Eleanor, we should not be in this situation after a horrific accident that is no fault of ours, the money is in court funds, whatever it is? Gathering 12 years of interests.

Not being able to do much in my situation, I have pleaded with one of the larges firms in London for human rights to help me but with no results at all. It does not make any sense when the solicitors have walked away with £400,000 and we are just about surviving on our pensions.

Hi Shubhaa, I do realize you are a very busy person, but I feel I have to talk to somebody like yourself about our position.
 
I have suffered with my wife for years because of the injustice that we have been left in, after reading your motto, “We're Leigh Day and we believe everyone has the right to justice and for their voice to be heard.”
I felt if anyone could hear our case it would be you, I do understand that you are extremely busy but we are prepared to wait as long as it takes we have already waited for years being a 24/7 carer for my wife it has been nothing more then a great hardship for both of us.
 
Well our scenario begin when washing machines fell from the height of 30 feet and it hit my wife missing me, the solicitor I employed never bothered to see my wife after eight months from the accident, I was too concern of her to realize that he was breaking all the CPR rules at the time but when I realize all what he had done it was too late to help my wife but only to contact the Law Society, after reading all the documents they told me there was nothing they could do, they had informed the firms insurers and I would have to sue the firm if I wanted to take it any further, but this is not what I need you for, we are stuck in a horrible situation where my wife compensation is held in court funds and there is nothing I can do about it being a 24 7 carer I cannot pursue their demands, I believe we have not been given any written Court order about the demands.
 
I believe this link could help you to understand the horrific problems we have had, after removing the first solicitor of the record, he must have said to the new solicitor that we were troublemakers and determine to cause problems, and that was the beginning of a continuous nightmare.

I believe we are connected on LinkedIn, but did not ask you for help because I thought it may place you in an awkward position this late in the day, but I am extremely desperate now I would not like to see my wife die without seeing a penny of her compensation.

Hi Eleanor, thanks for answering my post. Well I wish it was as easy as that but the reality is something totally different, my son had to get a social worker to help him find a home when I was in hospital for that few days at short notice, the social worker seem to be efficient even though she was an African not living in the area, I have nothing against Africans but surely I have been contributing towards the system since I was 15 when I started my first job, never however needed any help in my life up to now and the best Edmonton can offer me is a social worker living out of the area and don't know what I'm talking about.

Anyway she had us filling all the forms required could not do it myself my elder son came down to help me do it while she was here, few weeks when by and she turn up to say that she was going to put another social worker on our case that was experience with brain injury for the benefit of my wife, I could see the logic in that an agreed.

Another several weeks when by waiting for help, then the new social worker, another African lady who doesn't live in the area and don't know the homes in the area, introduce herself and my son had to fill in another stack of forms, I said we had just filled one lot in, her reply was it was another department we need ours filled in for our department, and vanished for another few weeks.

She phone me a couple of times on the phone and asked me have I decided on the homes she offered three of the worse homes in the area, I told her one of them nearly kill my mother-in-law they had to bring the priest in to give her the last rites, we had to move her out of that home and she survive for another year in a half. She certainly expect us to be running around, my wife that cannot do anything, myself having a stroke on my left side haven't help me because I'm left-handed, she said she was going to call me back soon, after another several weeks she decided to call and told me that she was a trainee social worker and she may be finishing the training soon, I was totally shocked, I said, I thought you was a social worker that covered brain injury patients, she said nothing.

Since my stroke on November 19, I have not received any help at all, hardly any communication with the social workers to see how am I managing.

I never discuss my condition, but maybe on this occasion I should...................................

I had a lot of support from social workers, specialists, doctors etc, when I first became disabled (suddenly after an illness), but not now.
I have had to pay for a carer, gardener, cleaner, house adaptions and all the necessary aids, required by someone who is bedbound, except for my hospital anti-pressure bed.

I suppose that you already know that you can get no assistance if you have more than £23,000 in the bank, have a private pension or own your home(because you don't have to pay rent).

Its the usual.......If you have worked hard and gone without to buy your own home, you are penalised when you are disabled.

I have considered moving into a nursing home, to relieve my family of caring for me.
My brain and my hands are the only functioning parts of my body left and it is a struggle coping, so I sympathise greatly with yourself and your wife.

My husband is diabetic with a now dormant brain tumour and gets confused and easily angered. We have no compensation due, but just do what we can with what we have. I'm afraid that is all one can do.

I have regular GP visits(mainly for pain control) but the social work management support teams have been stopped by the government, so I don't see them now and miss their advice.

I hope you can get it all sorted soon..........I know what a nightmare it can be.

You must try and ride above those feeling Colin. I have had such feelings too.
Keep occupied and try to plan what you can do next, to hopefully alleviate your stress and your wife's condition.
I plan and manage the home and garden from my bed. I enjoy that and being on the forum(when my hands will allow.

Are you having therapy for your paralysis?

Can you not get a home carer to care for your wife?

A live-in carer is cheaper than a residential home, if you have enough rooms......Not an option for me as I need a nursing  care too, to an extent.

There is also the option of a care assisted flat/bungalow where you can be helped in a warden controlled building.
Have a look and try the council for help.

You could do with a holiday where they have carers on site. Have a look on the internet.
Ask your GP about the £700 you can have towards a holiday and they should arrange it.

I guess you already know all of the above, but just trying to help.

Keep your chin up and work through it, but don't give yourself another stroke.

Anna things are far worst here then you can imagine, I'm not the sort of person who pray for God to please remove us from this awful world, so it must be horrific. As for holidays, we have not had a holiday since my wife’s accident at Costco's no holiday for coming on 13 years not even the short break not even a day to myself.

Believe me if you really want to help, please pray for us both to go together as soon as possible. We don't really want anything from this corrupted and evil society.

Colin,

I know things are bad, but you mustn't think like that.

Call your doctor and go and see him or arrange a visit.

And get something arranged so that you can get away for a couple of days at least.
Can your son take over for a couple of days?

I know that the system is dreadful when it comes to carers and the severely disabled, but you can book a holiday in a care assisted holiday place without any help from the government.

Priority right now.................Is you getting a break.

We gave up on holidays too, a long time ago.

If this accident was 12 years ago, why are you still waiting for compensation?

I am totally exhausted, if you know what I have just been through, having to fight with the poo trying to change my wife with her struggling and having to clean and sterilise everything, I wouldn't take this job on for £1000 an hour but do it in the name of love for nothing.

If you get the time to read the link to the Solicitor, yes I am wondering why we have not been paid, nor one is giving me any answers, I'm talking to a brick wall, you would not think it is possible, well here it is, believe it or not.

Sorry, Colin, I was trying to help in a practical way, but I now realise that it is the compensation issue that you need help with.

I read the letters and some of your old posts. Its dreadful how people are being treated.
If I divorced my husband, I would get all the help I need  ?8)@)-) Its daft and needs sorting.


I hope you can get the compensation sorted soon. The extra cash would give you more options on how to care for your wife, but I have no idea where you should start, to get at that compensation money.

A live-in carer and an extension seems the best option, if you do not want her in a care home, but you would probably need the compensation to pay for it. I don't know.

Solicitors keep their mouth shut and look the other way, I can only say that they are all corrupted in the UK, being silence is just as much as being guilty of the crime.

Well yes it's the crime that they are hiding from, this case is riddled with corruption against a poor individual with horrific injuries not being able to fight back, that is how low the legal and judicial system in this country is, at present this is an extremely sick country, there isn't any logical reason why they should hold a plaintiff's compensation for 12 years depriving her of her human rights in every way, and pay the professionals involve £400,000 for their efforts.

I have to use whatever little we have for Private medication costing £100 a month to keep her well and pay for her disposable pants that the authorities would only allow her one in a half pants a day, I don't know how many times do you all go to toilet in 24 hours, I have to check her every 2 to 3 hours making sure that she is not wet, I could not live with myself knowing that she is sitting in urine or poo.

I never knew that I could have ask for help with her disposable pants mention the social worker, I suppose I should be grateful for that 1 1/2 pants a day costing £1.50 we are not told anything, I know by my business I ran, my Muslim customers had all their entitlements that they were entitled to, helped and educated about by their Islamic social club, but not my English customers, pathetic.

Hi Colin,
       If I divorced or capable of having 4,5,6 or more babies with no partner. I would get lots of help.
We are a minority which reflects in the inadequate attention received by those with the power to help.
The severity of your disability does not come into it.
I know of several people who are classed as disabled and can walk around indoors and out, without support of any kind.
Like you we have spent a fortune on necessities and the carer costs are getting ridiculous with double fees for weekends and BHs. I wish we had never purchased our house or saved our money when we did.
If they don't catch you with your disability needs, they will catch you when you are old and need care. Quite disgusting and a bit prejudice against the disabled and elderly who do not live in council property.
I should have known years ago.
Before I lose my home too(should I live that long) I will be selling it very cheaply to my children and paying it back in advance rent.
I have washed my hands of any help possibly emerging.

Hi Anna, the people who rule us have a good reason why they do everything they do, there is a reason for all their behaviour, I know it is difficult for us to understand unless you know the whole motive of their behaviour, I believe some of it could be found through David Ickes books and many others, since I have embark on this journey trying to understand why things are the way they are, people have sent me off in different directions hunting the answers, and it is amazing how things come together and it all makes sense eventually.

As for the medication, my wife is at the very late stage she cannot afford to lose an inch more memory it would probably be the end of her, so I buy her Prevagen hoping that it would prevent that other inch from going, so far we are where we are, and hanging on to what little life is left for her, it may be that I'm living in hope but I know she cannot forget how to eat or drink, she was going down that road so I had to do something it may be grasping at straws, but that is all we have. I also give her Waterfall D-Mannose to prevent UTI infection it's supposed to be very good, because a lot of people in her position seemed to die of it, I must be doing something right after all she has survive 12 years many of the people and the family carers have lost their loved ones since I first communicated with them on the Internet.

I think one of the reasons they are treating me the way they are doing is because I belong to a lot of groups that they hate, who are exposing them for what they are, but I sooner die knowing that I have tried to do something rather then doing nothing.

Well I am studying Islamic religion at present, after being a Catholic all my life, passed down from my grandparents and parents. Going by the behaviour of our solicitors and the judicial behaviour to us, especially my wife, they have committed “haram”, pathetic our judiciary as broken the laws of the Koran and have made a mockery out of Islam.

The Qur’an also calls to the protection and sanctity of peoples’ lives and specifically mentions that the taking of an innocent life is one of the worst and most hideous crimes. The Prophet forbade breaking the bones of a dead animal so what about the taking of an innocent life? The Qur’an prescribes a life for a life and an eye for an eye for all injuries, however large or small, unless the family of the person killed or the injured person accepts financial compensation instead.

The House of Lords Committee appointed to consider and report on the Mental Capacity Act 2005 has now published its report. 
Key findings
The Committee’s second key finding is that the Deprivation of Liberty Safeguards are not fit for purpose. The Committee recommends that they be replaced with new provisions.
Lord Hardie, Chairman of the Committee said:   “We were very concerned by what we heard about the safeguards. The evidence suggests that tens of thousands of people are being deprived of their liberty without the protection of the law, and without the protection that Parliament intended. Worse still, in some cases the safeguards are being wilfully used to oppress individuals and to force decisions upon them. The Government needs to go back to the drawing board to draft replacement provisions that are easy to understand
