Is it possible, do you think, that a state prosecutor could exaggerate the strength of 'evidence' for any reason?

From whence do The Prosecutors get their information?  They certainly won't be out there collecting it themselves.  So stop procrastinating and tell us how the system works.  If you can.

If the prosecutors think a crime has been committed they ask the police to investigate. They then decide whether there is enough evidence to charge.

For the public prosecutor’s office to bring an indictment under Section 170 (1) StPO, there must be sufficient suspicion of an offence against the accused. This is given if there is an overwhelming probability that the accused will be convicted after a preliminary assessment of the evidence situation.

Despite Wolter's claims, it seems there isn't an overwhelming probabilty that Brueckner will be convicted.
