The McCanns weren't made arguidos as a result of TdeA's 'inspired' report - he didn't write it (or at least sign it, whoever actually wrote it) until 10 Sept.

Any enforcement would be done at the behest of the Portuguese judiciary, as it they who would be out of pocket.
At that stage, it probably wouldn't matter what the case was about, only that money was owed.
Chance of success? - no idea.

the judgement has to be enforced by a UK court...if it was just a rubber stamp there  would be no need for the court to be involved,,,the defendant has  a right to challenge the order...chance of success...who knows...

Amaral has been threatening to sue for years and he hasn't

The right to free speech was not established to allow the defamation of innocent people...amaral is abusing his "right" to free speech and the courts are supporting him...imo... I think the ECHR would take a very different view

the truth is amaral said this IS what happened...this is the TRUTH and the mccanns lied...whatever the law is in portugal this in breach of European law  which also governs portugal...it will be very interesting to see how this develops.

Any action against the McCanns by amaral awarded in a portuguese court court would have to be enforced against assets in the UK by a UK court...the McCanns could challenge this ...would a UK court support the abuse by amaral.....I very much doubt it

The couple said it was never about the money, which they would have used to continue the hunt for Maddie, but the damage it has had on the nine-year worldwide search and the crushing impact on 11-year-old twins Sean and Amelie.

Amaral, who won the major legal victory on Tuesday, now intends to sue the McCanns for libel.

In a new posting on the official Find Maddie website, heart doctor Gerry, 47, and ex-GP Kate, 48, state: “We are disappointed with today’s ruling from the Portuguese Appellate Court. As we have said in the past, this action has never been about money.

“It has always been focused on the effects of the libels on our other children and the damage that has been done to the search for Madeleine.”

The parents from Rothley, Leics., who face the agonising ninth anniversary of their daughter’s disappearance in less than two weeks, added: “We will continue to defend ourselves against this libel and the search for our daughter. We will be appealing to the Portuguese Supreme Court.

“Madeleine is still missing and we will do everything we can to get her home.”

The McCanns also took the time to thank their followers for their “continued support” in the update titled: “Statement from Gerry and Kate regarding libel case”.

Amaral, 57, was last year ordered to pay Kate and Gerry half a million euros in damages after he was ruled to have libelled them in his book The Truth of the Lie. But an appeal court in Lisbon overturned the ruling.

The former detective, who worked on the four-year-old's disappearance case in the opening days, claimed the McCanns "covered up Maddie's death by faking her disappearance".

He was taken off the case for criticising British police.

His book, which he made £286,000 from, is due back on the shelves in Portugal next week.

Their fund was down to its last £750,000 in October, with few new cash donations coming in. The Home Office this month stepped in to provide £95,000 to maintain it for six months.

I think the point being made throughout the judgement is that "Amaral's Thesis" for want of a better expression is that the child died accidentally and the parents covered it up. As that was a proposition put forward by the investigation team, was in the subsequently released archive documents and had been made in the press at the time arguido status was conferred then it had been in the public domain well before Amarals book was published and as such even as a retired policeman on the case he was entitled to discuss it and write about it.
The judgment as far as I can see imposes no stricture by way of "he can only say what is in the files".

So your summary is that Amaral was given licence to re-cycle tittle-tattle?
