Well done, JP. That seems to be the baseline. However, as you said, distinctions can be blurred.

A hypothetical example (based on an amalgamation of a few of the types of posts that I've seen online), what if someone, based (or pretending to be based) at the other end of the world, posting on a site hosted even further away, says something such as: "I dreamt last night that the McScamms were going to be waterboarded *innocent face* and that they revealed the truth about Margaret's murder #mccann".

And the post gets 200 "likes" or whatever the approval sign is, and umpteen RTs and favourites and leads to a rallying cry.

What are the legal implications?

- The attempt to disguise the names wouldn't be a defence in (UK) libel law, would it, if there is a reasonable assumption that people could guess who the parties are?

- What about the criminal side, including the international dimension?

I am not sure what crime would have been committed under that particular scenario - it would all be innuendo, really.  And the international dimenaion is one of the challenges to enforcement.  It would be necessary to have the cooperation of the "home" police force.

Tricky but not impossible.

I wonder if those people in the public eye who have dared to support the McCanns, and as a direct result have been deluged with messages of hate, will be included in this police investigation.

Quote from Antonella Lazzeri- describing her experience of being trolled.

''When my daughter was six she googled my name writes Sun journalist Antonella Lazzeri.  ''Why are people saying nasty things about you, Mummy? she said.

Luckily she was too young to understand what ''whore'' means, but she knew what the other words were, some of which were scrawled over doctored photos of me.

Since I started covering the Madeleine McCann story I have been ''trolled'' consistently in the most horrible, hideous way.

After one really vicious email, I'd had enough  and did the one thing experts say not to - I  replied.  ''Why do you do this? I'm a mother, my child reads this, it upsets her.  Why do you do this?'' I asked.

The woman immediately sent me a grovelling reply: ''I've had a bad day, I argued with my husband etc etc''

Really? does that give you the right to do what you do?
End quote

It would come as no surprise to me if the same people who conduct their hate campaign against the McCanns on Twitter and FB are the same people who troll anyone who publicly expresses support for the McCanns.  Lorraine Kelly for instance will no doubt have plenty of evidence for the police to use if necessary.

I sincerely hope that prosecutions will be the result of the police investigation.    If not then that will be giving the 'green light' to the perpetrators that they can carry on breaking the law with impunity - and the abuse will get even worse than it is now imo.  Who knows how far it will escalate - there are some seriously unhinged people out there imo.

The notion that innocence prevails over guilt – when there is no evidence to the contrary – is what separates civilization from barbarism.    Unfortunately, there are remains of barbarism among us.    Until very recently, it headed the PJ in Portimão. I hope he was the last one.

Has the police investigation only just started then?

I understood from material posted here that internet abuse of the McCanns was already being monitored over at least the past year.

If the offensive messages to the McCanns and their supporters are google-able, or on twitter and openly viewable surely the police already had the technical expertise to research, identify and prosecute "offenders" ?

I'll take a leaf out of your method of Tit for Tat posting Stephen and ask -  why is it McCann sceptics only look at one side?

This thread is about the 'Investigation into McCann Internet trolls launched by the police.'  My post relates to that.

If you want to discuss the content of my post - feel free.

According to you Mrs Leyland was not a troll - so why are you attempting to include her?  Are you now claiming she was a troll?

IMO Until the inquest is over - any discussion about this lady should be avoided if possible - out of respect for her family and because we can only speculate at this time.   In fact if I had my way - we would not be discussing her at all right now.

The notion that innocence prevails over guilt – when there is no evidence to the contrary – is what separates civilization from barbarism.    Unfortunately, there are remains of barbarism among us.    Until very recently, it headed the PJ in Portimão. I hope he was the last one.

I have already stated repeatedly, her tweets were unacceptable.

Your posts demonstrates very aptly the nature of one-dimensionality os some mccann supporters.

Thank you for that.

I.M.O. of course.

I  presume because their enquiries are still ongoing and they haven't yet been concluded.   Just goes to show the sheer enormity of the lawbreaking which has been taking place IMO.

Any police spokesman reports to that effect........ or concerning the launch?

I have no idea.   Does it matter when the investigations began?

If memory serves me well ... the dossier was handed to the police ... in person ... by a whistleblower who asked for anonymity ... for the simple reason she feared vilification, on-line attack, and for her personal safety.

Wonder what put those ideas into her head?

How can a person be a "whistleblower" when behaviour and material is already out in the open, already known to the police  and available to them via their own investigation personnel?

A very sensible post.

I think Stephen et al are attempting to defend the indefensible and they know it; there can be no justification for the attacks on the McCann family.

As the offence becomes more and more prevalent more people, many of whom have been directly affected by online stalking and bullying, are seeing firsthand the awful effects of trolling on the victim.

This is reflected in the growing number of prosecutions, usually affecting one troll/stalker and one victim none of whom have suffered for a period of over seven years.

The level and type of abuse that has been unleashed on the McCann family is unprecedented and has been allowed to go on for far too long; there is nothing which can justify that.

"All I'm going to say is that we've conducted a very serious investigation and there's no indication that Madeleine McCann's parents are connected to her disappearance. On the other hand, we have a lot of evidence pointing out that Christian killed her," Wolter told the "Friday at 9"....

No...........that`s not what I meant.

Is there an official statement from the police that an investigation has been launched at all in relation to the dossier they were handed?
