Corbyn faces legal action over criticism of Labour apology to ex-staff in [ censored word]emitism case
The Labour Party announced today that it would pay hundreds of thousands of pounds and apologise to former staff and a journalist it defamed in the wake of a BBC Panorama investigation of its handling of [ censored word]emitism complaints last year.

“The decision to settle these claims in this way is disappointing, and risks giving credibility to misleading and inaccurate allegations about action taken to tackle [ censored word]emitism in the Labour Party in recent years,” Mr Corbyn said. “Our legal advice was that the party had a strong defence.”

Mr Ware has now instructed Mark Lewis, a leading libel lawyer, to pursue a case against Mr Corbyn. “I confirm that I have been instructed to pursue cases,” Mr Lewis told The Times.

The former Labour leader could face further action from the seven whistleblowers. A source close to them did not rule out the prospect and said: “All of the whistleblowers are considering their options.” The Times has contacted Mr Corbyn’s office for comment.

Labour is understood to have paid about £200,000 in damages to the claimants, who broke non-disclosure agreements to allege that Mr Corbyn’s aides had consistently interfered in [ censored word]emitism cases and delayed and downgraded sanctions against accused members.

The former Labour leader and his allies, including Seumas Milne, his former director of communications, were considering launching a legal challenge to the ruling but are understood to have backed down.

Len McCluskey, the general secretary of Unite, which is Labour’s biggest donor, said the settlement was a “misuse of Labour Party funds”. He added: “The leaked report on how [ censored word]emitism was handled tells a very different story about what happened.”

Lawyers for Mr Ware say the settlement is an unprecedented case of a journalist successfully winning legal action against a political party.

Labour had attacked the claimants in a press release after the documentary Is Labour Anti-Semitic? which was aired last July.

It accused Mr Ware of “deliberate and malicious misrepresentations designed to mislead the public” and suggested the former staff members who participated in the film had done so with the primary aim of undermining Mr Corbyn’s leadership via a smear campaign. It also contended that their credibility as sources was undermined by the fact they had “political axes to grind”.

The party has now conceded that the allegations against the filmmaker and his interviewees were false and defamatory. In a statement read in open court this morning, it said: “The Labour Party is here publicly to set the record straight, and to apologise to the claimants for the distress and embarrassment it has caused them.”

Labour also apologised unreservedly to Mr Ware for alleging that he had invented quotes and misrepresented and fabricated facts. The party’s lawyer, Anthony Hudson, QC, said it also accepted that the allegations were untrue. “We retract and withdraw them, and undertake not to repeat them,” he told the court.

The new Labour leadership has been at pains to stress that it takes a zero-tolerance approach to [ censored word]emitism and sees settling and apologising as a political imperative, despite a total cost of nearly £1 million in damages and legal fees.

Last week Labour said it had received the report from the Equalities and Human Rights Commission into allegations of institutional [ censored word]emitism against the party, which is due to be published next month.

Some on the left believe that the party’s case had been strengthened by revelations from a leaked report into the “hyper-factional” relationship between Mr Corbyn’s team and party officials that allegedly undermined complaints procedures at Labour’s headquarters.

It also named several of the claimants and is currently subject to an independent review by the party, whose lawyers insist its conclusions will not be prejudiced by today’s apology.

One ally of Mr Corbyn told The Times that while the party acknowledged it had wrongly accused the whistleblowers of making false and malicious statements and working to harm the Labour Party, it had not withdrawn the allegation that they were opposed to his leadership.

A source close to the claimants said: “Why didn’t they launch a challenge? Probably because they realised the judge would have laughed it out of court.”

The legal settlement has been welcomed by the Jewish Labour Movement which said the apology was a sign that Labour under Sir Keir was willing to “change and act decisively against [ censored word]emitism”.

A spokesman said: “It is a sad reflection of its historic role as the party of working people, that Labour sought to pursue and silence its former employees for speaking out against racism.”

A spokesman for Labour said that Sir Keir and his deputy, Angela Rayner, had taken the decision to apologise to restore the trust of the Jewish community.

“[ censored word]emitism has been a stain on the Labour Party in recent years. It has caused unacceptable and unimaginable levels of grief and distress for many in the Jewish community, as well as members of staff,” the spokesman said.

“If we are to restore the trust of the Jewish community, we must demonstrate a change of leadership. That means being open, transparent and respecting the right of whistleblowers. We are determined to deliver that change.”

Mr Milne was employed by the Labour Party until June but has left and is now understood to be working on a book.

The row came as Labour lost control of Brighton Council after three of its councillors quit, with two of them accused of [ censored word]emitism.

Councillors Kate Knight and Nichole Brennan resigned from the Labour group and will sit as independents days after Anne Pissaridou, a third councillor, was suspended from the party pending an investigation into social media posts.

Brighton and Hove City Council said a number of complaints had been made to Labour over Ms Knight’s Facebook activity.

The Green Party is now tipped to take control of the council.

A day and a half after Labour settled with the Panorama whistleblowers £80,000 has been raised from supporters in case Corbyn needs to fund a defence against libel claims.

With the evidence against them I’ve seen I almost hope they do sue.

The only way to change an institution is to change the management. As long as a toxic leader remains in situ there is no hope that the institution can recover its standing. This was the force behind Sir Keir Starmer’s line, at prime minister’s questions, that the Labour Party is “under new management”. And this is the force behind his decisions to eradicate the [ censored word]emitism that has stained the Labour Party.

Mr Corbyn himself responded with his characteristic lack of grace and style by declaring the decision to be political rather than legal. The left immediately promised hellfire. The fringe websites and alt commentators were aflame with anger and threats of recrimination. In the final moments before the settlement, lawyers for the former high command of the Labour Party tried to stymie the payments and the apology that was then issued on behalf of their successors.

Mr Corbyn still cannot seem to fathom, and being a bear of little brain probably never will fathom, that this is a political fight as well as a legal fight. Even if the decision to settle were purely political, Sir Keir made the right call. The new manager has to do everything he can to make sure he is rid of the last one.

Sir Keir has made an assured start as leader. The position of leader of the opposition is a notoriously tough gig and the impressive figure he cuts has already been reflected in his ratings among the public. He has restored decency and gravity to British politics which went missing when the two principals were Johnson and Corbyn.

For someone who allowed two decades of Labour membership to lapse over the party’s unfitness to govern, as I did, it was quietly moving to hear the shadow home secretary, Nick Thomas-Symonds, deliver his urgent question in the House of Commons on Tuesday about Russian interference in the Brexit referendum. Mr Thomas-Symonds was measured, serious and properly concerned about national security. He was doing the work of an opposition that has a credible pretension to govern.

Labour had lost the sheen of credibility and that is why, despite Sir Keir’s fine start, the Conservatives remain ahead in the opinion polls. The 20-point lead has gone — classic Dom — but Labour has not yet established itself such that it can expect to be in the lead itself. The Corbyn period has tarnished the party and the public understandably wants more reassurance that it has changed than Sir Keir has been able, thus far, to provide. Change has to be dramatised over and over again, given that most people, most of the time, are not watching. This is why decisive responses to incidents like the libel case are so vital. These are the moments when the public looks up and notes that the place is under new management and the fear and loathing that marked the old management have gone.

There are grave lessons for the party here. The first is not to yield to ideological temptation. To turn a great party into a fanzine for one of its factions is to court oblivion. The response of the Corbyn team to the allegation that Labour was not really serious about investigating [ censored word]emitism was to pour scorn on the journalistic ethics of the BBC. As John Ware put it in a piece in The Jewish Chronicle: “Labour’s defamatory blast triggered a year-long fusillade of falsehoods from a stream of left-wing bloggers, ‘media activists’, Labour’s ‘people powered’ Momentum faction, and alt-left outlets — all of whom share a conviction that the mainstream media is fundamentally dishonest.”

To declare war on all of the mainstream media is a disastrously stupid strategy for any political leader. In due course Sir Keir will be well advised to be much more forensic than this in his choice of media enemies. He will need some — a media bogeyman is always handy in politics — but it most certainly ought not to be the BBC.

The second lesson is personal. The chaos of the Corbyn leadership is what happens if you take the most stupid person in the building and put him in charge. Public life can only bear so much stupidity. Bereft of intellectual weight, with nothing much in his head and painfully conscious of the deficiency, Mr Corbyn’s options were to lean heavily on unctuous self-righteousness or, when that failed, to lash out. Unable to provide good reasons, or any reasons, for his decisions, he simply acted with erratic impunity and got instantly testy if anyone questioned his authority. He was always a rather pathetic figure, if briefly quite a dangerous one. Meanwhile his entourage of sycophants, the Milnes, Murphys and McCluskeys, went out to argue for a man they always regarded as a useful idiot.

If the left decides to start a civil war in the party, so be it. In fact it would be a highly uncivil war as Corrie Drew, a Labour candidate at the 2019 election, showed when she posted a picture of herself, in response to the libel case, offering a single-finger salute to John Ware. Classy, these lefties. This is just the reaction that Labour needs.

There was a lot of talk during Mr Corbyn’s leadership that the Labour Party would have to split. The agony then was on the right of the party, as loyal Labour people wondered whether they would ever get their party back. That sort of talk will return, but this time with the left as the probable instigators. The party does contain two ideological groups who ought not to be glued together — the social democrats and the socialists. A split would be traumatic but, in the end, cathartic.

There may well be a casus belli because the saga of Labour’s [ censored word]emitism is not over yet. The full publication of the report by the Equalities and Human Rights Commission, which could arrive next month, is likely to be devastating reading, if the account of the Panorama whistleblowers is anything to go by. If it is, this will be another occasion on which the Labour leader has to be emphatic and decisive and there is an obvious course of action. Get rid of the toxic leader.

The real catharsis, the real way to show the world that Labour has changed, will be to kick Corbyn out. Take away the whip, expel him from the party, point the way out for his nasty band of facilitators.

Good to see Corbyn’s pot for the libel payout is growing nicely.  Fools and their money etc.  It’s like Amaral all over again.    Perhaps Corbyn could always do a Captain Tom and do a few sponsored laps of the allotment to generate more funds if needed.

I trust Corbyn is planning to boycott Twitter as other MPs are planning to do in protest at the vile anti-semitism spouted by his famous supporter Wiley.  No word from the great man on the subject yet, just a quiet deletion of a tweet thanking Wiley for his support.  Still, I’ve every confidence he will do the right thing soon...

Still waiting for Corbyn to denounce his supporter Wiley’s vile [ censored word]emitism.  I expect if it had been a famous Jew tweeting racist rubbish about Blacks or Muslims we would have had strongly worded condemnation from Jezza.

No word from Corbyn denouncing Wiley’s vile [ censored word]emitism.  Here was the perfect opportunity to stand in solidarity with Jews everywhere to denounce [ censored word]emites like his supporter Wiley and he preferred to keep quiet, just sneakily delete a tweet of thanks to the rapper.  Judge a man by his actions and his inactions.

“Mr Corbyn’s deletion of his positive Twitter exchange with Wiley without any statement condemning the artist's anti-Semitism suggests that the former Labour leader acted purely out of self-interest to try to protect the shards of his shattered reputation as a supposed ‘anti-racist’.”

I firmly believe there are really only two roads to choose in this life, one is of love, the other of fear. What is truthful and honest about deleting a tweet of thanks to a supporter who subsequently proves themselves to be a vile [ censored word]emite and then refusing to condemn that supporter’s vile [ censored word]emitism?   I think it’s sly and proves Jeremy IS on the side of those who hate Jews.
