In early 2011 the CCRC provisionally rejected Bamber's application for a 3rd referral of his case to the Court Of Appeal. The decision was published in an 89 page statement by the CCRC however Bamber was given leave to appeal against this decision and introduce further forensic reports.
After 3 extensions of the appeal period Bamber's lawyer Simon MsKay finally submiited futher forensic reports on 31st January this year. We now await the CCRC's final decision on whether Bamber's case will be forwarded to the CCRC or dismissed.
Most independent observers believe that if Bamber fails in this appeal he is condemned to serving out his whole life tarrif.

The CCRC will be delivering their decision in the Jeremy Bamber case next month according to Simon McKay who posted this information earlier this evening on Twitter.
Lets ensure the Commission is made aware of the illegal activities of the Bamber supporters.

It looks like we will have a decision pretty soon from the CCRC. I would expect that McKay will have been told when to expect it and he will have in turn relayed the news to Bamber yestarday while visiting the prison. Ann and David would also have been advised of when the CCRC would be making their final determination. My view is that the Commission will make a referral on the basis that erroneous information was placed before the court in 1986 and let the appeal court deal with it. I then can see them rule that the rest of the evidence is of sufficient substance and quality to maintain the conviction and that will be that. David Boutflour will then get his closure after nearly 27 years.

Personally I don't think the CCRC will refer Bamber to the CoA again. Remember they have already rejected Bamber is a 89 page statement .... that's 89 pages of why they are so confident Bamber's conviction is safe they don't require anything new to be tested before the CoA.
If all Mckay can come up with is the Rifle in the Aga Saga then I think there is little hope for Bamber ..... I am sure the CCRC can spot chancers as easily as we have!

Nevill Bamber never telephoned anyone that morning because he was shot initially in the bedroom and on the stairs as evidenced by the number of empty shell casings found there. If you add up the number of casings attributed to June and Sheila and deduct that total from the number of actual casings found in the master bedroom and on the stairs you are left with the number of shots which Nevill took before he managed to get downstairs before being assaulted again. The fact of the matter is that Nevill was bleeding profusely from the moment he left the bedroom as again evidenced by the blood found on the carpets and on the wallpaper on the stairs which he staggered down. Nevill was in no fit state to telephone anyone and having taken a shot to his face and jaw would have been unable to speak properly in any event. Do also note that no blood was found either on the phone or on the floor beside it. Also note what Jeremy said his father purported to have said during that call. No mention of shots having been fired or that he was shot or dying?? IMO Bamber most certainly made the whole thing up and what's more, the evidence proves it!

I am new to this and found this forum on your twitter page. I remember this case from many years ago and always felt there was something just not right. I have read some of the evidence which you have provided and I must admit it is extremely compelling. Certainly when you look and see that there is virtually nothing which supports a claim of him being innocent. It must have been awful for the remaining family and miss mugford to come to terms with such a dreadful deed.

Mind you it will give Bamber plenty of time to reflect on whether he should have pleaded guilty in the first place.

I think he should dump that upstart Tesko and come clean. After all we know he did it so why prolong his agony any longer, he will be the better of it in the long run and I would even support clemency after an appropriate period of time.
Adrian Prout and many others did the right thing in the end so there is hope if only to remove that slur and stain against poor Sheila.

The CCRC have notified the families that they will not be making any decision before 23 April 2012. They add that they will be informing Bamber and his lawyer first.

I have been amazed at the number of legal professionals who have contacted me to enquire about this latest application to the CCRC. Many of them saying that they are gobsmacked that this fiasco is being allowed to carry on some 26 years after the murders.

I can understand where they are coming from. This open ended system we have at the moment is wide open to abuse by killers like Bamber. Had he behaved himself and admitted his crimes he would be looking at the possibility of parole by now but that has been knocked on the head by his association with Tesko.

Bamber will need something remarkable to get anywhere near the CCRC again after the rejection we are expecting but I agree it's ridiculous that Bamber has been appealing non stop for 26 years now!
I am not sure why you say if Bamber had admitted his crimes he would be looking at parole now? His sentence was increased to a whole life tarrif in 1994, just 7 years into his minimum 25 years; perhaps you think Michael Howard wouldn't have increased the tarrif to whole life if Bamber had admitted his crimes?
I also think you give Tesko way too much credit. He hasn't helped or damaged Bamber at all in my opinion as he is way too insignificant to matter in the slightest. No one takes him seriously, least of all Jeremy Bamber!
The mad spinister Jackie Preece has been far more effectual in Bamber's cause. She found him Simon McKay and his sidekick Nelly 1006 and has been instrumental in getting the ITV documentary produced. Although I would say the programme did Bamber no favours, it did reraise his profile in the public's awareness. What's Tesko done for Bamber other than totally embarrase him at every turn?
The perverse thing is that Preece may have sealed Bamber's fate for good. By raising Bamber's profile with the TV show and McKay on radio, Twitter etc. a CCRC rejection will be all the more emphatic if/when it comes. No one is going to want to hear more 'new evidence' sagas again in 5 or 10 years time!
If the final rejection does come,we should all thank Jackie Preece for all her invaluable work ..... on behalf of the relatives, Essex Police and justice!

They would have to have something pretty substantial for the case to be submitted to the appeal court the way I see it and there just isn't anything that fits the bill. IMO I cannot see some tests conducted in dubious circumstances some thousands of miles away in Arizona providing anything to this case except sensationalism. Next week will be a nail biting time though especially for Jeremy Bamber and his hangers on.

It is worth pointing out that had Bamber never met Tesko we would not be having this debate today and Jeremy would be another forgotten murderer rotting away in a Cat A prison.

I think you're giving Tesco way too much 'credit' there Mark ... Bamber would be screaming his innocence without Tesco and would probably be in exactly the same position as he is now! No actual legal work has been done by Tesco and he has been totally ignored by the Bamber Campaign Team for years now!
Not one of Tesco crackpot vile theories is included in the current submission as far as I know. Bamber's official web site even goes as far as to state they do not believe the police shot Sheila as Tesco always spouts!
Tesco is of no relevance whatsoever imho!

I do hope for the right decision, whatever that is. Obviously I hope there is no referral based on my opinion that the conviction is safe, with the obvious caveat that my opinion is based on the knowledge I have of the case. I stand to be corrected, just in case the submission contains stuff that we don't know about that really does render the conviction unsafe, but I think this is unlikely given what the defence has said about the basis of appeal so far. The trouble is, we don't know. If there is a referral with a series of grounds, I believe that the court of appeal can only go so far in considering whether this, that or the next thing would have changed the decision of jurors. However, the option of a retrial is going to be impossible after all this time. These kind of issues are what make this case so interesting (for intelligent people anyway rather than loons at TT!!) - although I wish this wasn't at the expense of the the family.
Even if JB is kicked into the long grass this week, he has nothing to lose and will go on, with no shortage of willing volunteers ?8)@)-)

I think we have seen the new grounds of appeal .... if Nelly is honest (I suspect he is!) the grounds suggest the rifle muzzle was 'cooked' in the Aga to get to the necessary 200 degrees to make the marks on Neville's back. The Aga Saga that they say proves the silencer was never on the rifle.
The other rifle/silencer related 'evidence' was contained in the ITV documentary. The fact they were working from photos makes this kind of evidence very tenuous in my opinion; courts prefer witness/expert statements/testimony to photos. I doubt they can use this as evidence the pathologist was wrong in his examinations!
The other ground according to NGB is that Mugford was in fact arrested by the police and she did not come forward voluntarily! This leads to another spiders web of police conspiracy and if McKay can prove that I will eat one of my dogs!
My understanding of that is they must be saying that Mugford was forced by the police to lie against Bamber under threat of being tried as a party to the murders if she refused! That new theory is way past Machiavellian and approaching Teskovellian in its utter absurdity .... in my humble opinion!
If what NGB has said is the truth regarding the new grounds for appeal, I think Bamber has two hopes ... Bob Hope and no hope .... and Bob's dead!

I think we have seen the new grounds of appeal .... if Nelly is honest (I suspect he is!) the grounds suggest the rifle muzzle was 'cooked' in the Aga to get to the necessary 200 degrees to make the marks on Neville's back. The Aga Saga that they say proves the silencer was never on the rifle.
The other rifle/silencer related 'evidence' was contained in the ITV documentary. The fact they were working from photos makes this kind of evidence very tenuous in my opinion; courts prefer witness/expert statements/testimony to photos. I doubt they can use this as evidence the pathologist was wrong in his examinations!
The other ground according to NGB is that Mugford was in fact arrested by the police and she did not come forward voluntarily! This leads to another spiders web of police conspiracy and if McKay can prove that I will eat one of my dogs!
My understanding of that is they must be saying that Mugford was forced by the police to lie against Bamber under threat of being tried as a party to the murders if she refused! That new theory is way past Machiavellian and approaching Teskovellian in its utter absurdity .... in my humble opinion!

Just catching up some. I agree with what you post Tim. The idea that the police invented a story and then forced Mugford to lie and toe the line is just preposterous. If that is what they are saying over at cloud cuckoo land then I am afraid they have been watching too much fictional television drama from the USA. The vast majority of police officers are decent respectable honest individuals and would never tolerate such goings on. Roughing up the odd s..m-bag lout is one thing but a conspiracy to pervert the course of justice involving just about the entire Essex force is something else. I am afraid the reality is that such things just don't occur to that extent in the UK.

I don't think 'misappropriation' is exactly the right word because it implies fraud or dishonesty. It is fair to say that his client account was 'improperly operated', especially since that is actually how the Solicitor's Disciplinary Tribunal descibed it in their decision to reprimand him and order him to pay £5k costs.

it is stated at paragraph 9 on page 8:

A quick check of the insolvency register reveals that he did indeed enter into an IVA in September, and again in May 2011.
In short, he's skint, and whoever it was who branded him Simon McChancer (Tim?) was spot on.

Simon Mckay is actually insolvent as stated by High Court Judge Keyser last December in a court case he brought against a USA finance company .... which he lost!
The judges words and yes the claimant in question is Simon Arthur Samuel McKay!
The claimant was insolvent, was clearly unable to obtain finance from mainstream UK lenders and was branching out into an unfamiliar area of business.
It would appear McKay had a huge money making scheme but because he was insolvent he could not get UK finance. As in the Bamber case he had to go to the USA to get the answers he wanted; the USA company agreed the finance subject to Simon McKay obtaining reinsurance to protect their exposure!
Simon McKay promised the reinsurance BUT could not obtain it! Why? Obviously because McKay's scheme was frought with danger and they wanted nothing to do with it! He tried Lloyd's Of London insurers and got nowhere ... he tried obscure mickey mouse insurance companies with next to know capitalisation and still got nowhere!
McKay couldn't get reinsurance for his dodgy scheme because insurers are not mugs! As I an ex-director of a Lloyd's Of London broking house I can understand how they see a chancer coming at a 1000 yards! Especially an insolvent chancer like McKay!
McKay still had the nerve to take the finance company to court to get the money even without the required insurance! He lost!

Roachford has behaved very strangely since he lost his job at the foundry! He had worked there 35 years and only got 5 grand redundancy .... he has taken to drinking vodka with his Cheerios now and his wife has left him! She had an affair with Mr. Singh at the cornershop and now they have both eloped to Nepal where they live on the family's lama farm!
The sickening thing is he only bought his wife last year from Malaysia and he had to cash in his pension plan to buy her. I told him at the time he should have bought her sale or return but he wouldn't listen! He called her his Oopa Loompa from Kuala Lumpur .... she is only 4'2" but he loved her to bits! Very sad!
He has perked up a bit though since his coup d'etat take over as Nelly's new Baldrick .... the rumour is that Gladys is secretly furious at Roach's duplicity and is plotting a counter offensive in his potting shed! It could be a blood bath!

If the decision is being made publicly tomorrow then the parties involved will have heard today. IMO that isn't correct and the parties will be told tomorrow with a press release thing going out on Friday. If I could just jump in here, ngb has instructed the supporters to keep their heads down until the CCRC decision, which he considers will be a favourable one for them. We will see! Unfortunately, the strain has obviously been a bit much for Mr Rochford!
If the decision is being made publicly tomorrow then the parties involved will have heard today. IMO that isn't correct and the parties will be told tomorrow with a press release thing going out on Friday. If his lawyer had heard by now it would have filtered down to the foot soldiers or ants as i like to refer to them as. 8**8:/:

It must be hell for Jeremy Bamber waiting for a decision which will decide his fate for the next 10 plus or possibly more years. Imagine sitting in a cell for 26 years and then being refused any possibility of parole.
If he is refused he will probably go into the suicide cells again for a week.

My informer tells me that it will be Friday for an official announcement by the CCRC, it isn't such a big deal. Jeremy and McKay will be advised tomorrow along with the family.

It should be a fascinating weekend ..... the CCRC issued an 89 page rejection last year; I would be dumbfounded if so many pages of just why Bamber is gulty could be overturned by pig skin and burning a rifle in an Aga oven!
John can we get a copy of the 89 page judgement from last year and perhaps the new one due tomorrow from the CCRC .... obviously Bamber's team have them and understandably have kept them quiet. I would be surprised if the CCRC keep their judgements secret .... we should ask the CCRC for a copy?

Do you remember when he was going on about having a copy of the itemised phone bill from WHF around the time of the murders? Minor problem with this is that itemised billing didn't exist then. He was challenged to post it on the forum if he had it. Surprisingly he never has.

Tesko is past his sell by date and an embarrassment to Jeremy Bamber. Any credibility which Tesko once had is long gone and he knows it. I am not surprised he resorts to fiction to try to make a case. His problem is that he cannot get past the spoofs that Bamber sold him while in prison. Tesko will find it hard to accept that he has been lied to by Bamber and has spent two decades on a lost cause.

It is confidential to the applicant and the applicant’s nominated representative. If the case is referred to an appeal court, the Statement of Reasons is also sent to the court and to the prosecuting authority which has to decide whether to contest that appeal. In either situation, the Commission cannot make a Statement of Reason public. The applicant and their representatives are free to do what they choose with it.

I doubt it somehow! Having read Simon's SOR it will be a detailed dissection of each submission and their opinion the validity of each one. I don't think they're going to want that publicised.
