Amaral's Sentence has not been annulled.

Says who?!

It is part of the "acordão".
Don't you think that if a person that accused others has been found to have lied, and guilty in a court of law, those that have suffered the consequences of that person's actions are inevitably
Quote
innocent
?
Not annulling their sentences would be( with the due distance) like keeping a murder convicted sentenced even though the assumed murdered person emerged as a living individual.

Cite pleae.

I believe this is an erroneous assumption that you are making.

Two Portuguese Courts have ruled that Leonor Cipriano was Tortured.  Just because she and they don't know who tortured her does not mean that it didn't happen.

WRONG.
One portuguese Court ruled that she had been tortured, although they couldn't identify the torturers (from among the 5 persons her lawyer orchestrated her to accuse - remember your friend M.A.C?), so as the 3 couldn't be found as torturers, because they weren't even in the premises when the alleged torture occurred, what was left was to accuse the other 2 for non reporting (occultation) and false testimony.
That trial was a shameful event and one that we, portuguese, shall never forget as long as Marinho Pinto and the former Attorney General live

No, you are wrong.  Amaral's sentence was confirmed on Appeal in a higher Court, along with the sentence of his cohort for Falsifying Evidence.

Or should we now doubt the ability of The Judges and The Courts to reach a correct verdict?
Mind you, I might actually agree with you on that one.  The Original Trial of The Ciprianos was indeed shameful.  And from what I have seen in The Portuguese Media, quite a lot of Portuguese people agree with me.

If Amaral's sentence had been annulled surely there would have had to be a formal annulment in court - do you have the details of this?  Has it been reported in the PT press?  I'm sure it would be big news over there, so please provide the links.

I told you, it's in the "Acordão". If you pay me I can think about translating it. Your friends the McCs might consider covering the expenses by their Fund.

Who is this chap Amaral?   Was he one of the detectives on the McCann case by any chance.

Yes, he was, although how he came to be in charge of The McCann Case when he was made an Arguido on the day after Madeleine disappeared, will forever remain a mystery.

Lets be clear posters.   The person mention in this thread has not....repeat...HAS NOT...broken any Law nor been charged with any crime thus to speculate on this subject on this forum is unacceptable.   All references to this individuals name and the unsubstantiated allegation have been removed.

The conduct of certain individuals on Twitter is reprehensible.  For this social media site to permit impersonation of a respectable professional in such a manner says much more about the administrators of the site that it does the abusers.

Aye, there´s the rub- The McCanns have not been charged with any crime or broken any law- same as the individual. Yet people alleging that are allowed to post here.

How is your petard?

Excuse Mr. Administrator,
I find your position very honorable and condone your decision to forbid any unfounded accusation on any people.

Yet you allow that same treatment, that you now condemn, to be used towards Dr. Amaral, that although had been condemned to a suspended sentence for false declarations (because he signed the day sheet of his undergraduate where there was no reference to any torture session) had his sentence and condemnation annulled when a Court in Faro found that the accuser had lied and was sentenced to stay in prison for a further 7 months.

I hope your sword is not twisted.

Thanks

Luz

I have asked you several times for a cite that Amaral is no longer under a suspended sentence of imprisonment.

You seem to keep forgetting to post it.

Read my answer to your colleague.
If you are such a clever person you can get to the transcripts in the Court of Faro and use any translator.

Obstinate person.

If you cannot produce evidence for a statement you made, we are quite justified in beieving that what you said has no substance at all.

Thisd is like when I asked you to quote the law on Child Neglect in Portugal- you refused to do so becasue you knew that it required INTENT but did not want to have to admit you were wrong.

You are beginning to look a little dishonest and silly.

Are you telling me that the PT press couldn't be bothered to report this momentous turn of events when they reported that Cirpiano received 6 months for being tortured but being hazy on the details?

We are quite entitled to just believe that she has manufactured this just as she lost the Portuguese Law on Neglect.

I guess the conviction will eventually lapse naturally.

How long was it suspended for?

And will Amaral still have a criminal record after it has lapsed?

I think you might find that Amaral has already served his time.  Perhaps that is what Luz is talking about.

On the matter of Translations, I would rather rely on Google, or Pedro, or Heri, if he feels so inclined.

Convictions don't lapse surely?

The suspended element of it would, after the period that the sentence was suspended for had passed.

What I'm unsure of is whether there is an enduring criminal record thereafter ...

Amaral would surely still remain with a Criminal Record, but has now probably served his time on this one.  Remember that his Sentence was Suspended because it was a First Offence.  So obviously these things stay on record.

"Joana Morais said... 9 Roseanne, blame it on the lazy Lusa journos who just copy/pasted the extra bit from the end results of the previous trial (2009) without adding any information as to the consequences of Leonor being convicted for making false accusations - but I did try explain that in the notes bellow the news article. And yes you are right, the two PJ inspectors were wrongfully convicted and their sentences will hopefully be overturned soon, or as soon as possible since we're talking about Portuguese justice. There are still other issues, as pointed by dagama and myself in this blog, regarding the roles of certain people in this affair, which need or deserve to be fully investigated and taken to court."
