2) The investigation was incomplete because of the refusal of the group to co-operate in the reconstruction.

Wrong!

All points the (envisaged) reconstruction were intended to clarify were clarified by subsequent developments, such as analysis of telephone communications and corroboration of witness statements.

The reconstruction became and remains irrelevant.

Analysis of telephone records ?

The mobile phone companies refused to  pass on the text messages to the PJ.

No.  The Mobile Phone did not refuse to pass on text messages.  A Portuguese Judge ruled them inadmissible.

I stand corrected.

But why inadmissible ?

They would have been relevant to this investigation.

The Judge, who must have read them, deemed that they were inadmissible.  Probably due to being irrelevant.

The refusal or perceived refusal of most of the tapas-9 group to partake in any cooperation with the Portuguese Police including a reconstruction is very relevant don't you think?

Does the fact that the McCanns choose to return to PdL one at a time have some relevance?

Well it did strike me as strange but then I began to see a pattern.   Quite clearly and given what happened to them they are obviously wary of returning together in case they are taken in for questioning again or worse.

Given that the case is unresolved, anything is possible I suppose.

Oh, did I misinterpret both of The McCanns at The Trial in Lisbon for the banning of The Book?  I could have sworn that they were both there, right outside The Court.

Lisbon is a long way from PdL by all accounts.

The instruction judge Pedro Frias not having allowed the MP to read Mr McCann's 18 sms, the MP made an appeal, which was rejected by the Evora tribunal on the 28th of May 2008. I.e nobody read the messages. The unique odd point is that Mr McCann pretended he never got those sms.

The AG report says this about messages between the 2nd -4th May

concerning the days between the 2nd and the 4th of May (calls that were operated exclusively by the fixed network are not contemplated, because as they do not use the GSM system of mobile communications, those do not activate the antennas ("B.T.S.").

Oh, I see.  Only The Algarve PJ can arrest them.  But since Portimao seems to have been a little Dictatorship all of it's own, then I suppose this is possible.

If you care to read back a few posts Eleanor you will see that the reference to them not returning together was made to Praia da Luz and not Lisbon or anywhere else in Portugal. It is the Portimao police who have the case on their books yet marked unresolved.

I hadn't thought about this before but taken in context with the refusal to participate in anything official which in any way resembles a reconstruction then I am not in the least surprised.

As I posted on another board their reluctance to do any searching in Portugal is overshadowed by the heroic efforts of the Fitzpatrick and Needham familys who despite significant financial disadvantage have searched tirelessly in Spain and Kos respectively.  If anyone deserves to find their missing loved one it is them.

They are found not guilty of the charges brought against the suspects. They are found innocent of the charges put before the court.

They are found, under law, innocent of those charges.

However If further charges are brought with more or new evidence or if there were found to be errors in the first trial then those are brought before the court and the system starts again.

DaveL, it's ok to Google stuff and copy and paste but at least have an understanding of what you are pasting first.

Are you making this up as you go along. I have provided a cite from a law dictionary for my post. What do you have to support your post... nothing..its absolute rubbish

Another one for Albertini....

Innocent V. Not Guilty

Jury Decision Based Entirely On Evidence
(Media's Declarations of Innocence Inaccurate)
By: Hugh Duvall

Juries never find defendants innocent. They cannot. Not only is it not their job, it is not within their power. They can only find them "not guilty."

As regards law, you really do not have a clue.
