Without any trouble.  The Fenn balcony looked straight down onto the steps leading up to 5a.

I think you'd struggle to, from a seated position on the Fenn balcony, to easily see below the small roof.

How does this following description of the man leaving the gate equate with the gate at the side of 5a? Isn't CT really describing a man leaving the gate to 5B or 5C, both located on the alleyway & of which she'd have had an uninterrupted view?

I think you have a good point for CT doesn't seem to know where she is in relation to the apartment as a whole, so how does she know that the man is leaving the McCann apartment.

The point is - CT saw which direction he went after leaving the gate but did not see whether he went up or down the "supermarket street".  If the man had departed by the side gate of 5a she would have seen him go either up or down the hill (or cross the road) but she didn't.

But my point is it sounded like Russell O'Brien so if it was Russell leaving his apartment or Matt's apartment that is no big issue.  CT seems so poor with directions I wouldn't spend too much time on it.

I agree that's who she saw leaving their own apartment. Jane and Rachael played tennis and when they returned around 2.30 pm Matthew and Russell went to the beach to sail. The women and children followed later when the kids woke up from their naps.

The only question is why there was only one of them and why he was seen at or after 3.30 pm by CT.

The other could have left via their front doors therefore out of sight from the  Fenn's veranda.

It is weird that they didn't leave together but the only way you can lock up these apartments is if someone leaves from the front door.  They must lock the patio door from the inside and lock the front door as they leave (double lock it if you want).

The incident happened on Thursday.

CT'We were all seated on the terrace, hummm'talking, and I was inclined to look below and this is when I saw someone leave the apartment of the first floor, closing the gate very gently as they were leaving, opening and closing the gate with much caution and in silence. It appeared to me very strange. They looked to one side and the other, shut the gate and walked very quickly downwards. It was at this point that I turned to my aunt and my husband and exclaimed 'That was really very strange',

Carole Tranmer doesn't define what apartment she is talking about "the apartment of the first floor".  How do we know she is talking about the McCann's apartment or which other one?

Where she describes the direction as downwards that does make it sound like the McCann gate rather than the other apartments that had their gates opening into the lane.

I'm going through CT statement again and I notice this "DC1485'Okay Carole. I have read your statement from the 8th of May, 2007, more or less one week after you saw the individual. It would be easier if you read the statement yourself and tell me if there is anything you want to add.

Do you think it is odd that her original statement is not in the file?
Do you think it is odd that her E-fit of the person seen is not in the file?
