facts...cipriano tortured in PJ custody...amaral convicted for perjury and conviction not overturned

A Relação de Évora refutou a existência de "nulidades e inconstitucionalidades" no acórdão que confirmou a condenação de ex-inspectores da Polícia Judiciária (PJ) no processo de agressões a Leonor Cipriano, mãe de Joana, criança desaparecida no Algarve, em 2004.

A 18 de Março deste ano, o Tribunal da Relação confirmou a condenação dos ex-inspectores da PJ Gonçalo Amaral e António Cardoso Nunes, com penas suspensas, pelo Tribunal de Faro em 2009, mas este último antigo agente requereu "a reforma e aclaração do acórdão".

De acordo com fonte judicial, a Relação de Évora entendeu que "carece de razão" o requerimento de António Cardoso Nunes, condenado a dois anos e três meses de prisão com pena suspensa pelo crime de falsificação de documento. Entendeu ainda o tribunal de segunda instância de Évora que o recurso "extravassa por completo o âmbito permitido a um requerimento de aclaração ou arguição de erros, lapsos, obscuridades ou nulidades".

Na decisão dos recursos dos ex-inspectores, comunicada a 18 de Março de 2011, a Relação também manteve a pena de um ano e seis meses de prisão por crime de falsidade de depoimento, suspensa na sua execução, aplicada a Gonçalo Amaral, ex-coordenador do Departamento de Investigação Criminal de Portimão.

Na sequência da decisão da Relação, Marcos Aragão Correia, advogado de Leonor Cipriano, interpos uma queixa contra o Estado português na Organização das Nações Unidas por violação "grosseira dos mais básicos Direitos Humanos". O advogado referiu à agência Lusa que pediu a condenação e expulsão de Portugal da Comissão dos Direitos Humanos das Nações Unidas.

O caso das agressões a Leonor Cipriano foi julgado em Faro, em 2009, mas o Tribunal de Faro não determinou a autoria das agressões à mãe de Joana. Além de Gonçalo Amaral, absolvido do crime de omissão de denúncia, e de António Nunes Cardoso, também foram julgados os ex-inspectores Paulo Pereira Cristovão e Leonel Morgado Marques e o agente ainda no activo Paulo Marques Bom. Paulo Pereira Cristovão, Leonel Morgado Marques e Paulo Marques Bom foram absolvidos.

Joana desapareceu a 12 de Dezembro de 2004 da aldeia de Figueiró, Portimão, e Leonor Cipriano e o irmão, João Cipriano, foram condenados em 2006 a 16 anos de prisão cada um pelos crimes de homicídio e ocultação de cadáver, após recurso da pena de 18 anos.

O caso voltou à Justiça em finais de 2008, com a mãe de Joana a acusar cinco catuais e ex-inspectores da PJ, num processo envolvendo crimes de tortura, omissão de denúncia e falsificação de documento

ask luz...are you serious...Luz lied about amaral...do you remember...obviously not...luz claimed amaral had been cleared in court...and when pressed for evidence left the forum...words fail me

Perhaps because Amaral had so hopelessly compromised the investigation by his incompetence that the AG had no choice ?
Amaral busted a gut trying to cobble together a case against the McCanns but failed.  Do you really believe the lack of evidence was soley down to Amaral's incompetence as an investigator?

those three officers were acquitted but the court accepted that cipriano was tortured by the pj and amaral lied to cover it up...those are the facts and you should agree

Another fact is that Leonor was beaten with a bag over her head, which may have hindered ability to identify officers responsible for beating her (incredible though that fact seems to be for some) ....

Didn't one of those "acquitted" officers, currently awaiting trial on a plethora of violent crimes concurrent to his Sporting Lisbon shenanigans trial, allegedly send an email in which he admitted to knowing who had carried out the torture of Leonor & also who had authorised it?
