On the other hand according to the report it was established that, at the time of the Smith sighting, Gerry was at the Tapas Restaurant.

The Final Report is not 'the ultimate truth'. It says;

witness alleged that she had seen GERALD McCANN, in Avenida Descobrimentos, in Lagos, near an ATM terminal, at around 2.26 p.m. on the 7th of May 2007. According to the witness, the father of the minor was talking on the phone, saying "don’t hurt Madeleine, please". She was not peremptory in affirming that it was GERALD McCANN. It seems unlikely to us that it was GERALD, given the fact that on that day, he only activated antennas in Praia da Luz, adding to the fact that, at around 2.16 p.m., he activated an antenna in the centre of Praia da Luz, which we consider to make it impossible that he was present in Lagos ten minutes later.

It may be unlikely that Gerald was in Lagos on 7th May, but it is certainly possible because it's possible to make the journey in 11 minutes and it's also possible that he left his phone in PdL and was speaking on his Portuguese PAYG phone.

For me and others who are a bit rusty on the reports can you give a little bit more information in our opening post as to why you think it has been ignored.  A list of bullet points would be helpful.

It has been ignored by the Supreme Court judges, who have interpreted the archiving dispatch through the prism of the interim report as according the McCanns technical benefit of the doubt (that they had no involvement or direct hand in the disappearance of Madeleine), where the Tavares report opines that they did.

But the final report rules out woke and wandered, finds that Gerry was in the Tapas Restaurant at the time of the Smith sighting, acknowledges the cooperation and assistance offered by Kate and Gerry to the enquiry as it progressed.

It does indeed say that, despite the time of the sighting never being confirmed beyond doubt. It also says that the time of the alarm being raised wasn't confirmed beyond doubt (around). It takes only a few minutes either way, therefore, to destroy Gerry's alibi;

What happened during the time lapse between 5.30 p.m. (the time at which MADELEINE was seen for the last time by a person that differs from her parents or siblings) and the time at which the disappearance is reported by KATE HEALY (at around 10 p.m.).

There are potent and logical reasons for supposing Inspector Carlos had it bang-on right to suppose Gerry was at the table at the moment of the Smith sighting.

You are accusing the SC judges of ignoring the report. They didn't consider it because the McCanns didn't use it in their appeal. They were answering points of law raised, not deciding what happened to Madeleine.

What would be "some sort of truth" in your view?  For example if someone were tried and found guilty would that be some sort of truth?  Is the result of the SC Judgement some sort of truth?  What is truth and who determines whether it is so or not?
