If the child was to be sold,
Where is the money?
Why was he found 3 days later by someone other than police, with burn marks from the cold?
The police were already interrogating the mother, before he was even found
I may have missed it , but can find nothing on domestic abuse.....I wonder if she had bruises

Anyway a brief update:-

The mother was given visitation rights after being released from 2 days in prison

It looks as if the childs father may forgive the mother?

"Right now is no longer a situation the Commission for the Protection of Minors, but the court," said Bernadette Vieira told reporters on the sidelines of XIII Forum of the Child which runs in Funchal, when confronted with the issue of safety of the children of Lydia Freitas, indicted for the crime of trafficking in persons, on suspicion of involvement in the "staging" of the disappearance of little Daniel, 18 months at the time, in January this year, Calheta (west of Madeira).
The official stressed that "there is a suspicion of crime, if it is confirmed the court will make the decision and Social Security will meet this decision."

"The District Court of Ponta do Sol decided that the two minors are subject to the father's support, getting to live with his father, but always under the supervision of the Social Security", added the same source.
The decision states that "the father has to ensure all conditions to the two children."
In another joined case, the Court of Ponta do Sol also decided to parental responsibilities.
In this case it was established a "visitation rights to the mother," as well as the provision of a monetary value on the part of this, but due to its' current financial situation, "can be difficult to achieve.Contacted by the agency Lusa's father, Carlos Freitas, expressed satisfaction with the decision of the court and proved convinced that all conditions have to have children in their care.
Daniel, now two years old, disappeared on 19 January during a get-together with relatives and was found three days later.
According to doctors who observed the boy at the time, this was "clinically well", only with signs of burns due to the cold, in a case that considered "intriguing".The child's mother was arrested by judicial police six months later, on June 23, and so far  only suspected of involvement in an alleged staged the kidnapping of the child.
In June, Freitas Lydia was detained for two days at the Prison of Funchal, but after having been heard by the Public Prosecutor in the District of Ponta do Sol [county where the event occurred] and the judge of the Criminal Investigation Funchal, was released, pending the development of the process with term of identity and residence, with the obligation of the authorities biweekly presentations and prohibition to leave the region.

02/23/2015 07:55 Mother leaves little Daniel Lydia Freitas not seen the boy for two years. By Magali Pinto
Lydia Freitas left to visit his son Daniel, Calheta, Madeira. The boy abducted by the mother to be sold in January last year, lives with her father and sister, Mariana, in a new house. Lydia is indicted for the crime of trafficking in persons, but is entitled to two visits per week. A month ago that does not appear at home. "She never came here. She is who knows. Not phones," said CM Carlos Abreu, father of two children, who held the temporary custody after Lydia Freitas have been held by the Judicial Police. Carlos Abreu does not work, do a few odd jobs, and through serious financial problems. "I do not neglect my children, but there are months when I have to stretch the money. This month has not paid the bills," he added. After being taken to court, Lydia Freitas combined with ex-husband would visit the children at his house, as now, with a new boyfriend, Lydia lives in a house without electricity or water. It got to spend a week in Carlos Abreu house, but since it came out a month ago, no longer returned.

Press release today.

Daniel's mother, the boy who has been missing for three days in Calheta, Madeira, in 2014, accused of the crimes of kidnapping and human trafficking, began today on trial at the Central Court in Funchal. The defendant, Lydia Freitas, refused to give a statement to the collective of judges chaired by Carla Menezes and assisted by Teresa Miranda and Philip camera. The facts date back to January 2014 19, day in which the child, then 17 months, was reported missing during a lunch at the House of relatives of the mother.
The facts date back to January 2014 19, day in which the child, then 17 months, was reported missing during a lunch at the House of relatives of the mother.  Lydia Freitas has been to remain silent during the trial in the Court of Funchal. According to the District Attorney of Lisbon (PGDL), "the charges were deducted against the mother of the child, to have collected evidence, considered sufficient, that this was the disappearance of the child with a view to selling it to third parties so that they could adopt via illegal".
Daniel's mother was arrested by the judicial police to be interrogated two days after the child's disappearance, on suspicion of involvement in the disappearance of his son. Six months later he returned to be stopped and the 23 June 2014, after being heard by judge of Criminal Instruction of Funchal, was subject to term of identity and residence. The prosecution contends that the defendant "came up with a plan to sell the boy to someone who" did not have and wanted to have a child, "perspetivando receive between" 30000 and EUR 125,000.
Argues that Lydia Freitas will have done-if invited to a lunch at the home of family members residing in the Strait of Calheta, whereas "the location and isolation, would be the perfect place" to promote the ' disappearance ' of Daniel. The prosecution argues that the child will have seen the mother outside the House and wanted to go to her, having the defendant "went through the window, picked up Daniel and delivered the child to the person of unidentified identity", noting that this "action it took more than five minutes" and later "simulated search Daniel". The child was found three days later, about 1,100 metres in the same family house, by levadeiros [professionals dealing with the maintenance of watercourses in the island], in the New, "in the middle of dry ferns", with the wet clothes, signs of hypothermia, hands with signs of exposure to the cold and wrinkled feet due to humidity.
The fact that the defendant be remanded to the silence in the audience of trial, the Court began hearing the first seven witnesses, starting with the inspectors of the judicial police (PJ) involved in the investigation, the Commander of the volunteer firefighters of Calheta, John Joy, and Daniel's father, by videoconference, who is remanded in custody, suspected for committing the crime of statutory rape. One of the inspectors of the PJ said in court that the involvement of the accused "was a chance placed on the day of the disappearance of the child, emphasizing" surprised "the fact that Lydia Freitas" be too calm, "" not seem distressed "or" suffering "mother nature with a child in this situation.

Also the father of Daniel, who decided to testify, said that after the detetarem disappearance, the former "was calm", "wasn't worried" and "had no mood to talk about it". Considered that Lydia Freitas was "a little disappointed" when they received the call informing that the child had been found and said: "that's a lie, it can't be". Carlos Abreu Shah admitted he suspected the involvement of the former because, among other aspects, this also refused to integrate the group that organized to find the boy and told him not to worry because "where he [Daniel] is, is right" and that "whoever took him will certainly take care of him".

Mother of baby Daniel accused of trying to kidnap and sell her son

It was about 9:10 am when the mother of the little Daniel, Lídia Freitas, arrived at the Central Instance of the District of Madeira for the first session of the Judgment, and refused to speak to the journalists. The silence of the mother at the entrance to the court may be an indication of her posture throughout the session.

Lídia Freitas is awaiting trial while on bail and was accompanied by her current companion after leaving behind Carlos Abreu, the father of the baby which mysteriously disappeared on January 19, 2014, and found three days later in a nearby drainage channel. It was Carlos Abreu who reported that the former companion had orchestrated his kidnapping to sell him to a family, being a key witness in this process.

The trial which has its first session today will be chaired by Judge Carla Meneses. There is already a new session scheduled for a week from now, next Thursday.

By trafficking in persons, Lídia Freitas faces a sentence of up to 12 years in prison

Its Correia's back yard but is he still licenced to practise law following his escapades in court in Faro and after previously being suspended by the Madeira Lawyers Association?  She is bloody lucky not to be facing a murder charge imo since the little boy could well have died from exposure.

It was a tongue-in-cheek remark about the lawyer - I've no idea if he is still practising but his name doesn't appear on any recent lists.
You seem to have declared her guilty already. Why would someone abandon a child they were intending to purchase?

I came across the following report from a few weeks back.

Lídia's intention allegedly was to sell her son to another family

MIGUEL FERNANDES LUIS / WOOD
23 NOV 2016

Lídia Freitas is accused of trafficking in persons and faces a sentence of up to 12 years in prison.

The beginning of the trial of Lídia Freitas, the mother of the 18-month-old boy who early in 2014 had been missing for three days in Calheta Strait, was scheduled for January 19, at the Central Instance of the Comarca da Madeira (Building 2000). The woman is accused of the crime of trafficking in persons and risks a penalty that could reach 12 years in prison.

Lídia Freitas is the only defendant in a lawsuit that even had other suspects in the investigation phase but about whom the Judiciary Police could not gather sufficient evidence for an indictment.

It is recalled that the child disappeared from his godparents' house, located in Lombo dos Reis, during a family gathering on January 19, 2014. Despite intense searches in the subsequent hours, Daniel was only found three days later by a group Of levadeiros, in a zone of bush relatively close to the house of the padrinhos. He was in good health, although he had some signs of hypothermia.

It was not long before the Judicial Police questioned the boy's parents. At that time, the couple did not reveal everything they knew, but eight months later, in August, the couple disagreed over problems of infidelity and the father, Carlos Abreu, denounced the mother. Lídia Freitas was detained and was accused of practicing a crime of trafficking in persons. She allegedly simulated the kidnapping of her son with the intention of selling him. The investigators failed to gather enough information to locate the family that was to receive the child, although they questioned several suspects.

After the accusation of the mother, who left the family home, Daniel and his sister were left in the care of their father, who was given social housing.

However, already in August this year, Daniel's father was arrested by the Judiciary Police, suspected of committing a crime of rape of a minor. Carlos Abreu was denounced by a 17-year-old girl, pointing to him as alleged perpetrator of a crime committed on May 2 next to the pool at the Calheta school, where he worked under a program of the Employment Institute.

Asked for the acquittal of Lídia Freitas, mother of little Daniel
This morning there was a hearing of the last witnesses and final allegations in the case where the defendant is responsible for the crime of trafficking in persons. It was also marked the reading of the sentence for February 16, at 2:00 p.m.
MIGUEL FERNANDES LUÍS / MADEIRA / 19 JAN 2017 / 12:45 H.

The trial of Lídia Freitas, in response to the crime of trafficking in persons, including the alleged abduction of her son Daniel, continued in Funchal today.

This morning there was hearing of the last witnesses and final allegations. It was also marked the reading of the sentence for February 16, at 2:00 p.m.

After hearing the last witnesses, especially all the people who were in the house where the child disappeared, the statements were to point out a passive reaction on the part of the mother, admitted that they suspected something, but none accused Lídia of disappearance and indirect abduction By Daniel.

In the closing arguments Gilberto Gonçalves, defense lawyer, requested the acquittal of Lídia Freitas, arguing that "the version that she created a plan for the disappearance of the son does not make any sense" and also there was no evidence in the trial that the defendant Wanted to sell the son for 125 thousand euros as it appeared in the accusation.

The prosecutor Paulo Oliveira, MP, did not make final allegations.

Madeira: Daniel's mother, missing boy, acquitted

Court has failed to prove the crimes of kidnapping and trafficking in persons. Lídia Freitas was accused of staging the disappearance of her son for the power sells
2017-02-16 14:32

The mother of Daniel, the boy from Madeira who was missing for three days in 2014, was acquitted on Thursday of crimes of kidnapping and trafficking.

The Court of the Central District Court of Madeira was not able to prove the crimes that Lídia Freitas was accused after being suspected of staging the disappearance of her son to be able to sell.

Daniel was found three days later very close to where he had disappeared, in Calheta, safe and sound.
The group presided over by Judge Carla Menezes considered that "no evidence allows to conclude that the events [related to the disappearance of the child] succeeded in the way described in the indictment."

"In the absence of full proof" of the boy's mother's involvement in the disappearance of his son, "the court has no other choice" and decided, "using the legal principle of 'dubious pro reo', acquit" the defendant, the judge said.

The events date back to January 19, 2014, the day Daniel, then 17 months old, was reported missing during a luncheon with his mother's relatives.

The indictment alleges that "sufficient evidence was gathered that it was responsible for the disappearance of the child, with a view to selling it to third parties so that they could adopt it illegally."

According to the prosecution, the woman "generated a plan to sell" the boy to someone who "did not have and wanted to have a child," looking to receive between "30 thousand and 125 thousand euros."
Lídia Freitas has managed to get invited to lunch at the home of relatives living in the Strait of Calheta, considering that due to "the location and isolation, it would be the perfect place" for the 'disappearance' of Daniel.

The child was found three days later, about 1,100 meters from the same house as relatives, by healers (professionals who care for the maintenance of water courses in the island's mountains), in Levada do Nova, in the midst of dry plants.

He had wet clothing, signs of hypothermia, hands with signs of exposure to cold, and feet wrinkled due to moisture.

Daniel's mother was detained on June 23, 2014 and, after being heard by the criminal investigating judge of Funchal, she was subject to a term of identity and residence.

In court, witnesses, including the Inspectors of the Judiciary Police, family members of the defendant and the boy's former partner and father (currently on probation under another case involving suspected child rape) Accused "strange and calm" when the child disappeared.
In the video conference testimony, the boy's father, Carlos Abreu Sousa, said that Lídia Freitas was "a little disappointed" when they received the call informing that the child had been found and said: "It's a lie, it can not be."

Carlos Abreu Sousa admitted to having suspected the former partner's involvement because, among other things, she also refused to join the group that organized the searches.

The trial began on January 12, and the defendant, Lídia Freitas, refused to file a statement in court, which today handed down the sentence, acquittal.

========================================================================

Good news for Lidia & imo the correct decision was reached.
