The amazing missing child procedure in Portugal
« on: April 28, 2013, 11:18:59 PM »
1. a child is reported missing - searches and interviews are carried out - the child is not found.

2. interviews reveal something "suspect" in statements.

3. make 3 people arguidos.

4. have insufficient evidence to make any charges against the arguidos.

5. release people from arguido status.

6. shut down the search and wait for somebody to come up with new evidence.

7. job done

8. child remains missing and the Portugal can officially say that they can't do anything more until someone solves the case for them

9. UK Police undertake a review of everything.

10. Luz is not happy

I have always argued that the case against the arguides may well have been archived, shelved or whatever.

But for Portugal to close down the search for a missing child is DISGUSTING

The case is not closed, it's archived because there is nothing the authorities can do to force UK citizens to come back to help the investigation.

You should apply DISGUSTING to the parents of the missing child that don't care to help authorities to search for their daughter.

then tell me - which part of the Police system in Portugal is actually still looking for a missing child?

Implementing a Fund, a non charity organization, 7 days after their daughter disappeared; programming a one year anniversary of her disappearance in early July; giving interviews for money all around the world; writing books with very graphic descriptions; selling t-shirts, bracelets and other paraphernalia,...is not exactly the kind of behaviour one would expect from grieving parents. Why are they the saints and the police that did their job are the devil?

luz yet again on a different thread

A criminal process in portugal has 4 phases:
1.Investigation,
2.Inquiry
3.Trial
4.Sentence

This case is still in the first phase, the investigation, which is stalled because there is no way to continue it due to sovereignty boundaries. In order for it not to "prescribe" (I think you call it statute of limitation) the solution is to archive it so the time account is interrupted.
But as I said on some other thread, if the parents, friends, UK Home Office or any witness came forward with any kind of new information, it would be re-opened immediately.

So what did you expect them to do with the money that the public were contributing?   They could have just put it in their own bank accounts - as it was sent to help THEM to use in any way necessary for them to stay in Portugal and not have to leave for financial reasons before Madeleine was found.

You cannot have charity status for one person - so as advised by others they opened a fund.    Since then hundreds of thousands of pounds which they could also have put into their own bank account - i.e. compensation for libel, the proceeds from Kate's book etc have been put into the fund.  There has been no evidence of a luxurious lifestyle as a result of it - or even a change in lifestyle in any way.

Can the same be said about Amaral and how he spent the proceeds of his book?

All the McCann interviews have been for one purpose only and that is to keep Madeleine's profile high in the public mind so that one day maybe someone may recognise her - or become suspicious about something which could lead to her return to her parents.   This won't happen if she slips out of the public eye.

They are following the advice given by the 'experts' on what to do to give Madeleine the best chance of being found.

In the USA I believe they advertise missing children's faces on milk cartons - here Madeleine's face is on Teeshirts
etc.   Why anyone would think either of those methods of trying to find missing children is in some way offensive is a mystery to me.

The notion that innocence prevails over guilt – when there is no evidence to the contrary – is what separates civilization from barbarism.    Unfortunately, there are remains of barbarism among us.    Until very recently, it headed the PJ in Portimão. I hope he was the last one.

Kind people were sending the McCanns money for them to help find Madeleine.    As Benice pointed out they could hardly have just put the money into their own accounts.    A fund had to be set up,  as it was a fund for Madeleine alone it couldn't be set up as a charity fund.

Was it the McCanns idea to sell the bracelets etc?     Good idea though,  to get money for the fund.  I am sure other parents of missing children would do the same.

As for the travelling around the world giving interviews for money.    The McCanns travelled to different countries that Madeleine could have been taken to get the word out about her,  to keep her in the public eye for people to look out for her.    If that country then asked for them to do an interview,  why would they refuse?   That would be an excellent way of speaking to hundreds of people at once.

As for the 'year old anniversary of her disappearance, in early July'   what is the whole conversation?   We are just hearing a snippet of it here,   a snippet in order to make Gerry look suspicious.

You really should try and put yourself in the shoes of the parents.    They have a missing child and they are trying to do everything they can to find her.

It is the Police job to search for missing people, they are supposed to be the experts.. Police always tell the parents to stay at home, in case they turn up as parents can be a hinderence  in some cases.
