We don't know whether it was opened from the outside or the inside, though. It possibly was, but there is no firm evidence.

You assume it was opened before 10 pm.

b....r all evidence of that.

We don't

Yes there is clear evidence it was opened before 10 Steve - a witness gives evidence that she discovered it already open.
And there is absolutely no evidence to indicate that she opened the window.
BTW the supposed fingerprint, in a position which indicates she opened it, simply does not exist
Prints on glass are consistent with leaning on the already open window. Not with opening it.
Think back, when was the last time you opened a window touching only the glass?

Someone opening that window from inside would touch ONLY the handle and the lower button and the aluminium immediatly behind the handle, NOT the glass. The only place they would leave a digit-tip print would be on the lower button, and that would be a thumb-print. They would leave no prints of the tips of any of the other 4 digits.

I will pass on your nice magic mushrooms.  I have never indulged and I don't intend to start now.

I am curious, however, as to their impact on brain function, for the following reason.

Mechanical key.  Access by multiple staff.  Key cutter within 100m.  €6.50 per copy.  Weak control over key retention.

Q1 What in this issue do you not understand?

Q2 Is this, or is this not, weak security re keys?

Q3 Are you going to tell us what your 3 out of 10 theory is?

Q4 How does one tell if a mushroom is magic?

Q5 How does one tell if a magic mushroom is 'nice'?

Q6 Do magic mushrooms and jugged hare go together?  I am trying to get some distinctive recipes together.  I think I can manage the hare.  Not sure what the Portuguese is for magic mushroom, though.

I gave your theory 2 out of 10, and I don't have a theory of my own because there's not enough evidence on which to base one imo.

I have used electronic keys. On one occasion I reached the room door and it didn't work. The receptionist re-programmed it and then it was OK. That suggests the cards are 'blanks' which can be programmed to open a particular room. Easier than trotting off to the ironmongers then? Also, what happens in a power cut? An hotel may have a back-up system, but the OC was too scattered for that.

Who did before 10 pm ?

Never seen that.

You can press the glass after lifting the catch.

I see that happening regularly.

(snip)
KM gave evidence that the window and shutter were opened before 10pm.
There is no evidence (unless you can post any?) to indicate she is lying.
The first part of the case (child missing from that room) is entirely solve-able on the basis that KM is telling the truth.

I am not interested in what she said.

Where is the independent verification the window was open before 10 pm ?

There is none.  What she said may be true or false and we have no way of knowing which it is.

Look at a photo of the window handle and its two buttons.
Imagine you are inside the bedroom and want open the window - how would you do it?
Leaving 5 identifiable prints on the glass and none anywhere else.
If you can't do that, then it's unfair to claim that KM did.

The only evidence found on  the window was hers. Why weren't Gerry's fingerprints found?

"The windows were closed and the curtains slightly open. Gerry, who followed her and the elements of the GNR, said he did close the window because of the babies sleeping in the room, a fact she confirms."

Is this another witness who lied like Fenn, cleaner etc?
Smithman carrying a child in his arms checked his watch after passing the Smith family and the time was 10:03. Both are still unidentified 10 years later.

KM clearly stated that she found the window and shutter already open.
There is absolutely no evidence to indicate she is lying - if there is please post it.

If you're claiming there is a fingerprint indicating she opened the window, please post a photo or file reference of it.
Unless you can post some actual evidence that the witness is lying, the reasonable presumption must surely be that she is telling the truth.

Unfortunately for Kate there is no independent corroboration that the window was found open.  It might have been open, it might not. Even if it was found open that in itself does not support the abduction theory.
A malicious prosecution for a crime which never existed. An exposé of egregious malfeasance by public officials.
Indeed, the truth never changes with the passage of time.

Pathfinder unless you can give an exact step-by-step description of how you would open that window from inside, leaving 5 prints all on the glass, then you are not qualified to accuse KM of doing what you can't.

I don't see that any prints on the inside of the window need be contemporary with it being opened. They might have been made days earlier.
