is amaral talking of an appeal?

Someone whose opinion I respect believes Amaral could find a basis of appeal.

Whether he will is another question.

Offline Anna

I guess everything is subject to appeal.

I couldn't fathom what basis of appeal there might be.

But apparently, there is one ...

Appeal is a possibility FM, but Amaral is said to be Also..........

Extract:-

Amaral has let it be known that he is considering instigating a counter defamation lawsuit against the McCanns to seek compensation for the enormous damages on different levels he claims they have caused him.

he said this before the verdict....and has been saying similar things for 6 yrs

He has said it again, in the last few days.
He would however have had to wait until all other active court cases had ceased.

If he did claim damages on a defamation case, against the McCanns, would he not have to do it in the UK?

I also wondered if a libel action could be brought against the book and other items relating to amaral, that is freely online here in Uk?

   Just wondered. Any thoughts?

The injunction on the book that was  overturned in a higher court, means that his book is legal in Portugal....but I doubt that would be the case here?

You could only sue websites in the UK that hosted the book not GA. It was proved in the trial that unauthorised online copies of the book impacted the PT profits.

So the free books etc online, affected their sales in PT (all unauthorised material) .....and nobody done anything about it?

That was plain daft.

That Amaral might appeal against the final (or as it would then be, interim) decision in the libel trial is feasible.

But what basis of appeal he would have, I've no idea.

Before getting too excited, perhaps consider who authored this piece?

Yes all very strange indeed. We will just have wait and see, I guess.

The author wrote that Gonçalo Amaral is considering suing the McCanns for damages, he did not mention anything about appeals.

Amaral was reported elsewhere of having said that (if you're referring to his toying with the idea of suing thej McCanns for damages to him).

Just found where I may have seen that before. It was also by Len Port.

...Towards the end of his statement, he revealed that he is considering filing a lawsuit against the McCann couple and others, “in order to be compensated for the enormous damages that they have caused me already, on all levels, such as moral, professional and financial.”

Mr Amaral concluded: “The time to judicially react to all those who have put my privacy, my intimacy, my freedom of expression and opinion, and my survival conditions at stake is approaching.

“They have tried to assassinate me civilly, but due to the support and solidarity of all of you, they were not successful.”

ETA: Further up on that blog post, it was apparently in a Facebook post he wrote to his supporters.

Seems even Expresso's ( that staunch defender of all things McCann) has  gone over to the dark side.

So if they weren't successful what is he complaining about?  Isn't this the same as is being said about his book?

If his book didn't destroy The McCanns and The McCanns and Supporters didn't destroy Amaral, by Amaral's own admission, then what is the argument for Damages?

Amaral was certainly damaged from a financial view.
