Why does David James Smith ‘always cite’ this when it’s not true?

David James Smith worked for the CCRC reviewing Criminal convictions.

On page 3 of the transcript it states,

‘I met my first victim of a miscarriage of justice many years ago, when I wrote about him for the Sunday Times Magazine. I went to see him in a high security prison where he was serving a long sentence after being convicted of blasting his girlfriend’s parents to death with a shotgun at close range.
I would usually counsel against making judgments like this – because I don’t really think you can tell who is capable of murder or can believe someone who tells you they haven’t committed a murder when the law says they have. I think you should judge on the facts and the law and not on gut instinct. But a less likely murderer than Jonathan Jones is almost impossible to imagine.
Jones was a mild-mannered and softly spoken young man, perhaps a bit unworldly and disorganised. He said he had been in Kent when the parents of his girlfriend, Cheryl Tooze had been killed with a shotgun at their remote home in South Wales in July 1993


In February 2017 via The Justice Gap online magazine owned and run by Jon Robins, David James Smith stated, under the bold byline, ‘Factually innocent

‘I know people say it’s always the quiet ones and that we all have it in us, in the right circumstances but, really, a less likely murderer than Jones it is difficult to imagine. Even the trial judge thought so, and, controversially, said so.

Having done a ‘deep dive’ into the material available online - I’m of the firm view Harry and Megan Tooze were murdered by Jonathon Jones who went on to marry Harry and Megan’s daughter - Cheryl Tooze - now known as Cheryl Jones.

Will be interesting to see if David James Smith appears in the forthcoming Mindhouse TV docu series. He was involved in the BBC’s doc on the murder of Jill Dando, which apparently was made to mark the 20th anniversary of her death.

What is wrong with these men?  Why do they feel they have the right to terminate the lives of those who won’t give them what they want?  Or perhaps they just enjoy the feeling of power over others.

It's something that's always happened. On the whole, women and children do have more power and freedom today than ever before. They are no longer seen a man's property. In my young days I had to produce a letter of permission from my husband to put our children on my passport. I wasn't allowed to sign a credit or loan agreement and if we were caught without a TV licence the head of the household (my husband) was blamed, not me.

No - there is no witness, here is what passes for the arms and legs of MK being on Newbattle Road. Innocents Betrayed. P.235 by Ms Lean. Under "Mistaken Identity.

Ok, where to start. Firstly it would appear that MK is his own witness!! It is him (claimed) telling someone, that he had been seen running on this road. There is no actual witness statement from anyone seeing him running on the road. The, this, "he had gone to one of the local stores" and the supposition and assumption of it being either the one in Newtongrange or in Eskbank.

Let us stop there, now MK is stating he was spoken to by the police. So it is ok to state that everything he therefore said was true, but not that he had been spoken to by the police!! Now add the actual reality, whatever may have been said to the police, MK was spoken to. And whatever was put to MK he told them exactly where he had went for alcohol and they checked, and he had indeed and was on CCTV confirming this.

And the contradiction - of MK stating someone saw him running on the road and the insert of both these local stores would merit him traversing onto this road. Now the truth and the reality - MK had said he had been seen running for alcohol to a local store. Running to catch it before it closed for the evening.This "local store" to the Abbey is in numerous directions. In 2003 the one in Newtongrange used to close by 9pm. As did all Scotmids at the time, did they not? Now the short distance from his student room, is through the Golf house onto Abbey Road and into Dalkeith.

Now, as I have been stating several times, the author whilst attempting to show different points, consistently contradicts herself with others! She claims that MK was not checked for using either the store in Newtongrange or the one in Eskbank - and think. The boys on the pushbikes, she claims, and love the "around ten to six" were seen on the CCTV footage. And of course CM. And think again, that sighting by F&W and this claimed "mistaken Identity" - Did they just miss out the areas of that CCTV footage then!! That had this twin of LM in a parka jacket in that store - No of course they did not. What is shows, without a shadow of a doubt, is that MK was not in that store buying booze. Thus MK was not on that stretch of road and there was no "Mistaken Identity"

And to draw your attention, to just how much any information has been manipulated and morphed as above. Stemming from, "running to a local store to buy booze" then inserting it had to have been one of only two stores if "local"

And this does work across the board, as we had with the bike at the break in the wall - morphed from "close to", to at and at the V - when the break can not be seen from anywhere other than directly beside it. And we know it was a motorist, and we know they were from BTH - and the author knows all of this, and it is morphed into something else, and used, even though she can not fail to know that it is categorically wrong!!

This consistent talk of everything that SF claimed, was substantiated in the years to come, by other witnesses, who had said similar things! Really, now even without the arms and legs, it is not hard to see why? For does one imagine that this SF simply spoke to no one else other than MK!!

How does it go, one seeing scratches, onto another being told. One saying they had run for booze at a local store and onto another being told. And they tell someone else and that little bit more, and those Chinese whispers grow into something completely different!!

Before you know it, there are two or three more witnesses, who have been told by that first source, saying similar things - and the end result with it's clear contradiction and proof! Is that MK was not in that shop in Newtongrange buying booze or owt else!!

So again, the waffle upon waffle upon waffle - Proves that he was not in those shops, that he was not on Newbattle Road (we knew this of course, two lads, twins and every other piece of guff). That he was not out of his head on a cocktail of drugs and drink, so much so that he ran to that shop later in the evening to catch it for booze and so forth.

And the waffle about the 50k and this "It makes no logical sense" - it does not matter, it happened, 1k, 5k or whatever!   And the tutor and that essay!! All this, just because she states she can not remember any such essay, or that no essay exists - could mean simply that, that it did not exist at the time of the appeal, and the tutor just simply could not remember ------BUT, they remembered he wrote one about mugging an old person!!! Again that contradiction! Whilst trying to show, claim the tutor may have forgotten, she needs to get in what they did remember, that which was not nice - of mugging an old person!! - Really, well they would certainly have remembered!! Killing a girl in the woods type of story, that is a fact!!

Not just before 2200 hrs, buying booze at Haddows? Two separate sightings. Well, that’s what I infer from the ‘Mistaken Identity’ portion of ‘IB’ (starting p.233).

Drawing from my own personal understanding of the case, and my own instinct, I think it’s very unlikely that MK had anything to do with it, but it’s these messy little facets that prevent me from saying, categorically, that Luke is guilty beyond reasonable doubt.

I note with interest your views, beliefs and understandings regarding the relationship between Jeremy and myself.

I would like to add that our 'friendship' ended solely due to the lies and self seeking antics of Tracy Brazier from the Innocent Group.   Her behaviour I found to be unsettling and most disturbing - I found myself on unfamiliar territory when having to defend myself against her lies in order to discredit me in the eyes of Jeremy and the Campaign.

Jeremy chose to question me regarding the false accusations made against me and when I felt him lying to me down the phone I chose to walk away from him.  He did not drop me - I dropped him!!

He was someone for whom I strongly believed was wrongly imprisoned, he was alone and the nation had turned their back on this 'child killer'.  I did what I could at the time, for many years, but I should honestly add it is nothing compared to what others have done recently using the web and new technology.

When our 'friendship' ended I was deeply saddened......and I was concerned for his own well being having become more aware of the 'new' people surrounding him.  Liars, self seeking and deluded bamberettes and clever manipulators.....but I could do nothing more to help him.  Whenever I informed him of 'their' antics he tried to assure me he knew exactly what these people were like and described alot of them just as I have here.

However, after almost 20 years of befriending this man, it came as somewhat of a relief to let others take over.  I felt responsible for him for many years and it was a weight lifted the day we parted.  Today, I only hope that those around him stay, as I did, when all else is lost.

I hold no resentment against Jeremy and will not attempt to make him out to be someone he is not.  I don't feel it necessary to post his letters, our photo's etc......it was a strange relationship at the time, as he was in prison, but during our time together he was a most decent and respectable man.

I have come to believe and understand that Jeremy makes decisions based solely upon the information he receives from other in the outside world.  If the information he receives comes from somebody who dislikes me or feels threatened by my position, then the information about me will be most negative. And, if that person can have Group members support her lies, by also writing to Jeremy, then I don't stand a chance.  I refused to play the game and walked away.  Quite happily.

Should he ever be released, then he will have to come and see me as I still hold his most valuable possessions from his family.....and his own.  The truth comes out in the end.....one may just have to wait many years, but I'm in no rush at all!

I hope this gives some insight into those 20 years and gives answers to questions so far unanswered.

I wonder if with your combined expertise and knowledge, you can help me...

I am looking for an intriguing, compelling and important case/story that takes place or is strongly linked to the South West of England.

I am developing a programme for television and so am looking for a case that warrants an in depth investigation and coverage.

It needs to have a compelling story with a decent amount of known detail and material that could be drawn upon to help tell the story.

I would love to hear suggestions for stories you think haven't got the attention they deserve.

Ordinary or not he was 14 years old…a child in law.

How anyone can condone behaviour on behalf of the police that even the Appeal Court judges described as ‘deplorable’ is beyond me.
