The Remit of SY
« on: November 11, 2022, 08:09:41 AM »
There's been a lot of criticism of SY re their remit.. But... From what I can see SY have no power to investigate the McCanns as the crime was committed abroad.

The Istanbul Convention and the govt website covering extra territorial jurisdiction. It does blow a hole through the critics of the remit.. SY had no choice

There was a time when everyone believed that only Portugal could deal with this.  That has proved to be untrue.  But no English suspect has ever been in the frame so England has never had any jurisdiction.

This is not necessary.  You prove otherwise.

It isn't a problem.. I actually thought gunit was familiar with extra territorial jurisdiction ..I was... but perhaps she isn't.?
It limits what SY can investigate when a crime is committed overseas by someone who is normally resident in the UK.
So unless SY suspect Maddie was murdered or sexually abused by her parents SY have no power to investigate them.

For most offences, police forces have no authority or jurisdiction to investigate an offence committed abroad, unless they have a legal request in place from a foreign state, such as a European Investigation Order or a Request for Mutual Legal Assistance.

Thank you!

If your first quote applies the UK police wouldn't be investigating Madeleine's disappearance at all.

I can't see anything of relevance in your second quote.

British Passport Holders Abroad are entitled to help and protection.  That should cover it.

My first quote is absolutely right. Let me educate you.
SY cannot investigate Maddies disappearance themselves.. They have to go through the PJ. They can only investigate a UK suspect with the cooperation of the PJ unless its a case of an investigation into an offence covered by the Istanbul Convention.. So unless they suspect the mccanns of murder or sexual abuse they cannot investigate them

I think OG can investigate UK citizens, they only need Portuguese cooperation if they want to investigate their citizens.

Then you think wrong.. I know they can only investigate crimes designated by the Istanbul Convention... They have no jurisdiction to investigate anything else.. Its all explained in the links I've provided.
Do you remember when Bennett tried to bring a private prosecution for neglect.. Do you remember what the court said.. I do
