David went to see Kate to find out if she intended to bring the children to the play area, according to Gerry;

Regarding the episode where he spoke to David on the 3rd of May, he says that he was playing tennis at 18:30 when David appeared near the tennis court and asked him if he was going to continue playing. G. said he didn't know because Kate might be needing help to look after the three children, because they intended to bring them to the recreation area after their showers. He thinks that David offered to check if Kate needed help, which he did, and returned minutes later.

Kate was under the impression that was the reason for David's visit;

David's visit was to help her to take the children to the recreation area. When David returned from the beach he was with Gerry at the tennis courts, and it was Gerry who asked him to help Kate with taking the children to the recreation area, which had been arranged but did not take place.

She confirms in her book that taking the children to the play area was a possibility when Gerry left the apartment;

We decided we’d bath the children early, especially as they were all tired, and then I might take them down to the play area in their pyjamas for a little while, if they weren’t quite ready for their beds.....The others had met up with Gerry at the tennis courts and he’d mentioned we were thinking of bringing the kids to the play area. Dave
had nipped up to see if he could give me a hand taking them down.

So Gerry and Kate are quite clear about the purpose of David's visit. He, however, is his usual vague self;

I went over to see err Gerry at the err you know tennis courts, just to see you know what was happening, and err decided that we'd, you know I'd come, come back to play tennis and err Gerry had asked me just to pop in and check everything was alright err with Kate or you know again I can't remember the exact reason whether he was just making sure it was alright that he could stay there and you know more time but you know he'd asked me to pop in.

David told Fiona all about it;

he was saying how angelic they all looked and he said to Kate when we all sat down at the Tapas table as well and he was sort of joking how they looked like perfect children, because they were all sat there, all clean in their pyjamas, having a story'.

It could be how we read it, you read it differently to how we do.  There is also "changing your mind", he might have played tennis. Kate may have said something earlier but she may have changed her mind later.

David Payne popped in to see if Kate was ok as Gerry was playing tennis,  he then went to change for a game of tennis.

Ok I stand corrected,  David Payne went back to tell Gerry that Kate was ok then went to get changed for tennis.  That doesn't mean that Gerry asked David Payne to take the children to the recreation centre though does it?  Just that Gerry asked if she needed help,  meaning did she want Gerry to go back to the apartment.

It contradicts her statement when they had already decided not to bring the kids out before Gerry left the tennis for at 6. So then D.P. goes  to take them out. That doesn't add up and more importantly it's a routine change on the day she disappeared!

6:30 to 7 was normal kids bath time but they said they had bath time earlier that night before Gerry left at 6  &%+((£

I wouldn't read anything into the fact that they were getting ready for bed earlier than usual,  Madeleine was shattered by the sound of it and Gerry wanted to play a game of tennis,   they were going home soon and he probably wanted to make the most of the time he had left.

I think there has been confusion with translation.

Did David Payne actually say he had come round to take them out?     It is more likely that Gerry just asked him to pop in to see if Kate needed help with the children,   he probably felt guilty about playing tennis.

Anyway,  David Payne popped back to tell Gerry Kate was fine,  then went to get changed for tennis,  so what is the big deal about all this?

Once again we are relying on a third party report here ... and also a translation

There is always room for errors in both sorts of report.  So double possibility here.

How much better to have a verbatim statement, then we know that the words came directly from the statement maker.
