Title: 27 Times...
Post by: Holly Goodhead on July 19, 2019, 09:54:47 AM
This is the number of times approximately GM/KM departed the unlocked patio doors during the evenings.  If they left @ 8.30 pm for tapas and checked every 30 mins with the last check at 11.00 pm this would amount to 6 x's Sun - Wed and 3 x's on Thu.  Most people will either sit out on the balcony and then go in when it gets cold/dark sliding the doors closed and locking them from within.  Or most people will go out for the evening via the front door which can be locked from outside and reenter this way too.

Also please bear in mind how strange this might have sounded to Mrs Fenn who had lived above the McCanns for some 4 years.  She would come to know what was usual and what wasn't with regard to the habits of holidaymakers.  I would suggest hearing the patio doors sliding open and closed several times a night was not usual.  I've lived in a well appointed apartment and sound travels especially doors.  It's not a case of being nosey but just taking on board ambient noise from the environment.  Although in the case of Mrs Fenn she might well have been somewhat hypervigiliant having sustained a recent attempted burglary.

Once T9 were seated in the tapas restaurant many could observe from vanatage points all this to and fro activity?  Furthermore, according to BO, the group was, perhaps unsurprisingly, rather loud!

It is the above imo that makes the case extremely unusual coupled with having someone who was aware of the above and chose to use it to his/her advantage to procure a child for whatever reason.

Two highly unusual events coming together.

You could have a situation where a family did what the McCanns did every night for 10 years and not have a problem.

You could have a situation where the most dangerous would be child abductor lived on the complex for 10 years and not have a problem.

The problem arose simply as a result of the two situations above coming together and colliding ie a freak occurrence.

Do you have any evidence that the patio doots were left open every evening? They weren't on Sunday evening according to Gerry MvCann;

That they left the house by the main door, that he was sure he locked, it being that the rear door was also closed and locked

I thought we covered this previously/recently?

The McCanns confirmed they left for tapas at 8.30pm every night via the patio doors.
The McCanns confirmed they checked every night via the patio doors.
RO who checked at circa 9.30pm on 3rd May confirmed he checked via the patio doors.
Mrs Fenn confirmed she heard the parents enter on 1st May at circa 11.45pm via the patio doors.

Here's the reconstruction vid and at approx 13.30 in GM confirms they carried out the checks via the patio doors so as not to disturb the children by using the front door which was a) nearer the children's room and b) may well have made more noise in closing it than the patio door in sliding it over.

Maybe, but I don't think only my posts are relevant.  I look at this forum as a team all working together to possibly solve this case.  There is enough dedication and brain power to do it IMO.

I'm not sure if you feel part of the team as yet.  You are more like me about 3 years ago.

I agree it is teamwork.  Many pairs of eyes from different backgrounds.  Also we are not under any pressure or expectation.  Plus we have not been trained to look at something in a particular way which can help imo in the more unusual cases.

But I have not just looked at this case so I bring knowledge from other cases which helps.  Eg I know the LCN DNA tests are meaningless based on the research I did on Bamber.  I know wit stats and timelines are only ever approx and will always show benign inconsistencies based on Bamber, Essex Boys and Jill Dando/Barry George.  I know efits and witness sightings are unreliable based on Jill Dando/Barry George.

You're not quoting facts, Holly. You're quoting what two witnesses said are facts. The witnesses may or may not be telling the truth.

Was Russell telling the truth about Sunday evening? He claimed he used the patio doors to check the McCann children, but both McCanns claim those doors were not unlocked on Sunday.

Mrs Fenn assumed the parents had arrived when she heard the patio doors open, but she didn't see them. It could have been one or both arriving or leaving or even someone else.

Mrs Fenn heard what she thought was MM crying on 1st May from 10.30 pm to 11.45 pm.  She also heard a child calling Daddy, Daddy.  Apparently all of this got louder and more expressive to the point she was so worried she felt the need to call a friend and discussed.  At approx 11.45 pm she heard the patio doors open and the noise ceased.  If this wasn't the McCanns entering who do you think it was?

By calculating how many times the patio doors were used to enter/exit 5A you're inferring that you accept as a fact that they were so used.

Why might people say the patio doors were unlocked Monday-Thursday evening if they weren't? Obviously I don't know, but hypothetically to hide the fact that they were only left open on 3rd.

You may agree with Mrs Fenn that the patio doors were heard sliding on Tuesday because the parents were returning, but as neither of you saw them it's still an assumption. The fact is that she heard the patio doors, not that it was the parents moving them.

But to make progress you have to use reasonable and sensible inferences.

You say you obviously don't know why they would say they used these doors it they didn't and that's just it there's no reasonable explanation to explain why they would say this if it wasn't true.  Even if one takes the position they were directly involved in MM's death how does having the patio doors unlocked assist?

Agree Mrs Fenn did not see the McCanns arrive but I think its reasonable to draw a sensible inference:

- Mrs Fenn hears what she thinks is MM crying and calling Daddy, Daddy which gets louder and more expressive
- This noise goes on from 10.30 pm to 11.45 pm
- At 11.45 pm Mrs Fenn hears the patio doors open and the noise stops

If the above wasn't the McCanns entering 5A having just left tapas who was it and what caused the crying and calling Daddy to stop?

For their claim of abduction to work, the patio door has to be left open. Part of the staging.
If it were left open only on Thursday, this would look odd, so the door needs to be left unlocked every night, so as to establish the routine - even if it wasn't.

IMO

But why does it have to be abduction from 5A and not outside?  I just made a post on the other thread; if they wanted to stage an abduction then why not dispose of a pair of MM's footwear and KM/GM could say they found patio doors slightly open along with child gate and gate leading to road?

If the patio door was 'staged' why also 'stage' the bedroom shutter and window?

I think most would agree Mrs Fenn is a reliable and independent witness and it is sensible imo to infer from her wit stat the patio doors were unlocked when McCanns returned from tapas on 1st May.

An alternative scenario is that Gerry opened the front door with key and then opened patio door to let Kate in, as he done during the day.

Unlike you, I don't believe there was a stranger  abduction.

But a) Mrs Fenn didn't hear the front door open and b) why would GM at 11.45pm open the front door to enter 5A only to then open the patio door to let KM in?

But there are very few things in life we know about for sure.  Even in the criminal courts the accused is found 'not guilty' or 'guilty beyond reasonable doubt'.  There's nothing for sure about it.  If there was we would not have miscarriages of justice.

I am not emotionally invested in this case.  I can empathise with the McCanns over their plight because I believe in all probability MM was abducted from 5A but tbh I struggle to warm to them.  I hate the BS about keeping an eye on 5A from the tapas and I hate their ill thought out campaign which imo has done more harm than good.

They went out each evening leaving their 3 children unattended. That's for sure

They lost Madeleine due to their poor child care arrangements. That's for sure

The evening MBM was allegedly abducted, was the only night as claimed by parents and some T9 there was any actual physical checking- strange  coincidence.

DP checking on the family before bedtime, Gerry had his loving father moment and Kate finding her daughter abducted!  Mat had a wee listen at the door.. so many checks on that one eve and it so happens to be the one evening one disappears!

OK  so let us go with the every 30 minute check. If this was a schedule they all followed- why the need for versions of a time line and confusion about doors?
leave for Tapas    @8.30
then                    @9 pm
then                     @9.30
Then                      @10pm

We are  told by the T7 that they never checked on each others children so... how many times did Kate and Gerry go and check their childen that eve?   once by Gerry and once by Kate! The fact that they had to  try and remember the times is unbelievable

IMO the only purpose was to make it easier for one parent, the other locked up the patio door from inside and left by the locked front door and came around the long way.

It's a very odd story.  That appears to leave a single parent to negotiate the baby gate, the flight of stairs, and the garden gate, whilst looking after 3 very young children.

The easy route was via the front door, with no flight of stairs, two parents to 3 kiddies.  Gerry testified they did that at least once.   Wednesday?

I believe you are mixing day with night.  Afaik they have always been consistent with the night arrangements ie front door locked and patio doors closed but unlocked and exiting and re-entering and exiting to carry out the checks via the patio doors.

In which case why bother 'staging' the window and shutter too?

Mrs Fenn heard the patio doors open on 1st May and the crying and calling for Daddy stopped at the same time.  To my mind this is sufficient evidence to support the McCanns claims that they exited for tapas via the patio doors and re-entered and exited this way when carrying out the checks along with retiring for the night via the patio doors.  The reason they have given for doing this is that it was quieter to use these doors as opposed to the front door which was nearer to the children's bedroom.

Your counter argument to this is that possibly GM entered via the locked front door, walked through the apartment and opened the locked from inside patio door to allow KM in.  To my mind this is stretching what's plausible to fit a  wedded to narrative.

They all used the long route to check as is told in their documentary.  Since Gerry can't recall or is confused about back and front door it is difficult to analyse properly.Jane certainly walked past the McCanns gate  and around the corner to get to her apartment.

Patio doors make a noise- Mrs Fenn could hear them, she never mentiones hearing front door entry/ exit.

IF an abductor carried MBM out of the apartment via any exit ther would have been some marks as he/she/ they would have to open/close behind them.  Kate claims it was the window. No one else saw the open window/shutters.

With regard to the evening checking arrangements, T4 have always been consistent in that they left all doors locked and carried out the checks via the front doors.  The Paynes had the monitor in-situ and afaik did not carry out any checks and in any event all doors were locked.

When the McCanns arrived at OC they found the cots in the back bedroom (overlooking pool).  They made the decision to move these to the front bedroom (overlooking car park) which then placed the children's bedroom close to the front door, hence when they went out to tapas they exited via the unlocked patio doors and carried out the checks via these doors as it was furthest away from the children's bedroom and made less noise.

I think you've answered your own question in that Mrs Fenn doesn't mention the front door since it wasn't used at night.

Why would any abductor leave marks behind?  Unless they suffered some sort of cognitive impairment or mental illness they would be mindful of what they were doing was criminal and would take basic steps to avoid detection ie don a pair of gloves.

This brings me to the question- why would the dogs follow a scent alledgedly of MBM going out the front door.  According to Kate MBM would have used the patio doors if leaving to fetch them.

If MBM was being carried out the front door how would the dog pick up scent of MBM?

They may use gloves but that would leave smudge marks on door/handles- none were found and going out the window would need a very small professional chinese circus performer.IMO

Would some carrying Madeleine out the front door, particularly carrying her in the method described by Tanner be able to lock the door after them, or would they need a trusty assistant for that too ?

If someone had entered via the patio doors, picked Madeleine up and made an exit via the front door (that type of door where I am from, does auto-lock upon closing), the Tanner sighting is not plausible because of the position of Madeleine’s bed in the room, against the wall at the bedroom entrance and the way the child was carried i.e. head over left arm and legs over right arm. Unless that person was savvy enough to change her position in his arms to mislead the investigation to follow.

The only other explanation, in my opinion, is that the person picked Madeleine up and passed her through the window to someone else, thus the orientation of the child according to Tanner.

There's a simpler explanation; it wasn't Madeleine.

I think it has been discounted that anyone went in or out of the window

The simpler solution is very often the correct one - IMO

G-Unit, are you then believing Redwood’s “revelation moment” that Dr Totman was that person?

Redwood never mentioned any one by name, the lead investigators the press did that.
So it might not have been him.

I don't recall Redwood naming Totman?

I have a recent example where that would be achievable, assuming the door simply pulled shut.
