could stay with her children and said we would cancel our holiday to help her get through this but she refused our help and said she could cope.

'But Walkerwas so manipulative that when we returned from our trip they were back together again.

'He is completely sick. Since she died we have heard more details from her children of the horrendous domestic violence she was subjected to.

The family now wants a full inquiry into how Walker landed a job with Avon and Somerset.

Mr Bailey said: 'Walker actually used me as a reference and his references were never checked properly.

'His violent behaviour should have been noticed by Avon and Somerset before this. He should never have been allowed to get another police job with another force.'

Inspector Adrian Goldie, from Avon and Somerset Constabulary, said: 'Walker was required to resign from the force last December. No further comment can be made at this stage.'

The CCRC aren’t fit for purpose Daisy. Innocence fraud is rife in the UK

I've no doubt that is sadly true, but how do you diagnose them without running the risk of wrongly labelling hundreds of genuine cases? I'm concerned that you have got the wrong impression of Mark's case from the start and are so prejudiced in your own mind now that you can't make an objective assessment, whatever evidence someone shows you. Please take care not to falsely accuse more men and women like this, it's not fair on them or their families who are all working so hard to get to the truth, and have been fighting false accusation for years as it is.

Brilliant that CCRC has referred case of Gary Walker to CA -WELL DONE! every referral is precious ; sad took 6 years and  Commission’s first decision had to be JR’d by the High Court- CCRC must be more robust/confident in its attitude to CA which has such dismal  injustice record

What are your views on abusive and violent men like Gary Walker Daisy?

Are you familiar with the case and what this man did to Audra Bancroft or are you more interested in the CCRC having to ‘backtrack’ following a JR, as you claim ?


Senior investigating officer, Chief Inspector David Garrett, said: 'This was a difficult case to investigate because of the different stories Walker told to detectives investigating the murder.

'He had tried to cover his tracks of what he had done. Before Audra was taken to hospital, he had washed the clothes they had both worn that night. A suitcase lay open on the bed. And, when the ambulance had arrived at the house, he ran to Andrew Bancroft's house, Audra's ex-husband, accusing him of beating her up.

'The tragic loss of a young mother is almost unbearable for her family to have to cope with.'

I've no doubt that is sadly true, but how do you diagnose them without running the risk of wrongly labelling hundreds of genuine cases? I'm concerned that you have got the wrong impression of Mark's case from the start and are so prejudiced in your own mind now that you can't make an objective assessment, whatever evidence someone shows you. Please take care not to falsely accuse more men and women like this, it's not fair on them or their families who are all working so hard to get to the truth, and have been fighting false accusation for years as it is.

Nicholas is well aware of the broken justice system in this country and how many attempt to take advantage of its failings for their own ends.
A malicious prosecution for a crime which never existed. An exposé of egregious malfeasance by public officials.
Indeed, the truth never changes with the passage of time.

Another case has just been referred to the Court of Appeal.  Gary Walker was refused twice by the CCRC  and issued a judicial review of their decision.  They had to backtrack and look again at the new evidence.
