They can, and their supporters point this out endlessly. The problem arising is that SY seem to have reached that conclusion after reviewing the evidence gathered by the first investigation. If the Portuguese investigation wasn't able to 'clear' them based on that evidence how did SY manage it?

Perhaps they have found further evidence that enables them to say that the Mccanns are innocent.
We do not know.

Still wondering how the above in bold can be justified - in view of the following pronouncement also made by the SC,

Judges made it clear in their decision their job was not to decide whether the McCanns bore any criminal responsibility over their daughter’s disappearance and it would be wrong for anyone to draw any inferences about the couple’s guilt or innocence from their ruling.

So which one is it?  They can't have it both ways.

The Portuguese Supreme Court are not trying to have it both ways.
The SC found there was nothing stated in the Archiving Documents that cleared the McCanns. That is straight up and down easy to understand. The SC therefore have not said anything other than just that.
The SC stated that no one should draw inference from their[the SC] published finding in that respect. That is straight up and down easy to understand too.

The only difficulty that arises imo is when the SC Ruling has the effect of peeing on someone's bonfire.

I don't recall SY ever saying the McCanns are innocent?

Or indeed that they have ever found any evidence - of anything.

The difficulty with relying on any information gleamed from or offered by SY is that this is still a live enquiry and as such no police force will release anything which could undermine or compromise their investigations or prejudice any future prosecution.

Interesting thread.
One would hope Scotland Yard know more than they are letting on.  I find even in my own research into the case I am uncovering significant bits of evidence, I sure hope SY have been able to do the same.  Once that knowledge is found by SY they would go back to Kate and Gerry and hopefully get an explanation as to why those "errors" were promoted by them.  From that they will be able to say the "parents are not suspects", "we have a significant lead" and "we hope to solve the case".
I feel the case has been all but solved all except finding out if Madeleine is currently living under a new identity.

I believe Madeleine died on 3rd May 2007 and her body has been hidden in the surrounding countryside.  She might never be found or anyone brought to book and that is the sad reality of this case.

Oh G you must have been off the forum that day.. Yes there was a trial and everything and the McCanns were cleared of everything... totally innocent.

Ofcourse in the real world where real people mix and mingle there has never been a trial discussing the guilt or innocence of the McCanns, but I do recall the McCanns lawyer stating they were cleared and were innocent by someone else... 8(>(( 8(>((.

SY cannot declare anyone innnocent or guilty that is for a court to decide. They can say we are not investigating them in so ar as this particular line of enquiry is concerned. now lets look at that tey would be talking about.

1. would the parents be 'guilty' or innocent if og were looking at gypsie involvement
answer NO
2. would the parents be guilty or innocent if the OG were looking at abduction by stranger
answer No
3.  would the parents be guilty or innocent if the OG were looking at child trafficking by strangers
answer No
4. would  the parents be guilty or innocent if the OG were looking at paedophile gang of strangers
answer No

there you have it... These theories clears the parents but it tells nothing about what happend to Maddie. Which is what we want? or is this to clear the parents only? Jump and rejoyce.

oh but wait...

Now if they were to look at other theories then maybe...

From asking people about this case, many different responses but all said  similar,
1.parents got off light why are they still winging- if this happened here it would have been different.
2 why spend money on trying to absolve them and not find Maddie,
3 They hog the papers at every opportunity.
4 they have stopped talking about Maddie and keep on  about the coordinator...
5 they give that police man more air time than they do on their daughter
 many many more...

My belief is people are bored fed up with them and perhaps some feel ther behaviour is very strange.

The decision by the Portuguese Supreme Court to throw out the McCann's claim against Mr Amaral appears to have been the catalyst which has seen interest in the case slowly decline.  Not only did Portugal's highest court throw out the damages claim but they went to the trouble in their written judgement to question the interpretation of the Attorney General's original archiving report which some had claimed cleared the parents.

With the mystery yet unsolved and the police investigations about to close, has momentum in the case now wained as it has reached a 10-year low?

I think interest will and has generally waned after the 10th anniversary statement from SY,it told a lot but nothing new,Hogan Howe said last April that they were on the last lead,Rowley told us this year they are on the last lead,it can't go on forever imo.

It is a sad reality but life goes on and people move on to other things and other priorities.  For the parents of any missing child though the failure to have closure must come at a dreadful cost.

Me too.

I have reasons to believe that the case is all but solved, but whether they know where Madeleine is currently living under a new identity is another matter.

i am looking for something to happen in the next few months if they can find enough evidence to charge someone.
Hopefully they can.

Even if they just get her back and say to the people who have her "I can see why you were so confused" and put it down to just one big mix up.  But you Sadie have a different theory than mine.

If by some miracle she is still alive the priority should have been to get her back but alas that doesn't appear to be the case.  SY are more interested in finding someone to blame so that they can justify the £11 million spent on the case.
