I'm surprised no-one minds this man making money by printing unsubstantiated stories about a missing child's poor parents.
Are they harming the search for the child?  Are the poor parents damaged by the article?  Nick Pisa is a journalist, it’s his profession, of course he’s going to get paid, as is every journo who writes about the case for a paper.

If there is any solace to be had from the story it's masking the inability of SY to find any alleged abductors  being highlighted.

A false report is a false report. Whether it's favourable or unfavourable shouldn't be relevant.

How is this article “press intrusion “?  How is it proven to be false?   Certainly the “poisonous liar” bit would appear to be bang on the money but if you’re so concerned about it you can write to the press complaints commission or whatever they’re called these days, in fact why not rally together some support for it and get lots of people complaining?

I don't know whether it's a false report or not, but I wouldn't take a bet on its accuracy. If he has seen the application, it would have been helpful to provide information as to how the court ruling contravened articles in the Convention.

However unfair I personally find the outcome of the PT court, justice isn't always fair. I'm still curious as to the legal aspects submitted in the ECtHR application.

If the ECHR find against the McCanns, will you consider that unfair as well ?

I'm doing my best to separate my own feelings of fairness from the legal aspects.

I don't find it fair that he has gained a fortune based on a) insisting that Madeleine died that night and b) that  the parents were involved in criminal activities surrounding her, as yet unproven, death. He most certainly wouldn't have been acquitted in a UK court, but Portuguese law is... different.

The current question, AFAIK, is in what way(s) the State of Portugal violated their rights as per legislation in the ECHR.

Without knowing the legal basis for the application, let alone how the Court may rule, I can't answer your question, Jassi.

I never said it was press intrusion. It is false on several details which I have previously pointed out. The body you are attempting to refer to is IPSO.

I also have tried to separate my feelings from the legal aspects, and it isn't actually all that difficult once you accept that Portugal has a different attitude.

I certainly now know more about Portuguese Law than I ever wanted to.  And while I often don't agree, my thought on that subject are irrelevant.

I admire your honesty Carana. Personal feelings of fairness are immaterial in a court of law.

There has already been a ruling on calling Amaral a liar;

UK DAILY EXPRESS PUBLISHES WRITTEN APOLOGY OVER HEADLINE CALLING MADDIE COP A LIAR

“On the 29th April 2015 we published a headline on the front page which said “Maddy detective did lie about death cover-up claim”. We would like to make it clear that there was no determination by the Portuguese court that Mr Amaral lied. In fact the court ruled that Mr Amaral had breached the McCann’s right to reputation and ordered him to pay damages to them”.
