I am trying to find the definition of responsibilities in the scenario below. Does that mean we become one person?

Only divorce can change the status of married parties. If one is incapacitated, it complicates the divorce process, too. No third party can intervene in the relationship. The spouse assumes responsibilities of the marriage when the other is incapacitated.

Possibly morally but not legally since anyone who is mentally disabled has the right to be legally represented by a trustee or guardian.

Wow, can that be true, can this happen to a spouse after being happily married for over 30 years, that decisions would be put into a strangers hands to make important decisions for your spouse? What if the third party is corrupt.

What if The Spouse is corrupt?

Actually, if I am correct in assuming.  There is a deed whereby the two parties in a marriage can designate this responsibility to the other while still capacitated.  After the event The Law can step in and will probably win.
This deed can also be signed in favour of any child of the marriage.

It seems like a good idea if you don't want to pay The Court of Protection large amounts of money for the right to deal with the affairs of your spouse.
ie.  Also if you don't want to pay The Court of Protection large amounts of money for the right to deal with the affairs of your mother and or your father.

The Court of Protection is a big con as far as I can see.

So the spouse is guilty even though they have been happily married for 30 years. I am just trying to understand the logic in that, when an unknown party calling themselves the law can step in and take over their lives.

No, the spouse is not necessarily guilty.  But if one of the parties is incapacitated, who is to prove that they were happily married? 
This is why these agreements should be jointly signed while they both sound as though they know what they are talking about.  Although this isn't always a safeguard against spousal bullying.

The Court of Protection does have absolute power should even the smallest question be raised.  And will take it.

Try googling Anna Raccoon's Blog.  There is a section on The Court of Protection.  And there isn't much that she doesn't know about it.

Well I'm still trying to make some sense out of it, 30 years of good and loving relationship, confirm by witnesses, the spouse family, relatives on-both sides, neighbors, police records on family abuse, balanced against an unknown third party calling themselves the court of protection, may I say that don't really have a good name with the huge amount of allegations against them http://www.dailymail.co.uk/news/article-1222764/Secret-court-seizes-3-2bn-elderly-mentally-impaired.html

Have you tried exploiting the logic, that everyone above the age of 18 would have to take a deed or a LPA out on every member of there family, I dread to think the cost, and how many 18 year old think of these things.

I personally think that our lawmakers should pursue the things that they are good at, pedophilia, then destroying the lives of family's.

Well from what I can see that these laws are administrative laws, subordinate's to the rule of law.

Well basically they have brought in these laws to undermine the week and can't ill afford to bring it to court, nevertheless it does not make it right but only to further deceive the public.
Well it brings into question does this ministers have the right to do what they have done. Magna carta and the declaration of rights. http://www.britishconstitutiongroup.com/british-constitution

Yep.  That's about it.  The Court of Protection is an abomination, in my opinion.  They can even imprison people in secret if they think someone has broken their laws.  Although it is becoming more open due to a large amount of fuss kicked up by people who went to The Press.

But you need to think very carefully before doing that.  Not a course of action that I would advise, unless you can cope with having your life ripped apart.

I totally agree with you, using the tools that society provides is certainly not the answer, but in keeping my family at bay from the hounds it has cost me dearly financially the system is a trap for those who think’s there is help, but conditions attached could remove your right's and destroy your family.

I am so sorry that you are having such trouble.  As if you needed any more problems.

I was advised ages ago about signing this deed, giving my children rights over my affairs.  I haven't done it.  But I live in France where the Laws regarding Family are very different to UK.
As it is, I don't have a husband, and my children will be expected to care for me, or else.  France doesn't mess about when it comes to family.

I can empathise with your predicament Colin.  My late aunt designated me as her trustee and sole power of attorney but the Scottish Crown saw fit to challenge my aunts decision and painted me as some sort of embezzler even though every single member of our family refute the Crowns position. 

Make sense of that if you can?

Well Eleanor, there is not much I can do about this scenario we are in now, as a 24/7 carer I do not have any time to myself, my wife is extremely demanding through no fault of her own, our lives transform in a second when washing machines hit her falling from the height of 30 feet at Costco's.

I just cannot come to terms with what has happened to her, they have destroyed both of our lives, I cannot even do anything about it if I am to care for her.

Well you are living in France, lucky you they don't take any nonsense there and they have a better standard of living, we are extremely tolerant here so we deserve what we get but that is the British way.

Hi John, it is certainly mind blowing.

My wife is not registered as disabled so we are still living as an ordinary married couple, I do not claim any allowance or asked for any help, so I do not here a word from them, even though I could claim for everything I do not want anything to do with them, I would have to declare that my wife has no mental capacity to obtain any help but I am managing to pull through even though it is extremely hard and soul destroying, no 1 to talk to that makes any sense, I am lucky if I get two hours sleep on the trot.

But one of the things that keep me going is that I will get Justice one way or another when my responsibilities to my wife is over, they will probably send over one of their hit man but by then I would not have anything to worry about.
