Why didn't the Franklands notice a different smell that day if the parka was being burned?
No mention of this was there? Just the usual 'pleasant' smell wafting in the kitchen window!
Did Findlay point this out? I didn't notice!
Why weren't the Franklands made to witness a parka being burned and asked if that was the smell they witnessed on the day of the murder? Was this done?
No unusual smell=no parka or other items being burned on the day of the murder surely?
Isn't that basic common sense?
The Franklands seemed to be used to a particular pleasant aroma! Used to it!! They would have known if something unusual was being burned!
Hence, no parka nor other items were burned in the Mitchells garden on the day of the murder!
No brainer!

Different folks have different senses, reactions and recollections to things. While the whole back garden fire aspect of this case is not as compelling or as damning as the other strands of circumstantial evidence that were used to convict LM, it is still noteworthy that a neighbour noticed a strange smell on the night of the murder -- particularly as it was not out of the ordinary for people in that street, not least CM (as per the Franklands' testimonies), to use their log burners in the dry/summer months. Another coincidence amongst many other coincidences? I don't think so. Save all that for the birds!

The reference to the "pleasant" smell appears to be in respect of fires that had maybe taken place in the woodland to the front of the houses. I'll read it again when have more time. Mrs F didn't do anything about those if had noticed them, wood smoke etc. Not "thick" smoke.
 
I see what you mean with the two transcripts merged together Mr A, I wonder if that is the couple who could not ID LM, stating it wasn't him, I don't think theirs have been put up yet?

Agaiin, why didn't the police burn a parka with all the witnesses present?
Anyhow, it seems strange that the Franklands didn't notice such a funny overpowering smell, they seemed to think it was the normal pleasant smell that they were accustomed to!
I presume they meant the pampas grass that Corinne said she may have been burning that day!

Not really, I burned mine annually in-situ, not in a brick barbie/wood-burner.  That is until I learned pampas in your garden was the sign of a household used as a regular venue for orgies, so had to dig it up and get rid... didn't want to give neighbours the wrong impression!  But when bone-dry it does make good kindling to start off other items such as...... blood-stained parkas?

I have been googling pampas grass today Myster, mainly to see if it has a distinctive pleasant smell when burned!
Can you help at all?

Well it seems that the Mitchells log burner was used regularly in the summer, Vertigo!
Whether ten o'clock was an unusual time to use the burner, I do not know!
But remember, that is when the Franklands noticed the smell, the fire may have been started much earlier?
The wind can change direction of the smoke too I would imagine?
Not sure if Mr Ramage's trial testimony has been transcribed yet, it may shed some more light on the log burner issue!
One things for sure, no remnants of clothing were recovered from the burner, although guilters will say there was plenty of time to get rid of any evidence and clean the burner!
As ever with the LM case, its all speculation and circumstantial, no direct tangible evidence whatsoever!

Denial of having a fire is what took place from the mother. When faced with evidence from different neighbours who's gardens connected in different ways, still denial. But 'if' there had have been a fire then it may have been pampas grass was pretty much the end result? Fire taken place at different intervals inclusive of after heavy rainfall. Therefore not simply, yes I had a fire which may have been burning pampas grass.

Which brings us back to intent. He didn't just randomly, wildly attack, without need to handle that knife differently. Clearly a purpose to his intended disfigurement of certain areas.
