The reconstruction
« on: April 25, 2013, 08:18:23 PM »
Quote
On September, 7th, 2007, Mrs Kate Healy was questioned by the Polícia Judiciária (Inspectors João Carlos, Paulo Ferreira and Ricardo Paiva). The first part of the interview was about generalities like, how was Madeleine's behaviour, her relationship with her siblings, her relation with parents and relatives, etc.

why was the reconstruction not asked?

Because the PJ at the time ( you know Amaral and his cronies) thought they didn't need it as they were fitting the parents up.
Also, as stated in the files, the PJ decided it would be too busy with tourists, and, believe it or not, THEY WOULD HAVE TO CLOSE THE AIRSPACE to do a reconstruction

There should have been a reconstruction early in the investigation   ... not with  'actors'  in the crime-watch style that the McCanns prefered  ...  but a genuine reconstruction for police purposes only,  with the  real people involved

That it didn't happen is just one of the mistakes the Portuguese police  must take responsibility for

WHere does this sort of 'real' reconstruction happen outside of TV programs?

I don't know  ...  but it would have in Portugal if the McCann's mates hadn't stymied it

But the McCanns mates didn't stymie it per se though, did they? It was stymied in May2007 by the PJ. By the time that it was re-iterated in 2008 the McCanns mates were well aware that the PJ were trying to fit up Kate and Gerry with their lies about the forensics.  If I had been one of the mates, I would also have said no.

There's something culturally difficult to understand : in Portugal like in France and in many others countries of Europe, it is not the best story that wins.
I think that the act of judging has to take into account singular stories.
What is the value of the prosaic hypothetical conclusion of the PJ that parents discovered their child cold (accidentally dead in the process of finding where they were) and out of shame concealed the body for good, claiming the child had been abducted ? Shame ? Not much value.
Now what is the value of the dramatic story of an abductor without a face carrying little Madeleine like children are carried away in nightmares, after creeping through a window  previously jemmied, destroying horribly the life of honest and beautiful doctors ? Does one wonder about the success of that story ? Didn't it sell huge copies of tabloids and not only ?

Though TV series should have turned justice in other parts of the planet more familiar, people from Common Law countries pain to understand the proceedings of justice in countries where the Romano-German system prevails. And reciprocally.
There was no kind of Inquisitio Haereticae Pravitatis in Anglo Saxon countries.
In the Inquisitorial system, through investigation methods, the judge and the police inspector are charged to obtain the truth from the suspect.
In the adversarial system the focus is on permanent negotiation and persuasion. Those depend very much on intellectual and financial capacities of the suspect (which leads to the aberrant condemnation to death of people incapable to defend themselves).

There's nothing to explain, just a bad story.

Hi Anne.  Where do you imagine that they concealed  Madeleine's remains for 3 weeks before transporting said remains in the Scenic? Which is what the PJ were purporting....
