I also think the fact that Madeleine's case has been the subject of, now, two thorough professional investigations cause for celebration. Why would you think I wouldn't ?

It doesn't answer the question though why the McCanns failed to thank OG and the HO in their message. Can you think of one single plausible explanation for that ?

Perhaps the reason (if there is one) will become clear in 2018.

It has not been a good year for the McCanns what with the Portuguese Supreme Court ruling confirming the earlier decision by the Appeal Court to uphold the appeal by Goncalo Amaral in the damages case McCann v Amaral & Others. To add insult to injury however, the Supreme Court felt they needed to go further and included within their decision the clarification that the McCanns had not been cleared. This clarification was itself appealed by the McCanns but yet again rejected by the Court.

Lets hope 2018 is more kind to them and their 'search' for Madeleine.

It must have been the worst year for them since 2007 imo.  They were all set to win a fortune in damages only to have it snatched away, how dastardly inconvenient.

IMO none of those enormous bids for a 10th anniversary interview seemed to be finalised either.

I don't think any year since 2007 can have been an easy one for them.  I agree that it is disappointing that the good people who would have benefited from the distribution of a damages award won't for the time being ... but who knows, that could be a temporary blip.
I seem to remember through the dim mists of time that similar promises were made should Amaral come into his own ... seems the time might be here already?

A temporary blip ? Do you honestly think anything could now change the judgement of the SC ?

The ECHR could decide that the judgement did not comply with ECHR law. THE SC judgement could not be overturned. However any new statements by amaral...any new book...could be the basis for a new legal challenge. If the mccanns had a judgement clarifying the law re defamation then I dont see how the portuguese courts could ignore it in any new case. This is imo why amaral is now quiet

I don't think anyone here really knows the answer

Does amaral have a case....where would he sue..could a Portuguese judgement be enforced....and then what effect would a favourable ECHR ruling have
What we do know is he doesn't seem to be suing and he seems to have gone very quiet
We will know a lot more if and when we get details of the alleged ECHR claim

No money changes hands until the final decision.  It is the Courts responsibility to ensure Amaral receives what he is due.  Any claim for damages, loss of earnings, material loss etc is another matter and will require him to sue for those damages.

The SC decision relates to a civil case between private parties and cannot be overturned by the ECHR.

What good people; more dodgy PI's? There is no temporary blip, the McCanns will never get any money from Amaral, they lost their case and were ordered to pay the costs of all those they sued. Not only that, their claim that they were cleared in 2008 was dismissed as incorrect.  They may be innocent of any wrong doing, but there's no judicial decision which confirms that claim.
