Inadequate perhaps, but not illegal.  If she was run over or abducted however that would be illegal and I'm sure you'll be the first to condemn in the harshest terms those responsible.
If MBM was run over, it would raise one heck of a lot of questions as to whether what was described of the event scene at apartment 5A is true.

You can't help yourself can you?   That is not the only instance in which it would be illegal but you chose only the above scenario to describe.  I wonder why...

If the child was knocked down by a car, the more likely explanation for the lack of a body would be that the driver removed it, but you don't seem so keen to consider that, in favour of "someone" coming across the body in the road and for some utterly inexplicable reason deciding to conceal it.  That's what is odd, your strange bias...

1. I've never heard of anyone taking the victim of a road accident with them.
2. Hit and run is pretty common.
3. What about the 'evidence of abduction' windows and shutters?
4. I gave the reason for 'someone' hiding the victim; fear of being blamed.
5. I have no bias, strange or otherwise, but I will continue to counter the stories of others invented to support their bias.

30 seconds googling turns up this https://en.m.wikipedia.org/wiki/Death_of_Gregory_Glen_Biggs
Now over to you to find an example of someone coming across a road traffic accident victim and deciding to hide the body.  But of course you won't because you know when you're beat and have withdrawn from the argument. 
In any case both scenarios are extremely unusual, but one even more so than the other.  IMO it didn't happen to Madeleine this way.

If your child has disappeared for reasons unknown why would you stage a break in?

But if a hit and run happened and the driver picked her up that would put a spoke in the works.Even if the only reason he picked her up was to get medical help.
