I wonder what Amaral/Portuguese Justice system makes of Dr. Eva Carneiro v Jose Mourinho/Chelsea FC?

Is that the now very rich Dr Eva Carneiro courtesy of the British Court system you are referring to, Misty?
"All I'm going to say is that we've conducted a very serious investigation and there's no indication that Madeleine McCann's parents are connected to her disappearance. On the other hand, we have a lot of evidence pointing out that Christian killed her," Wolter told the "Friday at 9"....

The very same, Brietta. Given the original FA inquiry heard the audio tape which apparently proved Carneiro was not insulted (according to Portuguese language experts) the mind boggles at the expediency of the settlement & the sum involved. I can only wonder why the Portuguese system has allowed a pretty straightforward libel case to drag on for years, instead of just making it "go away" by accepting breach of judicial responsibility.

It was a settlement, nothing to do with the Court.  Chelsea and Mourinho buckled at the knees when they learned of the material which the dear Dr was about to produce to the Court.

  • Eva Carneiro was all smiles today after handed rumoured £5million pay off
  • Employment tribunal for sexism allegations cut short after Chelsea settled
  • The ex-club doctor was due to give evidence and release texts and emails
  • Chelsea apologised to her 'unreservedly' but Mourinho refused to say sorry
  • Carneiro claims Mourinho called her 'daughter of a whore' in match bust up

A malicious prosecution for a crime which never existed. An exposé of egregious malfeasance by public officials.
Indeed, the truth never changes with the passage of time.

ETA It will be interesting to see if Lucy Ward gets anywhere near as much out of Leeds Utd. I was under the impression the UK had a cap of around £75000 for constructive dismissal claims.

Dr Carneiro was going for "career loss damages".

Mourinho is a foul mouthed slob, he is the one who should be sanctioned, not given a fancy new post!  It's a real pity the public didn't get to see the texts and e-mails he sent out, it might have ended in a somewhat different outcome for Mr Nasty.

Absolutely spot on, John.  Mourinho epitomises all that is wrong with modern day football.

It's about insults, damages, quantum & the variance of 2 countries' justice systems of dealing with civil cases, Merc.
I wonder if the Carneiro award will have whetted Amaral's appetite for "career loss damages"?

She seems to have been excellent at her job and I think if another football club doesn't leap at the chance to employ her (if she wishes to continue in employment)it will be a travesty, so I hope Amanda Platell's assessment for the future is wrong, but I think she may well have hit the nail on the head with some of what she says.

I think she is wrong when she says that the decision to bring the case was a mistake ... I don't think she had any alternative but to rectify a situation which had obviously been going on for some time.

I agree with you John.
I would love to have seen her evidence, it must have been damning stuff for them to have settled so quickly.

PLATELL'S PEOPLE: Why Dr Eva Carneiro will live to regret her £5million victory
By AMANDA PLATELL FOR THE DAILY MAIL
PUBLISHED: 01:37, 11 June 2016 | UPDATED: 08:25, 11 June 2016

There was a haunted look on the face of Dr Eva Carneiro as she left an employment tribunal this week following a secret deal which ended her sexual discrimination claim against Chelsea Football Club.
My guess is that although the former team doctor had won a pay-out estimated to be a staggering £5 million, she may have realised that despite her stunning victory, her decision to bring the case may have been a terrible mistake.
Like many women before her who have bravely challenged males bosses over perceived sexism, the long-term effect could be deeply damaging.

There was a haunted look on the face of Dr Eva Carneiro as she left an employment tribunal this week following a secret deal which ended her sexual discrimination claim against Chelsea Football Club

Take two previous high-profile cases, in which successful City women (bankers Svetlana Lokhova and Isabel Sitz) took on their bosses for sexual discrimination. They won huge pay-outs of up to £3.2million but admitted afterwards that they were left feeling debilitated by the experience, with their self-confidence shattered.
Eva Carneiro and Jose Mourinho leave tribunal after settlement

During the tribunals they would have had to defend themselves against an army of lawyers and the inevitable courtroom attempts at character assassination.

Dr Carneiro, as we know, lost her job after the then Chelsea manager, Jose Mourinho, called her a ‘daughter of a whore’ for treating a player on the pitch he didn’t think was injured.
The 42-year-old doctor claimed she was simply seeking what was called a ‘whole career loss’ damages, which is probably an accurate description.
By challenging the oafs who control football, she will almost certainly never again get the job she loved in the industry she loved.
Why would a manager hire her if he feared she might be noting down or squirrelling away incriminating comments or emails for possible use in some future discrimination claim?
At the end of the case, Dr Carneiro said: ‘It has been an extremely difficult and distressing time for me and my family.’

Yes, sexist behaviour is unacceptable, but any woman brave enough to confront it needs to know that money won’t necessarily compensate her for the nightmare she will go through.
Revenge, however, justified, has a tendency — like a penalty rebounding off a goalpost — to bounce back and hit you in the face.
