Because the information was in the public domain. The Judiciary made the files available for the public thereby relinquishing their exclusive rights to the content.
The issue is "were the files in the public domain when the book was published"? ; answer yes.
Next define what public domain means. You can Google that as well as I can.
You will find "Levy" is not listed as a precondition of anything. Now there's a major surprise  @)(++(*

The Portuguese judiciary ceased to have exclusive rights on 21st July 2008 at which point members of the public could have sight if they wished. Sr Amaral's book was published 24th July 2008.
Rule one when reading any legal or contract document. Read the definitions section first. It's usually the first one for a very good reason.

The only information in the public domain @24/7/2007 was from press releases.

The source of the thesis was the author of the book so it wasn't an independent idea.

The files are deemed to be in the public domain when the case is archived and the judiciary cease to have exclusive rights to the content. The law will only deal with public domain so when the files were first printed off is irrelevant. It might have been a year later for all I know. Some cases may never have been printed off but remain in the public domain.
