Title: A view from Portugal on the SY investigation
Post by: stephen25000 on May 04, 2016, 07:56:06 PM
This appeared on the Joana Morais site. The content at this time is being updated. However, the basic premise of the Mccanns (first and foremost) being protected is one I concur with, since the SY review and investigation was started.

Carlos Anjos: 'I believe that there is clearly an attempt to exonerate the couple'

Short debate on the news that Scotland Yard is allegedly following a lead that presumes that Madeleine McCann was abducted by three Portuguese men. Rua Segura is a daily TV show broadcast by CMTV where criminal current issues are debated and analysed. On this episode the program had as guests Carlos Anjos, former PJ inspector and former head of the Criminal Investigation Officers' Union and André Ventura, University Law Professor & book author.

Transcript

Anchor Sara Carrilho - The thesis of abduction of Madeleine McCann by three Portuguese men is back on the table for the British authorities. The Judiciary Police however does not believe in that hypothesis which was already investigated two years ago.

Voice Over Joana Sales (news segment) - It's the last line of investigation concerning Maddie's disappearance. If it doesn't produce any results Scotland Yard will close the case nine (sic, 5) years after it started. The thesis of this new investigation is unknown, but English police sources believe that the possibility that the little 3-year-old girl was abducted during a burglary deserves a fresh look. This hypothesis surfaced in 2014. The Portuguese police constituted at the time three men as arguidos (suspects), José Carlos da Silva, 30 years old (sic, 39), Ricardo Rodrigues, 24 years old, and Paulo Ribeiro, 53 years old. One of the suspects worked at the Ocean Club resort where the McCann family were staying. He was in charge of accompanying the clients up to the apartments in Praia da Luz. The British police believes that this man together with the other two suspects assaulted the McCanns' apartment and upon seeing the little girl decided to take her. The English police suspicions have as basis phone calls records between the three men on that night. The Portuguese police provided at the time the information requested but considers that there are no indicia to incriminate the three suspects. Scotland Yard will carry on with the investigation, as was recently advanced, until they close it in a few months time whether they have conclusions about Madeleine McCann's disappearance or not.

Anchor Sara Carrilho - Carlos, do you think it makes any sense for the English authorities to question these three Portuguese men again, or return to this abduction thesis?

Carlos Anjos - No, nothing makes sense anymore. I would say, from the day the process was reopened or since when the English authorities reopened the case in England and started to investigate, it has never made any sense. It would make some sense if the English authorities had read the Portuguese process and said that there were failures, and then followed alternative lines of investigation. All they did do, what they have limited themselves to, was merely to follow or repeat what was done by the Portuguese, several times. In fact, they are now redoing what they themselves had done, they've already done this step.

Anchor - That they themselves did, they've already investigated this lead.

Carlos Anjos - It has been a series of blunders, even from the point of view.. A few years later they were searching the sewers to see if the girl was still there, if the body had been there the sewers would have blocked and would have likely burst, with all that rained down in Portugal in the past winters there would be no hypothesis. What they have done, from an investigative standpoint, not only was badly done, we cannot also see a line (methodology). Now they want to pursue a thesis of abduction, which is something... They want to talk with three people, it should be said that of these three I can almost guess who they are going to try pin the blame on for the abduction - on the one that died. Of the three men there's one that has already died, and that is always the weakest link since he's not here to defend himself. These Portuguese have been very helpful, even the suspects, because they've always talked to the English. That is, whenever the English want to speak with them, they have accepted to answer their questions and to give them statements. Because they could clam up, they could refuse with the status of arguidos to give any statements. Actually, they are not arguidos1 because the English don't have the capacity for that. There is a curious fact, the only suspect that was an arguido, Robert Murat, who right or wrong was considered initially as the main suspect, the English discarded him immediately, maybe because he is also English, but that one didn't matter for this scenario. We couldn't see a line of reasoning in there.
I believe this process is going to end very soon, after they make this new onslaught in Portugal. They've spent a lot of money, it's one of the most expensive cases in English investigation history. Strangely enough, numerous children disappear in England yet they don't give them any special care, but they have that with Madeleine McCann.
I would applaud them if I saw an investigation done in different way, and if I saw them taking steps that we hadn't taken, if we had failed it would be necessary to do them, and I do think that we failed, this was already said in here, Rui Pereira said that and Manuel (Rodrigues)2 also, that one of the serious errors was not constituting the McCann couple and their friends as arguidos for the abandonment of their children. There were mistakes in the investigation but those errors were repaired. Now, the English have never brought anything new to the investigation, absolutely nothing at all. And we are here today - if people notice, Portugal followed several lines - we don't know of the English investigation a single lead that was different, a single line of investigation that was different, or that it had produced a different type of results.
This is gearing up for one thing, the English, Scotland Yard will end up arranging a report that says that they have eliminated for good the possibility of the child dying in that house, in that night - and I'm not saying that it was homicide, negligent or not - and that what happened was an abduction. They're not going to say much more than that because they don't have any factual basis to affirm that it was an abduction. But they are going to say it. And why? Because this investigation since it started, from the English side, and from the point the dogs came to Portugal, the dogs that detected cadaver scent which lead to a different line of investigation, those English (officers) were replaced because it was of no interest (unhelpful), the thesis wasn't the one the UK wanted and what they want is a thesis that says: 'No, what happened was an abduction and the McCann couple is once and for all exonerated".
Curiously, we heard the process was going to be archived, and I am convinced, it's my personal opinion, that this process wasn't archived now because the Portuguese court decided in favour of Gonçalo Amaral. Since the decision was favourable for Gonçalo Amaral, and the McCanns are very embittered with that decision because they felt that it was unfair - I'm not saying that it was or not, this is just an observation - the English police, at a time when everything pointed to the archival of the case for lack of evidence - there was even a news article on Correio da Manhã and in other newspapers - decided to start new investigations upon the decision of the Portuguese courts. I believe that there is clearly an attempt to exonerate the couple, the English want to remove any suspicion from the McCann couple. In my opinion, it was never their main goal to find Madeleine McCann. The main objective of the English authorities was to exonerate the parents of Madeleine McCann.

If this has been the goal, it hasn't worked very well. More people than ever are questioning the events of that night.

I don't see why SY would spend 12m on this just to place guilt away from Kate and Gerry. I have never believed in the massive government conspiracy stuff that some believe...but then again I have never even made my mind up what I believe happened given that there seems to be no proof anywhere for ANY theory. Its almost like an alien abduction...no evidence, nothing.

WHY would SY spent so much time and money trying to exonerate the McCanns though? Doesn't make any sense. With every extra bit of publicity it seems more doubters appear..so how on earth could this have ever have absolved them of guilt? Pinning it on a dead perp wouldn't work..most of us aren't daft enough to believe that.

I think in the circumsatnces it is important that SY do publicly exonerate the McCanns...it shouldn't be necesssary in a civilised world but unfortunately it is

They can't though, short of actually finding the person who abducted the child and proving that they did it. Throwing a bunch of money at the case and leaking a few stories to the rpess, then closing the investigation without resolution (as looks likely right now) won't help anyone.

I read this so much in regards to this case. Why would a whitewash ever be needed? This case could have disappeared years ago and barely anyone would ever think about it...sad but true. Look at other missing kids. How often do we hear people talking about Ben Needham and such...unless its related to the Madeleine case?

They can...they can make a statement...file a report detailing their findings and state that in their opinion the McCanns had nothing to do with Maddie's disappearnce

we have been through this before.....opinion has a lot of bearing in the court of public opinion....SY's opinion would also be based on the evidence they had seen

Had 'the abduction' occurred in the UK it would have been within Scotland Yard's power to exonerate the McCanns if they so wished.

The newspapers got very exited at one time;

HOME SECRETARY Theresa May has agreed extra funding for police to pursue a full-scale investigation into the disappearance of Madeleine McCann, effectively taking over the case from the Portuguese authorities.
16 June 2013 Sunday Express
http://www.mccannfiles.com/id442.html

Of course there was no chance of taking over anything. The Portuguese had and still have primacy in the case.  They will require extremely solid evidence of wrongdoing by a Portuguese citizen before they will take any action against them. It's clear that there would be an outcry if they acted without having solid evidence.

The situation the McCanns are in has, if anything, been made worse by the involvement of Scotland Yard. They brought their 'expertise' to the case at enormous expense and appear to have ended up no further forward than the initial investigation.

What would be the need in spending all of this money and time..if the plan was just to state that the McCanns aren't suspects though? Seems a bit daft to do all of this just to give your opinion on something (unless they have proof of an actual abductor)

If SY attempt to pin this on a bunchof petty burglars who panicked because child woke up and abducted said child ,they better provde the evidence otherwise they are on a hiding to nowhere.

"of these three I can almost guess who they are going to try pin the blame on for the abduction - on the one that died. Of the three men there's one that has already died"

Is Anjos talking about the man who died in a tractor accident in 2009 , or is he stating that one of OG's supposed gang of 3 burglars who were interviewed in 2014 has since died?

What is abundantly clear, is that SY with the one direction remit, and without any evidence to support abduction will close it down shortly.

It has already been made clear that police officers have donated to Amaral from both SY and other forces, and it is abundantly clear why they have done so.

There will be an inevitable statement that they will await further information, but what clearly some people don't get or comprehend, is the increasing numbers of people who don't believe the mccanns story, and never will.

Evidence of police including SY contributing to Amaral's fund has been posted on this forum, including material from John.

Hasn't the same article been given some credence by people who post here too? Carlos Anjos is not alone in taking it seriously, it seems.

Carlos Anjos [CA], President of the Committee for the Protection of Crime Victims/ former president of the Criminal Investigation Officers' Union of the PJ (ASFIC/PJ)  appears to be little more than a buffoon who is misinforming Portuguese people via the media.

Speaking of the efits released by SY he appears to confuse Jane Tanner with the author of them, which we know to be absolute nonsense.
Giving rise to the suspicion that he does too.

Carlos Anjos: Release of e-fits "is very unprofessional"

**snip

... ... Regarding the e-fit, the only person that saw something gave a description to the Judiciary Police and provided a facial picture of a suspect that doesn't exist, that is, it was a featureless face. The witness was too far away...

AV - It's the picture of a man seen carrying a child?

CA - Precisely, the person gives a description, 30 meters away, at night, and just gives a physical account given that she could not see the facial features. That picture which appears now, is based on that slightly oval shaped face, from that statement that was given initially to the Judiciary Police, composed with further descriptions given by other people, thus we have a face that... a picture of a face that is a composite... - it should be said that these are portraits of the same man, one is of the man 6 years ago that was then aged with a software program, the other is a portrait that was done based on the accounts given by several people. This is very problematic.

To describe the work of another professional body as a "circus" in the same interview is in my opinion a very unprofessional thing to do.  Particularly in a case which involves a missing child.

The impression I get loud and clear from some of the 'old guard' in Portugal is a huge ill will towards anything that is likely to uncover what may have happened to Madeleine McCann nine years ago.
I find that extraordinary.

Claims that SY are in the process of conducting a whitewash are quite common - although no-one has come up with a credible reason why such an extreme measure would be ordered/undertaken for a couple of ordinary folk from Leicester - who were just getting on with life until tragedy struck.   A whitewash makes no sense whatsoever IMO.

Hello Carlos, good afternoon.
Thank you for being here.
This e-fit of an individual, this new "breath" of the [English police] investigation, does it have any credibility in your opinion?

Carlos Anjos [CA], President of the Committee for the Protection of Crime Victims/ former president of the Criminal Investigation Officers' Union of the PJ (ASFIC/PJ)
- Good afternoon. Unfortunately, no. Unfortunately, no.

It seems to me, from the way that this is being carried out, from the standpoint of the criminal investigation to be very unprofessional.

We do have in fact two schools of thought.

We have the school of thought of criminal investigation in Continental Europe that has a particular way of working, where the media is only used to divulge any information when it reaches a dead end and is unable to go further; and the Anglo-Saxon school that uses the media in every way possible...

AV - Often from the outset.

CA - From the outset, precisely, playing on emotions.

For a man who holds such a derisory opinion on the use of media ... he doesn't appear to see the irony in making a very good living from it as a CMTV commentator. (Correio da Manhã TV (CMTV) is a private Portuguese 24-hour news channel operated by Cofina, owner of Correio da Manhã, a notable Portuguese newspaper (tabloid). it is available in basic fiber and satellite. https://en.wikipedia.org/wiki/CMTV)

In my opinion the McCanns wanted a review partly because they hoped it would officially exonerate them. Cameron wanted to help them find their daughter, so he believed in the abduction. May was probably more cynical but she was leaned on allegedly; certainly the McCanns had criticised her response previously. Stephenson was offered funding, a high profile case which could cover SY in glory and find a lost child.

The remit cast doubt upon Operation Grange's intentions. If they were only investigating an abduction they were not progressing the archived PJ investigation, they were following just one of the possibilities, the one suggested and promoted by the parents.

I don't think Operation Grange was set up and funded in order to exonerate the parents. As far as the people who set it up were concerned there was no need to exonerate the parents, they believed there had been an abduction and they hoped SY could find out what happened and hopefully even find the child.

Whatever happened to Madeleine McCann it's disgraceful if a hugely expensive investigation was launched with a restricted remit. The McCanns may indeed be innocent of involvement in the disappearance of Madeleine, but would UK police have accepted their innocence at face value had it all happened in the UK? I think not.

In case you haven't noticed, and after several investigations, nothing has been found.

A one sided remit by SY really said everything which needed to be said, about an investigation which is now drawing to it's close, without a single piece of evidence to support abduction above any other scenario.

Contrary to what some might think, the Portuguese are no mugs.

The impression, I  get, is that the  SY investigation was set up by whoever ordered it with one point in mind, to protect the mccanns.

It is also now known that police officers including some from SY contributed to Amaral's fund. It is hardly difficult to work out why.

...and Brietta, if you has taken notice, the investigation is grinding to it's inevitable halt.

Stating opinion as fact
There is no evidence members of SY have contributed to the fund

What is it with your petty little points?
Who really cares who contributed to Amaral's defence fund?

That is your view of a view from England ... the thread title refers to a view from Portugal on the SY investigation.
Please stay on topic, thank you.

Sorry, Brietta. When I began writing an OG 'whitewash' was being discussed; I was replying to this really;

I believe that there is clearly an attempt to exonerate the couple, the English want to remove any suspicion from the McCann couple. In my opinion, it was never their main goal to find Madeleine McCann. The main objective of the English authorities was to exonerate the parents of Madeleine McCann.
Carlos Anjos.

well if Carlos says that it must be true...even Pat Brown is admitting the McCanns are innocent

It really sticks to the craw with some mccann supporters that people including members of the police have donated to Amaral's fund.

Shame.

From Pat Brown's site.

'If the Scotland Yard Review is Legitimate, Then the McCanns are Likely Innocent'

Yet the review had one remit.

As a reminder, I don't believe anyone on here has accused the mccanns of murdering Madeleine.

IIRC in the beginning all kinds of supporters were apparently contributing to the fund - including Clarence Mitchell.  All those names were eventually deleted as they were obviously not true and were done for malicious reasons.

IMO the claim about SY is just more of the same malice.

The key word, IF.

There is no evidence that the Mccanns or their associates have been investigated at any time by SY.

It had one remit, 'abduction'.

An open investigation would have looked into all aspects of the case and all logical and possible scenarios.

It has plainly not done that.

The bottom line remains in this case, it has not been determined with evidence how Madeleine 'disappeared' from the apartment.

Read around Benice.

Why do you not comprehend police officers including, ones from SY, and former officers , have contributed to Amaral's fund ?

Good questions.
The fund achieved its objective: To ensure Amaral had enough funds to cover the necessary appeals.
An added bonus of course was that the initial ruling was overturned.
