I think 'prosecute' is the key term here. Portugal want to 'investigate', if we use the spirit and letter of arguido status. Portugal would have to declare an intention to prosecute post an investigation being concluded.
Tell me I'm wrong. No seriously, tell me I'm wrong and show me. (because I speed read it and CBA to read that entire thing).

If only you'd taken the opportunity to read a link I posted previously...

 ARGUIDO
(The status of “arguido”/ defendant)

The status of arguido (defendant) is granted when an inquiry has been opened or an investigation is led regarding a specific person, if there are grounds to suspect that such person has committed a criminal offence and when that person is heard by a judicial authority – Public Prosecutor or Examining Judge – or a criminal police body, or where a coercive or patrimonial guarantee measure must be imposed or the suspect is detained. When acquiring the status of arguido, the person benefits from a set of procedural rights and duties covered by law.

Under this status, the person is no longer a simple participant in proceedings, differently from the suspect who does not have a specific status, but is indeed a subject in court, and has the right to: be assisted by a defence counsel; attend all procedural acts that directly affect him; be heard in court or before the examining judge whenever they render a decision that may personally affect him; be informed on charges against him prior to making statements before any authority; take part in the inquiry (and in the examination – instrução - before the Examining Court) by providing evidence and requesting any measures found necessary; request the opening of the examination stage (instrução) where the Public Prosecutor has formally charged him, in order to challenge this decision and to prevent it from being submitted to a criminal court.

You seem to have misunderstood. 'Investigate' is the key term and absolutely nothing to do with the Portuguese term 'arguido'. We were discussing the EAW, for all that is holy.

The status of arguido is relevant to the terms of executing an EAW.

If Portugal decide to arrest CB they'll need to ask Germany to do it, not Italy.

Its because the victim is British the alleged  crime was in Portugal the alleged perpetrator is German and to top it all its seems as if CB's last days of freedom were in Italy and permission is needed from them to proceed because the alleged crime's of abduction and murder were not on a eaw, simples . Just shoot the barsteward so much easier.

I've just finished listening to the complete episode. There was nothing that we hadn't heard already & IMc is still denying that Diana M was raped. She also only mentioned one alibi witness for Brueckner, not four. A right crock of ***** and a waste of an hour of my life.

What evidence is there she was raped?

If your evidence is the conviction for rape, then I'm sure you'll agree Joana was murdered by her mother & uncle.

It shows what a twisted lot some sceptics are.  She said that CBs child porn was merely photos of his girlfriends.. daughter.. That the paedophilia offences he was jailed for were from when he was, 17......and that the American rape victim suffered from alzeimers and the medical report shows she wasn't raped

Proof if proof were needed of the sceptic tendency to downplay, deny and deflect from CB’s horrendous crimes.  Talk about broken moral compasses…

You are quite wrong, perhaps because you don’t spend enough time on this forum and perhaps you didn’t even read the post I was responding to?  If that wasn’t repulsion and blame being shown at the parents for “allowing” their child to be abducted rather than at the person who (allegedly) abducted her then what was it in your view?

Well thankfully I spend more time in the real world and less in the rabbit hole of internet analysis of the case, and it was a general point I was making, It is perfectly reasonable to examine the evidence and to question the accepted narratives of both sides without downplaying the repulsive crimes of rape and paedophilia.

If CB is a patsy then it's precisely the revulsion we feel for his convictions that make him the ideal patsy, imo.

If Brueckner is a patsy who do you think has set him up?

If Brueckner is a patsy why do you suppose that those allegedly setting him up omitted the rather obvious ploy of contriving to put in place a slam dunk piece of evidence irrefutably confirming his guilt?
