Where do you think the law stands?
Don't know. But I'm sure the moral reasoning would outweigh the legal implications, or at least mitigate them.
Would you smash a car window to help a dog dying of heat exhaustion? Depends where your moral compass is I suppose.

Oh ok but there's a world of difference between doors closed but unlocked and open doors.  Either way no one had any legitimate right to enter 5A unless of course there was clear signs of imminent danger eg a fire breaking out.  I don't believe a child crying amounts to imminent danger.  If PF was so concerned she could have called OC reception instead of a local friend.

You are giving your opinion which is fine ...but it isn't fact
If CT had entered the apartment through an unlocked door.. to investigate a distressed child she, would be committing no offence

And in any event as I've pointed out PF's wit stat states she heard crying on 1st May and that on 3rd May she did not hear anything not even the opening and closing of doors:

When asked, she replied that on 3rd May she did not hear any noise from the McCann apartment, not even the opening of doors.

Just my opinion of course but Jeremy Bamber is innocent and a couple from UK, unknown to T9, abducted Madeleine McCann - motive unknown.  Was J J murdered as a result of identifying as a goth?

Where's the evidence of a distressed child on 3rd May?

There is no law of trespass

Technically it may be trespass, which is a civil violation. You'd be hard-pressed to push a charge of breaking and entering, given that there was no breaking to speak of and the moral reasons I discussed earlier. Not even the inept, sardine-munching, keystone cope-like layabouts of the PJ would go for that one against a concerned, elderly lady.

Or he?

But if he/she wanted to abduct a child and thought ok if I'm caught I will say he/she was crying they would have to know a) a child was in the apartment and b) they could gain access and c) if caught they could quickly induce crying if the child wasn't in fact crying!

But why would a concerned elderly lady take it upon herself to venture into unknown territory during the hours of darkness which in any event didn't actually happen.  Surely the concerned elderly lady would simply pick up her phone and call OC main reception where she could remain anonymous and just say she could hear on-going crying which appeared to be from apartment 5A?

I understand... According to you... The perp knew Maddie was without adult supervision

Mrs Fenn may not have... But didn't you say your perp may have had altruistic intent

Maybe. Maybe not. I thought we were talking hypothetically, attempting to establish justification for entering the apartment. You categorically stated that nobody had the 'right', wheres I was positing a scenario whereby the act may justified / rationalised by a reasonable person.

Mrs Fenn's wit stat states she heard crying which in her opinion was from a child MM's age and emanated from 5A.  The crying and calling 'Daddy, daddy' started around 10.30 pm and ended around 11.45 pm at which time she heard the patio doors slide open.  What can reasonably be inferred from this:

- MM was home alone
- The patio doors were unlocked

Mrs Fenn's wit stat also states she called local friend Edna Glyn to discuss the siutation.  What can reasonably be inferred from this:

- PF was discussing with others
- Others may have discussed with others
- Others may have overheard

So yes imo the perp was someone who gleaned intelligence from PF that:

- MM was home alone without adult supervision/baby monitor
- Patio doors were unlocked
