Rape is a notoriously difficult crime to prove.

Even with Brueckner's pubic hair being recovered from the scene of the crime he appears to be sticking with the cat excuse.

If Ms Behan's rape is brought to trial which I think it will be ~ I would be surprised if the argument on her behalf might not be bolstered by the boxes ticked in the crime against her when compared with the boxes ticked in the crime against Mrs Menkes who - told police: “I felt that he enjoyed torturing me.’’  and put her through what she believed was a “methodical procedure” which was “long and planned”. https://www.dailystar.co.uk/news/latest-news/madeleine-mccann-prime-suspect-enjoyed-22140786

The outrages were remarkably similar and I'm sure those similarities will give the judges evidence worth pondering about.

This article is almost two years old and still no charges have been brought against Brueckner. Doesn’t seem that the police are in a hurry to get justice for Behan either.

Hair yes, pubic no.

Yep, a big curly ginger pube. Along with his cat stroking excuse, it was actually part of CB's defence case that the hair found couldn't be his because it was reddish and his hair is blonde. Unfortunately for him, a DNA match trumps any assertion that you can't have ginger body hair when your head hair is blonde.

It's all in the case evidence files (and published in the German press). You love evidence. Maybe you should expand your interest beyond the PJ files.

The German Judiciary have got at least another four years to make any cases they might have in the pipeline.  And of course they are dealing with Judges, so no problem with Trial by Social Media.

I am not entirely sure that this is a good idea, but it is their Justice System.  And I am a trifle hidebound as I only really understand Trial by Jury.

From the prosecution point of view, it makes sense to leave it a while before presenting the Behan case, imo.

If the case runs whilst his present prison sentence still has yonks to go, any new sentence would probably run at the same time as his present one, and that would not only be unsatisfactory for some, but also would reduce the time that the German investigators have to deep investigate, both her case and the Madeleine possible connection.

All IMO

Bit of a flippant remark there. Again, what's the rush? The guy is already in Prison. What's more important, taking the time to construct a case that is going to stick, or getting it done quickly? It makes no difference to the total time he serves whether he gets convicted now or in a few years time. Also, if the fingerprint evidence is true, that is a much more recent discovery from when this article came out.

Also, don't forget there are a lot of legal obstacles in place. The victim is Irish, the crime was in Portugal and the Germans want to prosecute. Add to that CB is only in Germany due to an extradition agreement which also need amending to include any further charges. There is a lot of cross-jurisdictional wrangling to be overcome. And going back to what I said earlier in the thread, the Germans seem to be exploring the possibility of a joint indictment in several cases. This means the overall process is inevitably going to take longer.

This is a possibility.  I don't know enough about The German System to be sure.  But we certainly don't want that to happen.

Off the top of my head >>
Re-opening Hazel's case is most certainly not an easy thing to do for a variety of reasons.
  • without doubt it is a Portuguese case which has run up against the Statute of Limitation in Portugal
  • all the physical DNA evidence was destroyed
  • co-operation between Germany and Portugal and all the legal intricacies would take time to be worked out
I don't think the amount of time which has passed since Hazel was physically sick when she recognised and compared the similarity of her rape with the rape Brueckner was convicted of is remarkable - I just think it nothing short of miraculous that she is on the brink of having her day in court and the chance of justice.

"All I'm going to say is that we've conducted a very serious investigation and there's no indication that Madeleine McCann's parents are connected to her disappearance. On the other hand, we have a lot of evidence pointing out that Christian killed her," Wolter told the "Friday at 9"....

If the evidence is true about the fingerprint then it would undeniably put Brueckner at the scene of the crime so there would be no reason why charges could not be brought no matter what other elements were being considered. Therefore I think it’s safe to assume that the fingerprint story is simply more newspaper twaddle….the kind that certain individuals seem to lap up.

As to legal obstacles, these seem to have been deftly navigated in the case of the rape case Brueckner has been convicted of. Have we any real reason to believe that the same cooperation and mutually satisfactory outcome could not be achieved speedily again in the Behan case?

Wow. You just completely ignored all the legal complications I pointed out and resorted to the argument of "if they got fingerprints, they charge!". Genius.

And since you are such a legal expert on all this, tell me how you think all these legal obstacles were deftly navigated in the other rape case then? There was nothing deft about it!

It was an all round struggle, not least due to fact the Portuguese authorities have been so deliberately unhelpful and laboured. Do some research. In case you've forgotten, it was taken to the European court of appeal and his conviction was very nearly overturned on the techincality that the Germans didn't obtain the correct extradtion paperwork. Thankfully they were helped out by the Italians in all this mess and the conviction stood.

You have absolutely no idea what I'm talking about either do you?

Maybe don't assert such strong opinions on aspects you have absolutely no clue about.

Faithlilly isn't a moron.  She just doesn't see things in quite the same way that we do.

Sorry.  I am not a moderator anymore.  But I no longer feel restrained.

So take your pick, any of you.  But I don't like it when anyone is being insulted for personal beliefs, even if I don't understand those beliefs.

Fair enough. I amended my comment. I would just say it was the logic I was criticising, not her personally. I have no real knowledge of her personal beliefs so I'm not sure what you mean. But she has not shown me any respect, quite the opposite, so I have difficulty in showing any back until it is warranted IMO.
