IMO, the difficulties show that applying for Ward of Court status was a sensible one.


I'm still mystified as to where the question to Kate about her wanting to hand over custody to a relative came from...

The only connection that comes to mind is that the PJ "misunderstood" the purpose...

The quoted reasons for making Madeleine a ward of court seem to have been related to a possible need to obtain evidence not normally available to the public such as telephone records and airline bookings. No doubt the court could ask for DNA tests to be performed in another country, but I would imagine that country would only comply if they thought the request was reasonable.

I thought one of the main reasons was to prevent any convoluted legal wrangling which might occur between 'adoptive' parents and natural parents - because as a WOC she would have to be immediately handed over the the nearest British Embassy?

Don't know.  But The British Embassy has got to get their hands on her first.  This would be the difficult bit.

Ward of Court status often applies to adoption or other situations related to a child's welfare.

I haven't. I'm therefore wondering if the PJ had "misunderstood" the purpose of applying for it.

And how exactly were they going to get her DNA in the first place?  Believe me, I have considered every angle I can think of on this one.  And apart from a passing chance there isn't one, if the supposed parents refuse, which they will obviously do if they are guilty.

Exactly. I agree with you on this one.

That pleases me more than you might think.

I am working on the theory that Scotland Yard knows where Madeleine is, but can't actually do anything about it.

All speculation, of course, but worth thinking about.

Drawing inferences from refusals is a slippery slope.

That isn't my point, but you know that.  Anyone can refuse.  But especially The Guilty.

I am just exploring how difficult it would be to establish that a child is Madeleine, since some Courts are now refusing DNA Tests.

The lawyers then talked to us
about applying for an order to make Madeleine a
ward of court.
Wardship status gives the courts certain statutory
powers to act on a child’s behalf in any legal
disputes and to bypass some of the data-protection
laws that deal with access to information (hotel guest
records, for example, and airline passenger lists),
when knowledge of this information is considered to
be in the interests of the child in question. Such an
order could be useful in acquiring records not
otherwise available to us that might be relevant in
our case. We decided to proceed with an
application, which was granted in due course
Madeleine chapter 8.

They used the Ward of Court status to try to get the evidence held by Leicestershire Police, but it didn't work.
