The mccanns have delayed too.

When, exactly?

Unless you are referring to the postponement to see if an out of court settlement could be agreed?

Which is an obligation on all those engaged in civil litigation to keep court time to a minimum.  And whichever side initiates that request, it is plaintiffs who must request the stay for obvious reasons.

Who is going to apply for this Presumption of Death Certificate?  Goncalo Amaral?  Anthony Bennett?  I would seriously like to see them try.
One of them would be laughed out of court and the other one would wind up in prison.  I will leave you all to decide which is which.

Nor me.  It has been known for some time that something like this was going on.  Someone has been feeding Amaral false information about The Presumption of Death Act.

In this case only The McCanns  would be allowed to apply for this, and they ain't going to.

Would it even apply retrospectively? Very few laws do.

I don't think it's even been passed yet.  But Retrospective wouldn't alter the situation anyway.  You would have to have a very good reason for applying if you weren't family.  And i don't think Amaral's Libel Trial would count.

Mind you, I suppose he could try it on by trying to use the essence of seven years without a body being found.  But that won't wash.  Not even in Portugal.

I don't know, Stephen.  I wish I did.  But Amaral is making another pillock of himself by spouting off on Television about this.
According to him it is only five years in Portugal, but I have still to see any evidence that parents in Portugal can be forced to accept this on the say so of someone else.

But why is Amaral pursuing this if not to in part explain his stalling of The Libel Trial.  Mayhap his WoC ploy didn't work.

So how long will it take to convince you, that if no trace of Madeleine is found, despite the worldwide publicity, she  won't be found alive ?

A very long time, Stephen, if ever.  My stance is that if no body or evidence of a body is found then Madeleine could still be alive.

I don't know that either, Stephen.  Let's hope Scotland Yard find something.

But I have no doubt that The McCanns will go on searching, even if The Investigation ends.

Telll that to Ben Needham's mum - she's still hoping to find her son alive after over 20 years.

I just wish the UK government would re-open Ben's case.  But no doubt you would be against that because of the cost to the taxpayer?

And please don't try to claim there is no comparison between the two cases.

Ben disappeared in a foreign country.
He was unsupervised when he disappeared.
No evidence was found of an abduction.
We only have the family's word for what happened.
His family know he may be dead, but until they receive confirmation of that - they will continue to hope he is still alive.

The notion that innocence prevails over guilt – when there is no evidence to the contrary – is what separates civilization from barbarism.    Unfortunately, there are remains of barbarism among us.    Until very recently, it headed the PJ in Portimão. I hope he was the last one.

The McCanns were never called to attend at any time. They just showed up...So why the moaning about being inconvenienced?

similar situation would be: wedding crashers complaining they didn't get a chunk of cake- well they were not invited!

They asked to give an statement which may provide further evidence after  all other evidence has been heard, a change in the Law allows for this. The Judge allowed it- it is NOT the same as  a victim statement as it is here in the UK. I am lead to believe.

Just a small correction. The judge for the trial rejected the McCanns' request to make a statement. They then appealed and were allowed to do so. The judge will be allowed to question them and the other lawyers will also be able to ask for clarifications through the judge.
