Alleged Miscarriages of Justice => Jeremy Bamber and the callous murder of his father, mother, sister and twin nephews. Case effectively CLOSED by CCRC on basis of NO APPEAL REFERRAL. => Topic started by: Padgates staff on November 29, 2012, 01:20:24 PM

Killer Jeremy Bamber has failed in his latest High Court action to overturn a conviction for murdering five relatives 27 years ago in Essex.
Two judges in London rejected a judicial review application.
Bamber challenged a refusal by the Criminal Cases Review Commission (CCRC) to refer his case back to the Court of Appeal as a miscarriage of justice.
The CCRC, an independent body which investigates possible miscarriages, rejected Bamber's last appeal in April.
The decision on Thursday follows a single judge rejecting Bamber's application for permission to seek judicial review of the CCRC's decision after he studied the case papers in private.
Bamber made a renewed application dealt with by Sir John Thomas, president of the Queen's Bench Division, and Mr Justice Globe.
Announcing the decision, Sir John said that having looked at the approach taken by the CCRC in the case he could not see "any way" in which a challenge could be made to the decision reached.

Very well done to everyone who have participated in the Jeremy Bamber debate. Those of us who have spent many hours seeking out the facts in this dreadful case have always known that he was guilty. I will add that had there been the slightest evidence to the contrary I for one would have been very willing to revue my position. As it is, no such evidence was ever brought to the table with those idiots who have campaigned on his behalf simply resorting to propaganda and lies.
This effectively brings Bambers case to an end in the UK and about time too. If Bamber had an ounce of decency he would admit his guilt now but somehow I don't think he ever will!

High Court Judge Refuses Permission for Judicial Review of CCRC Decision, 29th November 2012
“It appears that the threshold for my case to be referred to the court of appeal is much higher than in most cases but that doesn't make me any less innocent. The law it seems, simply does not apply if it assists me in proving that I am wrongly convicted. The Commission have been given powers that allow them to dismiss forensic evidence without addressing it or having any valid reason and they are fully supported in this by the judiciary.
The Commission is clearly set up not to refer the cases of innocent people but to refer only on points of law which means the innocent are stuck in a system that does not recognise them. The route to the appeal court needs to be readdressed as the CCRC is not fulfilling the purpose it was originally set up to do which is investigate possible miscarriages of justice. It is underfunded and under resourced and as a result leads to inexperienced case workers, and poor relationships with their clients.
Since the CCRC’s triennial review is upon us let’s hope there can be some improvements to the way in which they operate. I have no choice but to re-submit my case to the Commission with a large amount of fresh material and forensic work. I hope it will not take them another 8 years to review my case again as my life is being wasted simply waiting for the Commission to ignore valuable, credible and expensive forensic evidence, which is always submitted within their guidelines. I am not the only person to suffer at the hands of a system that just does not work and more must be done to aid the victims of injustice."

Good afternoon and what a wonderful day this has become.
Mr Bamber has become like a broken record. Yet again he has fresh evidence at his disposal the second a decision goes against him. Has he yet to realise that he isn't going anywhere for a very long time?
I commend the Royal Court of Justice and the CCRC for their unswerving efforts in this case. A decision has been made today which will have far reaching ramifications for all similar cases now and in the future.

Thank you John for setting up the forum and for spending so much time presenting the facts. This case is now over and those on the other forum who think a new claim to the CCRC by Mckay is going in any time soon are sadly deluded.

Bamber has had unique opportunities for reconsideration of the validity of his conviction and the rejection of his JR application must surely represent the last chance saloon for him. Intelligent lawyers like NGB and Mr McKay must be looking for a way out without losing face. I cannot beleive that they really consider this to be a genuine miscarriage of justice . The core members of the blue forum continue to prattle on about Jeremy's phone calls, WHF window latches and other minutiae without any real insight into how the end game has now been reached. It just seems to be a bizarre sort of hobby for some people, but I guess that that there is nowt so strange as folk. ( I hope that my comments do not breach the terms of the " truce " ! )

No problemo, I would rather see people post it as it is. The blue forum seem to be lacking in reality where Jeremy is concerned, this continual nonsense about new evidence being found has a half life all of its own. We all know of course that this is all fiction, all in Jeremy's head and basically a load of tosh. There is no fresh new evidence, there never was any fresh new evidence and there never will be any. Sad but true!

Well put John and thank you for giving us the forum to voice our support for JUSTICE in the Bamber case. We all knew the judges would do the right thing because we have read the mountain of evidence that proves Bamber guilty time after time! It's not rocket science Bamberettes ... NGB and McKay know damn well he is guilty ... stop looking at 27 year old photos of the angelic Bamber and wishing he was innocent ... he isn't!
Like you John, if there was the slightest doubt in Bamber's guilt I would give Bamber the benefit of that doubt, The bottom line in my opinion is that Sheila wouldn't have done those murders! The bottom line in law and to anyone who applies dispassionate commonsense is that Sheila COULD NOT HAVE COMMITTED THOSE MURDERS!
Another good day for justice just as we expected!

Aggie probably has more insight into this case than anyone, and is always a supremely respectful poster. But if Bamber is relying on Sheila shooting herself in the kitchen, then getting up and running upstairs without any bloodflow from a shattered throat, then I'm afraid that theory is f..ked.

Jeremy's position would appear to be that Sheila was shot in the kitchen before making her way upstairs and all this before the cops entered the house. As you have pointed out this would have been impossible given the more than adequate forensic evidence available to us.

Whats political about Bambers case in any event??? Both the Labour and Tory parties have presided over his imprisonment over the last 27 odd years so it makes little difference. Every judge who has ever reviewed the case comes up with the same decision. There have been enquiries and witch hunts but nothing ever changes because it cannot change. Bottom line is Jeremy Bamber is a murderer.
-
AA and Patti (and a couple of others) have always been respectful Bamber supporters and I have no problem with that. In my opinion their logic is based upon wishful thinking but thankfully the law relies upon cold hard facts.
The Bamberettes theories always have an element of police corruption as a garnish but even their professionals like NGB and McKay have to include ridiculous 'ritual cleansing' or 'heating the rifle end in the aga' fairytales to try and make their stories fit! But they can still never explain how Sheila could possibly be unmarked and forensically clean after murdering 4 people, battering her father into submission and shooting herself TWICE!
How did Sheila ritually cleanse herself of the gunshot residue after she shot herself the second time, killing herself instantly? Oh I know, it must have been corrupt/incompetent police and scientists!
The game's up NGB and you know it ... can we now have your honest opinion as to Bamber's guilt or innocence please?
I honestly do not believe NGB and Simon McKay actually believe Bamber is innocent. Has anyone ever seen NGB state Bamber is innocent in his opinion?

Essex: Family of killer Jeremy Bamber welcome court’s decision.
RELATIVES of killer Jeremy Bamber have welcomed a decision to throw out his latest legal bid to overturn a conviction for murdering five members of his family in Essex 27 years ago.
Bamber, 51, wanted to appeal a refusal by the Criminal Cases Review Commission (CCRC), the independent body which investigates possible miscarriages of justice, to refer his case back to the Court of Appeal to be looked at again.
The hearing followed the rejection by a single judge of Bamber’s application for permission to seek judicial review of the CCRC’s decision.
But yesterday his renewed application was refused by Sir John Thomas, president of the Queen’s Bench Division, and Mr Justice Globe.
Bamber is serving a whole life sentence for murdering five relatives in Tolleshunt D’Arcy in 1985.
He has always maintained his innocence and claims his schizophrenic sister Sheila Caffell shot their wealthy parents, June and Neville, and six-year-old children, Daniel and Nicholas, before turning the gun on herself, in a remote farmhouse.
Yesterday his extended family said they were pleased with the High Court’s decision but spoke of the “horrendous” pain they experience each time Bamber has appealed his conviction.
The CCRC’s decision is now the fourth attempt Bamber has tried and failed to get his conviction overturned.
Karen Boutflower, the wife of Bamber’s cousin David, said: “We are pleased with today’s outcome but every time he tries to appeal it’s awful, horrendous for us. It just never goes away.
“I think he does it because he’s got nothing to lose and nothing else to do or think about. But we have no doubt he’s guilty, you only have to read the forensic report to know that.
“Sense is prevailing, there is no new evidence and nothing has changed.”
Sir John, announcing the decision of the court, said that having looked at the approach taken by the CCRC in the case he could not see “any way” in which a challenge could be made to the decision reached.
In a statement posted on his website, Bamber said: “It appears that the threshold for my case to be referred to the Court of Appeal is much higher than in most cases but that doesn’t make me any less innocent.
“The law, it seems, simply does not apply if it assists me in proving that I am wrongly convicted.”
His latest request for an appeal was based on a fresh analysis of three burn marks found on his father and gunshot wounds on his sister.
Commenting on this appeal Mrs Boutflour said: “Killing five members of your family is inhumane and degrading so I think he is in the right place.”

The problem is that the Bamberettes dont think its over at all. That's why they are going on about the new claim to the CCRC. I'd be really surprised if Mckay carries on with the case in any capacity. Without him, what are they going to do. I'm sure no other lawyer will touch it with a barge pole.

Bamber's case is well and truly at the bottom of the heap now, but there will always be a handful of delusional people who believe in him, Bigfoot and the Loch Ness Monster, so it doesn't hurt to keep a profile on here to remind them, and anyone new to the case, exactly why his conviction is safe.
And thanks, Mike, for changing tack YET again. As with Ali Bongo and Z, you have undermined any work that you have previously done. More to be pitied than scolded, I suppose. 8(8-))

The problem is that the Bamberettes dont think its over at all. That's why they are going on about the new claim to the CCRC. I'd be really surprised if Mckay carries on with the case in any capacity. Without him, what are they going to do. I'm sure no other lawyer will touch it with a barge pole.
Totally agree frank. Didn't the CCRC ask for all the evidence to be presented the last time so anything they conjure up now will be viewed with disdain imo. I would love to know how much the CCRC has spent on this silly case over the last few years and then we will see if they are value for money. I feel a FOI request coming on.

And how much did the Arizona gun tests cost? And who financed them? (Hush, Luggy, I know really.) A dead, thick lump of pig rind, with no blood supply, compared to the delicate skin on a living person. But all is not lost, old Colleen Cropper promised to pay for further tests. Whoop de doo.

We know that not everyone uses twitter but the propaganda continues every day by the campaign team. We take great delight in responding to each and every tweet...it must drive them up the wall.
Our tweets are retweeted far and wide by other users and it is seldom that we get any negative responses. One which does stand out however was received on Christmas Day by an exasperated twitter user who asked if we could desist for just one day! We sent him a link to the banned Diana film to keep him occupied for an hour or so. Think he's still watching it. @)(++(*
ps If anyone wants to see it, it is still available online from our Russian friends.

How do people find the time to twitter, facebook, myspace...blah blah? It's like brain diarrhea. "I've just had a hobnob, a cup of tea and a hysterectomy...lol....rofl..." Oh, good grief.

We find that people like to communicate in short bursts of activity these days and twitter and facebook etc are ideal. It's all down to new technology and the various small mobile devices we all use nowadays. One advantage too is that tweets can be made from the courts so effectively the internet blogger is now beating the Press to the draw.

And, in the spirit of the truce, we could do worse than live by the words of the immortal Lugg.
"Nothing is forcing you to read the posts. You make me laugh really. If you don't like what you read, then don't read it. PLAIN AND SIMPLE."
Live by the keyboard....die by the keyboard.

I get that, but to my own detriment I realise that a single pissed-up post will be out there forever. Very damaging. If I was trying to help a MOJ, I'd think twice before the whole world watched my brain unravel.

Never go to a party, then come back a bit pissed and cross, and gunning for an argument. And never pluck your eyebrows when you're smashed.
I once had a very convoluted discussion with the legend that is Bob, about why Bamber isn't more angry. I would be so angry. I wouldn't be mild, and accepting, I'd be fighting the f..king system every step of the way, every day of my life. I would PROVE that I was in bed when it all kicked off. But....the phone call. From Ralph. The one that proves that either Sheila or Bamber was responsible. Oh dear.

I think it has a lot to do with being institutionalised Shona. Most prisoners begin down this road after three or four years inside so for someone like Jeremy with 27 plus years inside he must consider Full Sutton to be home. He will be very comfortable in his surroundings and will have formed an inner ring of trusted inmates around him.
Any publicity is a bonus to him, a little chink of light in an otherwise dark existence.

And one thing that everyone has missed up to now. A long blood stain on one of the cupboard doors. You have to really look, but it's there.
-
And the round marks beneath the bible. Mike tried to make some fantasy shit from them. It was Bamber wiping the blood from the silencer.
-
Forensic pathologist Dr Vanezis made some really good points in his formative report on the case when he referred to the state in which Sheila was found. The position of the rifle on the body was all too convenient as was the that of the Bible. Like Adrian Prout, Bamber made fatal errors in his haste to cover up his crime.

Which cupboard door do you mean Shona? The bedside cabinet one, built-in cupboard one, or one on this new website that you mentioned before and that I asked you about, but you never replied?

Are you going to have one? We were going to have a chinky, but I went to Iceland this afternoon and bought some of their party stuff, and I've eaten most of it. So now I'm full of salmon parcels and chocolate strawberries. And I feel sick.

It's no good, I can't be Bambering anymore tonight. It's a toss-up between watching the rest of Kill Bill, or going to bed with Arthur the pug and Horse and Hound. Goodnight, all.

Oh, ffs. BT has put his hair in a bun and shoved a chopstick through it, and is doing some sort of kung-fu caper shenanigans. No sleep for me tonight unless I can dart him. Again. ?8)@)-)

I see that the Jeremy Bamber Twilight Retirement Home are busy libelling Julie this morning. What a brave bunch. Lucky for them that no one takes that forum seriously.
