I would offer a word of caution to the McCanns given that the Portuguese judicial hierarchy appear to be on the side of free speech and at war with any attempt to stiffle it.   Isabel Duarte will go home with her fee regardless of the coutcomes, win or lose.  The only thing she might lose in taking this farcical legal action any further is a tad of credibility but the McCanns are facing ruin.  Let's not underestimate the damage that this latest ruling hascnow caused to the parents and the potential damage which a/failed application to the Supreme Court could do to them.  I fear they could be being badly advised as happened previously and we all know how that ended.

I share your concern for the blatant disregard of the McCanns human rights at the expense of amaral's right to free speech. As we all know free speech comes with responsibility and that is why free speech is NOT an absolute right. We do not have free speech on this forum for those reasons. If the Mccanns fail in portugal...which is not a given....they could take their case to the ECHR where i think their rights will carry more respect. i certainly would not give up if I were them

You should do the same.

The appeal court judges invoked to s/he who is willing, no harm can come.

That was a misapplication of Portuguese law (because Amaral breached judicial secrecy in writing it).

Or, if the case really is as open-and-shut as the appeal court judges portray it, the McCanns will not be granted leave to appeal (as they will have no grounds).

I think Amaral had The Gaspar Statements long before he was sacked, but what with all the mess he left behind, this would be impossible to prove.

That's the point really. We don't know why the PJ asked for the statements, it's perfectly possible they had mislaid them somehow. Either that or they didn't have the originals for some reason, just translated copies which they wanted to check against the originals. I thought that because of what it says at the beginning of the statements, the translations had been revised;

they will be taking advice from someone who understands the law...they should carry on. The portuguese judgement is a disgrace...imo..and I feel sure the ECHR will agree if it has to go that far
