Portuguese police 'ignored Madeleine McCann leads'

Portuguese police have ignored hundreds of potential new leads in the Madeleine McCann case because of their belief that she is already dead, it has been claimed.

By Fiona Govan in Lisbon

Details of possible sightings from across Europe have been forwarded to Portuguese investigators by local forces but no effort has been made to follow them up.

Kate and Gerry McCann, both 41, learnt of the existence of the dossier of new information, including tips offs, license plate numbers and even photographs of children who could be their daughter, during a court hearing in Lisbon that ended Wednesday.

"They were shocked at what was in it and, even worse, what little had been done to follow any of it up,” said Clarence Mitchell, spokesman for the McCann family.

"Kate and Gerry have consistently known that potential fresh information was not being properly followed up, if at all.”

The potential new leads date from July 2008 when the case was officially shelved by Portuguese police after they failed to find any evidence of the missing girl.

The confidential dossier contains hundreds of statements that could prove useful in solving the mystery of Madeleine’s disappearance from an Algarve holiday apartment on May 3, 2007.

The McCanns’ legal team became aware of the file during court proceedings as part of a libel trial brought by the couple against the former detective, Goncalo Amaral, who led the initial investigation.

The McCanns’ Portuguese lawyer, Isabel Duarte, accused current Algarve police chief Ricardo Paiva of deliberately ignoring the leads because they did not fit in with the theory that Madeleine’s parents were involved in her disappearance.

Last month he appeared in court as a witness in support of former colleague Mr Amaral, who has written a book alleging that the girl died in the holiday apartment and her parents fabricated a tale of abduction after hiding her body.

"Every piece of information (in the dossier of potential new leads) was treated the same way - Ricardo Paiva writes on it 'this is not relevant to the investigation',” Mrs Duarte said from her office in the Portuguese capital on Thursday.

“He believed and to this day still believes that Madeleine is dead. I asked him: ‘How can you find a person when you are not looking for them?’”.

She said some of the leads seemed credible, including a cluster of sightings by independent eye witnesses in northern Italy, and had been forwarded by police forces in the UK, Spain, France and Italy but ignored by their Portuguese counterparts.

Copies of the files would now be passed to the McCanns to be followed up by private investigators hired to search for their daughter.

"But I am angry because it is the Portuguese investigative police who should be doing this job,” Mrs Duarte, added.

"They have the power and capability to do it. It is they who should be doing it not and not my clients."

And what evidence do you have that the leads weren't followed up and only then deemed them irrelevant ?

Weren't the McCanns asked about important leads by SF and found it difficult to remember properly a single one. I'll bet Kerry Needham has every possible sighting on her son engraved on her memory.

A witness for Amaral, inspector Ricardo Paiva who worked with him and is now in charge of the case since taking over from Paulo Rebelo, who took over when Goncalo Amaral was sacked, calmly announced under cross-examination from Isabel Duarte, that Amaral's book had not prevented people from contacting the police with info because he has a fat file crammed full with sightings that people keep sending. Isabel Duarte asked to see that file and in her final speech asked about all that neglected information: "how can she be found if the police is convinced she is dead and doesn't follow up the leads"? She asked, which of course is true. However, this wasn't the most damning of Paiva's announcement, when Ms Duarte later collected this file of information, she discovered that not only was it stuffed full of photographswhich bore a remarkable resemblance to Madeleine, not only was it crammed with information about sightings of Madeleine and other reports that people thought were significant enough to contact the PJ, or their local police or the McCanns investigation team, it was discovered that ALL information coming into the "investigation" which is shelved, has been shoved into this file *WITHOUT* being examined, or actioned and the file itself has been marked"Not Relevant To The Investigation", so the chances of it ever being looked at in the future would also be greatly diminished! It is an absolute astonishing admission and confirms the fears of a great many people about the fear of corruption and the level of competency concerning those charged with the investigation into Madeleine McCann's disappearance.

When the case was officially shelved it was publicly announced that if any new evidence came in, that the case would be re-opened. Since then there has been information that has come into the investigation, among the information submitted to Ricardo Paiva at the Portuguese policia judiciaria (PJ) was that from Kate and Gerry McCann's private investigators, which the McCanns state was credible and has NOT been acted upon. This also applied to the information that the Leicestershire police had submitted to the PJ, the LP being the police force local to the McCanns and in charge of any information coming into the police in the UK and have also been carrying out investigations in the UK concerning the Madeleine investigation.

All this information being sent to the PJ has been finding its way into the file of Ricardo Paiva and marked "NOT RELEVANT TO THE INVESTIGATION".

I noticed you didn't say where the above came from DCI.

My guess would be the British press. So I ask again, how do you know that the information hadn't been actioned and found to be irrelevant to the investigation ?

No wonder you didn't want to provide a link.  I believe the writer latterly turned against the McCanns and added some rather scathing comments to several newspaper 'Have your say ' sections.

So you think it is OK, do you, Faith, that people were sending infornation in and it was being ignored?  Further more it was stached in a file labelled

"NOT RELEVANT TO THE INVESTIGATION".

Such a title would likely have ensured that all that information sent in would never see the light of day.

What ever was Riccardo Paivas little game?   Anyone have any ideas?

I don't think it was ignored sadie and what's more I don't think you have an evidence that it was ignored.

As far as we are aware the information was looked at and deemed irrelevant. Nothing wrong with that. Every high profile case attracts  information that is discounted after being looked at.

It is a really weird type of truth seeker who fails to register the dereliction of duty which has occurred at almost every stage of Madeleine McCann’s case.  I know what the definition of with holding evidence is, but I think Ricardo Paiva's actions are much worse.

Some of us have no doubt 'lost' an inconvenient file ... but what this man did is mind boggling ... yet the cite has been decried because of its author as a neat deflection from the fact that the information is accurate. Job done.

Thesuggestion seems to be that all the information was checked out before being discarded as not being of relevance to the inquiry.

The absolute lie to that is that there were numerous pictures and CCTV images of children, many of whom looked like Madeleine McCann, one of whom might have been Madeleine McCann, but Ricardo Paiva did not bother to show them to Madeleine McCann’s parents.

Why not? Because he believed Madeleine to be dead.
That is what is being defended and condoned.

NSY did not reopen the investigation into Madeleine's abduction because they had new evidence - they reopened it because of the evidence which already existed in the files and which had not been actioned - I wonder how much of that came from the files Ricardo Paiva sat on for two years, and which he would be sitting on yet but for opening his mouth in court about them in answer to a question from Isabel Duarte.

Portuguese police 'ignored hundreds of sightings' in search for Madeleine McCann

Portuguese police faced growing pressure to reopen the Madeleine McCann investigation yesterday, amid claims they ignored potential sightings of the missing girl.

Detectives have refused to investigate hundreds of clues about the disappearance, including photographs of children said to bear a 'shocking' resemblance to the blonde youngster.

They include a cluster of sightings in Italy and Spain which could hold the key to solving the mystery and ending the years of heartache suffered by her parents, Kate and Gerry McCann.

But instead they have gone unchecked, marked as 'irrelevant' after the case was shelved, and left to gather dust in a police archive.

The McCanns' private detectives, who are continuing the search for the missing child, did not even know the dossier existed until a Portuguese policeman let slip a reference to it during a legal hearing.

Inspector Ricardo Paiva said police had received hundreds of tip-offs from witnesses convinced they had seen Madeleine and knew where she was being held.

They sent in photographs of children and of locations which they believed were being used by her abductor, believing that police would investigate their claims.

But arrogant detectives were so convinced by their own theory that Madeleine died on the night she disappeared, and that her parents faked her abduction, that they made no attempt to check the sightings.

The McCanns' lawyer, Isabel Duarte, has seen the dossier. She said every single statement had the same phrase scrawled across it: 'This is not relevant to the investigation.'

She said: 'I was shocked at how much was in there, and that absolutely nothing had been done to follow any of it up.

'Every piece of information was treated the same way - Ricardo Paiva writes on it "This is not relevant to the investigation".

'He is the witness who declared in court that he believed Madeleine is dead. You cannot find a person when you are not looking for them.'

Gerry and Kate McCann
Unaware: Gerry and Kate McCann, pictured being mobbed by the media this week, were not told about many of the potential clues to their daughter's whereabouts

Mr Paiva gave evidence at a legal hearing over a controversial book, written by his former boss, Goncalo Amaral.
He admitted that Mr Amaral's insistence that Madeleine died on May 3, 2007, meant the police investigation had failed to consider other options.

Mrs Duarte said they had not investigated any tip-offs since the case was officially shelved, in July 2008, when the McCanns were cleared as official suspects in the investigation.

She said information had continued to pour in from potential witnesses and even from other police forces in Europe, but was ignored, even when the clues including photographs of girls who looked like Madeleine.

The lawyer said: 'Some of them are very, very similar to Madeleine. But Kate and Gerry had never been shown them.

'There was information from Leicestershire Police, French police, Spanish police, and again nothing was done about it.

'Kate and Gerry did not even know this file existed until this week. I am going to give a copy of the file to them so that their private investigation team can follow up the information in it.

'But I am angry because it is the Portuguese investigative police who should be doing this job.

‘They have the power and the capability to do it. It is they who should be doing it, not Kate and Gerry.'

Mr and Mrs McCann, both 41, will discover next week if they have won their court bid to keep an injunction which bans Mr Amaral from repeating his vile claims that their daughter died in a 'tragic accident' and that they faked her abduction to cover up the death.

Their spokesman Clarence Mitchell said they had been shocked to discover the full extent of the Portuguese police's failure to investigate Madeleine's disappearance.

He said it had confirmed their worst fears about the investigation, saying: 'They were shocked when they went through the file and saw what was in it, and even worse what little had been done to follow any of it up.
'Kate and Gerry have consistently known that potential fresh information was not being properly followed up, if at all.

'The tragedy of this case, which once again has been highlighted by this, is what little was done to find Madeleine.
‘Kate and Gerry will have to do it themselves as they have been doing. They are the only ones looking for her.'

Mr Paiva said he could not discuss the case. He said: 'I cannot comment, in accordance with Portuguese law.'

You really don't get it do you Brietta ? Apart from a few British press statements, no doubt cut and pasted from a Mitchell press release, there is NO evidence the information contained in the file.was not followed up and ruled out of as unimportant. This happens in every criminal case and especially one as high profile as Madeleine's.

But of course context is everything. Pavia had just told the court that Kate had phoned him while Gerry was out of the country and confided in him her dream that Madeleine was lying on a hill in PDL, a fact denied by a furious Gerry, apopletic with rage, in a press conference after the court session. Pavia's credibly had to be destroyed and what better way than suggesting that he had disregarded leads that could have brought the parents poor, lost little girl home.

This was the McCanns at their most calculated and vicious and the fact that the supporters greedily gobbled  it up and are still spewing this bile out several years later speaks volumes with regard to their agenda and lack of regard for the truth.

Of course the dossier debacle did come back to haunt the McCanns when the British newspapers got hold of the files but that's a whole different story.

There is correspondence in the files between Paiva and Amaral which proves that sightings were not followed up - specifically the one I remember is the sighting at Lagos Marina of a couple seen with a young child early morning 4th May 2007 - a sighting that was only very half-heartedly followed up, and then dismissed as "not relevant to the investigation".  Dismissed on what grounds exactly?  Was the couple traced?  Who was this child?  Where is the information in the files?

The bald fact is that Ricardo Paiva stated from the witness stand that it was nonsense to say that Dr Amaral’s book had not affected the search for Madeleine because people continued to send information to him.

The fact is that when the file was inspected by Isabel Duarte – it was full of information which had not been actioned.

What kind of investigation is it that does not show the parents of a missing child photographs and video of children for elimination purposes?

These are the facts – and are indicative of how Madeleine’s campaign was botched so badly by people who were so limited they could not see past their theory, and continued until NSY really looked at the evidence.

Then if there is correspondence in the files kindly produce it and perhaps you can also tell me what else the PJ could have done with regard to the Lagos Marina sighting ?

Of course lest we forget that the McCann PIs have not exactly covered themselves in glory when following up leads.  Remember the Barcelona marina debacle where information on what was purported to be a very important incident between a drunken stag-weekender and a 'Victoria Beckham' lookalike was given it's very own press conference on national TV. However after an exposé in the Sunday Mail ( the rag so clearly beloved by supporters ) it transpired that there had been no follow-up investigation done of this incident at the marina even though the McCann's PIs had had a jolly there.

This man really does have a sin to answer for as his treatment of evidence still coming into the PJ from 2008 till 2010 was wide of the mark; and the reopening of the new investigation into Madeleine's disappearance has really put the spotlight on the deficiencies of the old one including his time in tenure.

This man really does have a sin to answer for as his treatment of evidence still coming into the PJ from 2008 till 2010 was wide of the mark; and the reopening of the new investigation into Madeleine's disappearance has really put the spotlight on the deficiencies of the old one including his time in tenure.

Yes isn't there just!

It's odd how all 3 main officers supposedly investigating Madeleine's abduction, have criminal convictions. One even an arguido in another case.

All this incompetence just doesn't add up IMO!

I believe what happened in a Portuguese court which ordered Paiva to hand these files over to the Drs McCann legal team.

All information that Ricardo Paiva received was passed on to the Ministério Público and did not disappear into a drawer as some would love to think here. The MP decided whether the leads and information was worthy of being followed up.

Bumped for Montclair

The PJ don't have the time, money or Authorisation to go gallivanting around Europe 'looking' for Maddie.
Did The parents PI's not follow them up?  did the parents not go and check out these 'sightings' themselves? if not why not?... stones being turned and all that jazz!

So, anyway are the NSY going to follow up ALL these leads?

Australia, New Zealand, Spain, Africa, Arabia.....Did she go on a world cruise FGS?

Team McCann are happy she hasn't been murdered, and may still be alive and returned to them... or maybe not [ moderated ]

why should they bother doing any investigating at all...they knew maddie had not been abducted and the mccanns knew exactly what happened to her...just go to work in the morning..get pissed lunchtime....whats the problem...they had already solved the case
